Change from District Forestry One to District Residential/Recreational One. Purpose of request is to create 14 lots far residential use. In October the Town Board tabled the application. This application has been tabled from the December public hearing. The Town Board has now denied the application. The Sawyer County Zoning Committee approved the rezone application as follows: All Proposed Sandy Beach Road Lots covenants to be enforced; maximum of 8 lots, 6 on water; no fertilizer use, no dock or walkways; maintain 50' shoreline buffer. Findings of Fact of the Zoning Committee: It would be compatible with surrounding uses and the area. It would not be detrimental to ecology, wildlife, wetlands or shorelands. The Sawyer County Board of Supervisors must ratify the approval of the change in zone district before it becomes final. This will be scheduled for the County Board meeting on February 15, 2007, 6:30 P.M., in the Circuit Courtroom of the Sawyer County Courthouse. This decision is a recommendation to the County Board of Supervisors. Any person or persons jointly aggrieved by the decision of the County Board may commence an action with the Sawyer Colinty Board of Appeals to review the decision in whole ar in part, within thirty (30) days after the filing of the decision in the office of the Committee. Wishes everyone could walk the prop- erty. Bart Gratzmacher: There is a dominant wetland in the middle of the property. There will be a 15 acre parcel that would be left after subdividing. Wants to lmow what the ownership of it would be. Aas been in marsh area on a jet ski from Lovejoy. Howard Mazsh lives on Blue Island Road: Who would enforce deed reshictions? With more and more development more and more of marsh would be opened up by motorboats and jet slds. Fred Bathke, property owner since 1980 comments on arti- cles from Hayward paper. He asks ZC to deny request. Dale Olson, county L&WConservation Dept. comments on BM's question of how much of this property is a filter to Lovejoy Lake and what his thoughts on the developmenYs impact would bc. JB: This issue is comparable to the Osprey Lake de- velopment. Walkways and docks are discussed. Scheer rebuttal: Willing to add a 9t° restriction to prohibit docks. The bulk of water channels don't come up to property lot lines. The isolated wetland within the property is about 1 acre in size.Would work with the topography.KM would like to see no fertilizer use and no docks or walkways added to restrictions. She's very concemed about the wet- lands. Isn't sure residential development is appropriate around wetlands.Not sure iYs the best use for the property. Asks if Scheer would consider reducing to 8 lots. 5 minute break while Scheer confers with partners. Scheer feels they have met the criteria but willing to go to 81ots and increase the shore- land buffer to 50'. KM asks if he'd agree to decrease 1 lot from fronting on wetlands. Scheer agrees to 6 on water, 8 lots total. FZ: Would require a county plat. JB would like to send back to Town Board since many changes have been made today to the initial application.KM: TB has been tom,not sure if TB would want to see it back. To whom it may concern: This letter is intended as an explanation to the rezone request from forestry to RR1 for the enclosed 40 acres in tl�e Town of Round Lake. The rezone request is in an area of residential zoning and residential use will be consistent with the current adjacent residential development in this area. See enclosed zoning map. Current land use planning recognizes the need for developinent that retains the"Northwoods character" of future land use projects. The developers Woodland Developments and Up North Retreats have a history of q�iality environmentally sensitive developments that retain the aesthetic of the Northwood's and often go beyond current ordinance in their restrictions on use. � A private road will be constructed that is approximately 1000 feet in length. This will be a dead end road and will be built to current ordinance specifications. It is our intent to enl�ance the project for the o�vners and surrounding properties through the implementation of deed restrictions. These deed restrictions will be as follows. 1. Increase wetland setbacks to 100 feet. 2. Create and locate lot specific building sites that meet the requirements outlined below. 3. Create a natural 40 foot ��o soil disturbance buffer on entire wetland edge of the Lovejoy marsh. No lawn planting or soil disturbing landscaping inay be done in this zone. Lot owners may have a 6 foot walk to the �vetland edge but may not disturb the soils for any other reason. They may reinove trees and brush according to current ordinance. 4. NOW, THEREFORE BE IT RESOLVED, that the Sawyer County Zone District Maps, adopted March 1, 1971, be and the same are hereby amended as follows: TOWN OF ROUND LAKE 1) S&N The Oaks LLC, c/o Fred C. Scheer. The SE'/4 SE1/4, S 30, T 41N, R 7W, Parcel .16.1, excepting the wetlands as indicated on the Wetland Inventory Map. Doc #340603. Approx. 25 acres to be rezoned out of the total 40 acres. Change from District F-1 to District RR-1 for eight lots total, six on water; with all covenants; and with the following restrictions to be recorded on the county plat: 1. Each lot shall not be subdivided. 2. Lake setbacks shall be increased fron175' to 100' to the ordinary high water mark. 3. Septic setbacks shall be increased from 50' to 150'. 4. Shoreland buffer shall be increased to 50' from 35'. This shoreland buffer shall not have any soil disturbance ever and the trimming of vegetation in the allowed viewing corridor shall not occur until the principal dwelling is completed and any disturbed soils from construction are stabilized. 5. Lots shall not be clear cut of trees. Trees that are diseased, blown down or dead may be removed.
