Doc #344416; CSM Vol 29 Page 42. 50.04 total acres. Change from District Agricultural One to District Residential/Recreational One. Purpose of request is for the creation of residential lots. The Town Board has approved the application with additional comments. The Sawyer County Zoning Committee approved the application with the conditions placed by the Town of Bass Lake and that the covenants become deed restrictions: 1 . All residential dwellings and accessory buildings, if any, shall be built a minimum of 60 feet from the street. 2. One outbuilding, other than a garage, shall be built provided there are no kitchen facilities and it is not used for business purposes. Said outbuildings shall be behind the house, meaning away from the street and shall be a maximum of 30'x36' in size. 3 . There shall be no more than one residential dwelling per parcel. 4. There shall be no subdivision of any lots. 5 . The exterior of any buildings must be finished within nine months from the commencement of construction. Finished is defined as the exterior being completed in brick, stone, wood, vinyl or aluminum siding. 6. No visible, unlicensed, uninsured, junked or disabled vehicles may be stored or parked on the parcels of property. 7. Only one business related vehicle may be parlced on the premises. 8. All recreational vehicles must be stored in either the garage or behind the house. Findings of Fact: It would not be damaging to the rights of others or property values. It would be compatible with surrounding uses and the area. The Sawyer County Board of Supervisors must ratify the approval of the change in zone district before it becomes final. This will be scheduled far the County Board meeting on April 17, 2007, 6:30 P.M., in the Circuit Courtroom of the Sawyer County Courthouse. This decision is a recommendation to the County Board of Supervisors. Any person or persons jointly aggrieved by the decision of the County Board may commence an action with the Sawyer County Board of Appeals to review the decision in whole or in part, ��vithin thirty (30) days after the filing of the decision in the office of the Committee. The stream is navigable waters of the state and such crossings of navigable water require a Wisconsin Chapter 30 pernut be issued for such crossings. I know the stream well where you have identified the potential crossing. It has been a site of concern due to off-road vehicles `mudding' in the stream bed. The stream is negatively impacted by this activity— destruction of stream bank, destruction and disturbance of the vegetation and a widening and silting of the strearn bottom. There is a narrow section of stream corridor to the west of the mudding activity that would be suitable for culvert crossing. The ground is also elevated at this spot and would not likely require any wetland fill associated with the crossing. A permit application for culvert would be required for the crossing. Depending on location and size of culvert,the application could be either a General Pernut application or an Individual Pernut application. I could not tell you which until you have an idea of location and sizing. Any culvert placement would require the bottom of the culvert be set 6-8 inches below stream bottom and be sized accordingly to handle snowmelt or heavy precipitation events. Whether the culvert would need a General Permit or an Individual Pernut,with proper location and sizir.g for the stream crossing I would suspect that the DNR would issue the permit in either case as we have already looked at the waterway system for any unique or critical habitat issues. It is to inform you that the Sawyer County Subdivision Control Ordinance (Section 4.0) limits the number of lots that can be created without going through the steps of creating a county platted subdivision. In reviewing our records, I found that in 2007 you applied far a change in zone district application to create 16 lots. Your application and the map were approved with several conditions that were imposed by the Town of Bass Lake. However, the approved map of the proposed 16 lot layout was never submitted for recording with the Register of Deeds. Unfortunately now you must follow the guidelines established in the subdivision ordinance relating to land divisions. You are limited to 4 lots within a period of 5 years. The first lot that you created in the 5 year sequence was created in 2014 (identified as lot #15). With the recent 3 lot survey (submitted by surveyor Jesse Suzan) you are now at the limit of lots you can create until 2019. After 2019 you would be allowed to create another 4 parcels in that area. I have spoken with a member of the Town of Bass Lake regarding this matter and have agreed that a way to correct the limited number of lots you can create would be to record the original 16 lot subdivision map with the Register of Deeds. Also, keep in mind that there were conditions placed on these lots that need to be carried through from grantor to grantee by deed. I've attached all the documents regarding this issue(13 pages...sorry�. In February 2007 Tom Thompson and Steven Longtine purchased lots 2 and 4 CSM#7354 located off Fun Valley Road (along what is now Brodi Lane). In March of the same year,they applied for a change in zone district from A-1 to RR-1 to create 16 residential lots.(a copy of the proposed map is attached�. The Town of Bass Lake approved the request with conditions(see Town Board decision and attachment). The County also approved subject to the towns conditions (see County letters to applicant). The problem is,the proposed land division map of the 16 lot subdivision was never recorded however,the change in zone district occurred and the property is now zoned RR-1. Question:Would it be the town's opinion that the conditions placed on the approval still applies to that property even though the plat map was neverrecorded? There have been two lots created by CSM(legal parcels according to the ordinance)and sold already.The first lot was created in 2009(map#7661). The second lot(5 years later)created in 2014(map#7987)and I now have a third map of three more lots pending approval(see map signed by Jesse Suzan dated 3-25-2015). Setting aside the fact that the application to rezone was for the creation of a 16 lot subdivision,and assume the property was alreadv zoned RR-1, our ordinance would allow for the creation ot up to 5 lots within a period of 5 years. So according to the ordinance,they can only create one more lot between 2014 and 2019.There is the potential for more lots that can be created from lot#4.(see CSM#7354 and parcel map). I believe that this property will eventually become a"subdivision"as first intended and the developers are circumventing the rules by not going through the required steps to create a platted subdivision. As you can see by the map created by Jesse Suzan,they are numbering the CSM lots according to the lot numbers identified on the unrecorded plat map(compare the proposed 16 lot subdivision map with all the CSM maps). From a zoning standpoint,technically they have done everything that is required in order to create a residential lot...the property is zoned correctly,the size of the lots meet the RR-1 size requirement and the creation of the lots have been by CSM. HOWEVER, it is possible that the two owners could split their partnership,dividing the land that is left and each could create 5 more parcels in this location within another 5 years.That would make 10 more lots for a total of 15. Another scenario is that the current two owners could each sell their parcels and those parcels could be split by the new owners and so on until the end result is many 100'x 200'lots,which is the minimum lot size required for that zone district. One of the conditions placed on the approval was that the 16 lots could not be split again.Was it the towns intention to limit that area to only 16 residents? Also,when the County Board ratified the approval,they added that the conditions placed by the town become deed restrictions. I happened to look up one of the deeds and there was no deed restrictions attached to the deed. I will be sending the land owners a letter informing them that they are limited to the creation of one more lot between now and 2019.However,the potential for more in that"unrecorded development)is coming,so I'm asking the town to review the information I have provided and let me know what the towns opinion is on this matter.
