Dear Ms. Marucha,
On May 18, 2007, the Sawyer County Zoning Committee approved with conditions your application for
change of zone district on the following described real estate to wit:
The SE 1/4 of Section 22, and the NE 1/4 NE 1/4 of Section 27, all in T 39N, R 7W, Parcels .13.1,
.14.1, .15.1 and .16.1 (Section 22) and Parcel .1.1 (Section 27), excepting therefrom the wetlands
as indicated on the Wetland Inventory Map. Approximately 145.6 acres to be rezoned out of the
total 200 acres. Change from District Forestry One to District Agricultural Two. Purpose of
request is for the stabling of horses and for raising fowl, cattle and pigs. The Town Board has
approved the application. At its March 16, 2007 meeting, the Sawyer County Zoning Committee
motioned to deny the above petition to the Sawyer County Board of Supervisors. At its April 17,
2007 meeting, the Sawyer County Board of Supervisors refused to deny the petition as
recommended by the Committee and re-referred the petition to the Committee with directions to
draft an ordinance to effectuate the petition and to report the ordinance back to the Board at which
time the Board may enact or reject the ordinance.
The Zoning Committee voted to approve the rezone with a limit of 10 animal units and a 150' setback for
livestock from navigable water.
Findings of Fact: It would not be damaging to the rights of others or property values. It would not create
an air quality, water supply, ar pollution problem. Conditions that have been placed are for the protection
of the environment. They allow for the property owner to use her property in a reasonable manner while
actually trying to protect the property rights of adjacent owners. County Board's order to effectuate has
been approved.
The Sawyer County Board of Supervisors must ratify the approval of the change in zone district before
it becomes finaL This will be scheduled far the County Board meeting on June 21, 2007, 6:30 P.M., in
the Circuit Courtroom of the Sawyer County Courthouse.
This decision is a recommendation to the County Board of Supervisors. Any person or persons jointly
aggrieved by the decision of the County Board may commence an action with the Sawyer County Board
of Appeals to review the decision in whole or in part, within thirty (30) days after the filing of the
decision in the office of the Committee.

potential for ecological damage because of wetland. There is no other agricultural zoning around,
it would be spot zoning. It does not make sense to rezone with F-1 and wetland all around.
Also, the Zoning Committee voted to have horses removed by August 31, 2007.
The Sawyer County Board of Supervisors must ratify the denial of the change in zone district
before it becomes final. This will be scheduled for the County Board meeting on April 17, 2007,

The Lac Courte Oreilles Tribal Governing Board and Historic Preservation Office are
requesting, the Sawyer County Zoning Board, to deny the Marucha family zoning
variance from forest land to agricultural land, on the grounds that:
l. Pipestone Creek originates on the Marucha family lands as a spring fed creek.
The Ojibwe view these natural springs as sacred, the creek travels thru the
Maarucha land to a sacred pipestone quarry, on the Lac Courte Oreilles tand
owned by the tribe.
2. There is a population of trout in the creek area or. LCC� Re�enratior., CP�t:c:: ?�,
and Pipestone Creek. The runoff of farm contaminates would pollute this creek
and eventually the Chippewa Flowage waters as well.
3. The Pipestone Creek in certain areas are creek beds, other places it runs
underneath a layer of granite. There may be undiscovered archaeological or
cultural sites all along the creek.
This area contains the wetland complex that forms the headwaters of Pipestone Creek
which is a Class A trout stream. The headwaters of a creek are an ecologically important
and sensitive area. Any activities that happen in the headwaters area can affect the entire
reach of the stream. This is particularly true in the case of nutrient loading.
Allowing the rezone of this area to Agriculture would be a drastic land use change which
would result in increased nutrient loading to the creek. As can be seen from the attached
topographic map,essentially this entire property drains into the headwaters marsh
complex. Therefore the waste and nutricnt loading from livestock would make its way
i�to headwaters impacting the stream even if they were fended out of the wetlands areas.
This also appears to be a case of spot zoning. This entire stretch along Hwy H is forested
with no agriculture. It is used for hunting and farestry pracrices. One can also see from
the soils map that the area which isn't wetlands is classified as"very stony",which
wouldn't make it suitable for farming.
Pipestone Creek is sacred to the people of the Lac Courte Oreilles Tribe,(eligible for
National Register of Historic Sites). Therefore,we implore you to take in to
consideration the impact this project would have on the lands in question.

AMENDING SAWYER COUNTY ZONE DISTRICT MAPS
WHEREAS, the Sawyer County Board of Supervisors has heretofore been petitioned to
amend the Sawyer County Zone District Maps; and
WHEREAS, the petitions have been referred to the Sawyer County Zoning Committee
for public hearings; and
WHEREAS, the Zoning Committee, on due notice, conducted a public hearing on the
proposed amendments and filed their recommendations with the Board; and
WHEREAS, this Board has the legal authority to amend zone districts pursuant to
Section 59.69 (5) (e), Wisconsin Statutes.
NOW, THEREFORE BE IT RESOLVED, that the Sawyer County Zone District
Maps, adopted March 1, 1971, be and the same are hereby amended as follows:
TOWN OF RADISSON
1) Geraldine M. Marucha et al. The SE 1/4 of Section 22, and the NE 1/4 NE 1/4 of
Section 27, all in T 39N, R 7W, Parcels .13.1, .14.1, .15.1 and .16.1 (Section 22) and
Parcel .1.1 (Section 27), excepting therefrom the wetlands as indicated on the
Wetland Inventory Map. Approximately 145.6 acres to be rezoned out of the total 200
acres. Change from District F-1 to District A-2 with a limit of 10 animal units and a
150' setback for livestock from navigable water.

The Sawyer County Zoning Committee, having held a public hearing pursuant to Section
59.69 (5) (e), Wisconsin Statutes, notice thereof having been given as provided by law
and being duly informed of the facts pertinent to the proposed changes, hereby
recommends that the petitions described as follows be approved:
TOWN OF RADISSON
1) Geraldine M. Marucha et al. The SE 1/4 of Section 22, and the NE 1/4 NE 1/4 of
Section 27, all in T 39N, R 7W, Parcels .13.1, .14.1, .15.1 and .16.1 (Section 22) and
Parcel .L1 (Section 27), excepting therefrom the wetlands as indicated on the
Wetland Inventory Map. Approximately 145.6 acres to be rezoned out of the tota1200
acres. Change from District Forestry One to District Agricultural Two. Purpose of
request is for the stabling of horses and for raising fowl, cattle and pigs. The Town
Board has approved the application. At its March 16, 2007 meeting, the Sawyer
County Zoning Committee motioned to deny the above petition to the Sawyer County
Board of Supervisors. At its April 17, 2007 meeting, the Sawyer County Board of
Supervisors refused to deny the petition as recommended by the Committee and re-
referred the petition to the Committee with directions to draft an ordinance to
effectuate the petition and to report the ordinance back to the Board at which time the
Board may enact or reject the ordinance. This application was tabled from the April
20 public hearing.
Kathy McCoy motioned to approve the rezone with a limit of 10 animal units and a
150' setback far livestock from navigable water.
Fred Zietlow seconded the motion.
Motion carried.
Findings of Fact: It would not be damaging to the rights of others or property values.
It would not create an air quality, water supply, or pollution problem. Conditions that
have been placed are for the protection of the environment. They allow for the
property owner to use her property in a reasonable manner while actually trying to
protect the property rights of adjacent owners. County Board's order to effectuate has
been approved.
