At its March 16, 2007 meeting, the Sawyer County Zoning Committee motioned to deny the above petition to the Sawyer County Board of Supervisors. At its April 17, 2007 meeting, the Sawyer County Board of Supervisors refused to deny the petition as recommended by the Committee and re-referred the petition to the Committee with directions to draft an ordinance to effectuate the petition and to report the ordinance back to the Board at which time the Board may enact or reject the ordinance. The Zoning Committee voted to approve the rezone with a limit of 10 animal units and a 150' setback for livestock from navigable water. Findings of Fact: It would not be damaging to the rights of others or property values. It would not create an air quality, water supply, ar pollution problem. Conditions that have been placed are for the protection of the environment. They allow for the property owner to use her property in a reasonable manner while actually trying to protect the property rights of adjacent owners. County Board's order to effectuate has been approved. The Sawyer County Board of Supervisors must ratify the approval of the change in zone district before it becomes finaL This will be scheduled far the County Board meeting on June 21, 2007, 6:30 P.M., in the Circuit Courtroom of the Sawyer County Courthouse. This decision is a recommendation to the County Board of Supervisors. Any person or persons jointly aggrieved by the decision of the County Board may commence an action with the Sawyer County Board of Appeals to review the decision in whole or in part, within thirty (30) days after the filing of the decision in the office of the Committee. Pipestone Creek originates on the Marucha family lands as a spring fed creek. The Ojibwe view these natural springs as sacred, the creek travels thru the Maarucha land to a sacred pipestone quarry, on the Lac Courte Oreilles tand owned by the tribe. 2. There is a population of trout in the creek area or. LCC� Re�enratior., CP�t:c:: ?�, and Pipestone Creek. The runoff of farm contaminates would pollute this creek and eventually the Chippewa Flowage waters as well. 3. The Pipestone Creek in certain areas are creek beds, other places it runs underneath a layer of granite. There may be undiscovered archaeological or cultural sites all along the creek. This area contains the wetland complex that forms the headwaters of Pipestone Creek which is a Class A trout stream. The headwaters of a creek are an ecologically important and sensitive area. Any activities that happen in the headwaters area can affect the entire reach of the stream. This is particularly true in the case of nutrient loading. Allowing the rezone of this area to Agriculture would be a drastic land use change which would result in increased nutrient loading to the creek. As can be seen from the attached topographic map,essentially this entire property drains into the headwaters marsh complex. Therefore the waste and nutricnt loading from livestock would make its way i�to headwaters impacting the stream even if they were fended out of the wetlands areas. This also appears to be a case of spot zoning. This entire stretch along Hwy H is forested with no agriculture. It is used for hunting and farestry pracrices. One can also see from the soils map that the area which isn't wetlands is classified as"very stony",which wouldn't make it suitable for farming. Pipestone Creek is sacred to the people of the Lac Courte Oreilles Tribe,(eligible for National Register of Historic Sites). Therefore,we implore you to take in to consideration the impact this project would have on the lands in question. At its March 16, 2007 meeting, the Sawyer County Zoning Committee motioned to deny the above petition to the Sawyer County Board of Supervisors. At its April 17, 2007 meeting, the Sawyer County Board of Supervisors refused to deny the petition as recommended by the Committee and re- referred the petition to the Committee with directions to draft an ordinance to effectuate the petition and to report the ordinance back to the Board at which time the Board may enact or reject the ordinance. This application was tabled from the April 20 public hearing. Kathy McCoy motioned to approve the rezone with a limit of 10 animal units and a 150' setback far livestock from navigable water. Fred Zietlow seconded the motion. Motion carried. Findings of Fact: It would not be damaging to the rights of others or property values. It would not create an air quality, water supply, or pollution problem. Conditions that have been placed are for the protection of the environment. They allow for the property owner to use her property in a reasonable manner while actually trying to protect the property rights of adjacent owners.
