Dear Mr. Houston:
Notice is hereby given that on May 18, 2007 the Sawyer County Zoning Committee
approved the following application:
The SW '/4 NW '/4, S 7, T 39N, R 7W, Parcel .10.1. Vol 715 Records Page l. 65.9
acres. Property is zoned Residential/Recreational Two. Permit is desired for the
location/operation of a greenhouse. The Town Board has approved the application.
The Sawyer County Zoning Committee approved the application with the condition that
the approval remain in present owners name only.
Findings of Fact: It would not be damaging to the rights of others or property values.
The approval of the conditional use will expire on May 18, 2008, if application for the
actual permit to use/construct is not made by that date.
Any person or persons jointly aggrieved by the decision of the Zoning Committee may
commence an action with the Sawyer County Board of Appeals to review the decision in
whole or in part, within thirty (30) days after the filing of the decision in the office of the
Committee.

REFORMATION AGREEMENT
CORRECTING DESCRIPTION OF LIFE ESTATE
THIS REFORMATION AGREEMENT,is made and entered into as of the�i"
day of August,2000 by and between Jean C.Houston("Jean")and Guy Eugene Houston
("Guy")for the purpose of correcting the legal description of a life estate retained by Jean
in certain real property located in Sawyer County,Wisconsin as more particularly
described bclow,previously conveyed by Jean to Guy on Scptember 23,1982.
RECTTALS:
WHEREAS,on September 23, 1982 Jean executcd a warranty deed(the"1982
Deed")conveying to Guy and his former wife,Rosemary Houston("Rosemary"),certain
real property(referred to herein as the"Subject Property")consisting of approximately
370 acres located in the Town of Couderay,Sawyer County,Wisconsin,more particularly
described as follows:

WHEREAS,the Subject Property conveyed by Jean pursuant to the 1982 Deed
included a field stone and frame construction lodge building built in the 1920's and
commonly known as "The Hideout- - Al Capone's Northwoods Retreat" (the "Lodge
Building"). The street address of the Lodge Building is 12101 W. County Road CC,
Couderay, WI 54828. Jean resided in the Lodge Building at the time the 1982 Deed was
executed and recorded.
WHEREAS, it was Jean's intention at the time she conveyed the Suhject Property
to Guy and Rosemary to retain a Iife estate in the Lodge Building so that she could
continue to reside in such building for as long as she wished during her lifetime.
WHEREAS, it was Jean's further intention to convey an unencumbered fee
simple interest in the remainder of the Subject Property to Guy and Rosemary and to not
retain a life estate in any portion of the Subject Property other than in the Lodge Building.
WHEREAS, Rosemary conveyed all of her interest in the Subject Property to Guy
pursuant to a Quit Claim Deed recorded with the Sawyer County Register of Deeds office
on March 20, 19$7 as Document No. 203958 in volume 401 of Records on page 233 and
with an Abridgment of Judgment recorded on March 23, 1987 as Document No. 203975
in volume 401 on pages 255-256.
WHEREAS, since the 1982 Deed was executed and recorded and consistent with
Jean's original intentions, Jean and Guy have operated under the assumption that Jean
held only a life estate in the Lodge Building and did not retain an interest in any other
portion of the Subject Property and Guy has relied on this mutual understanding with
respect to his time, expense and efforts incurred in connection with the management,
operation and improvement of the Subject Property.
WHEREAS,Jean and Guy have recently had opportunity to review the 1982
Deed in detail and have been advised by their attorneys that due to a scriveners error by
the attorney who drafted the 1982 Deed, said deed incorrectly indicates that Jean retained
a life estate in the entire Subject Property and not just in the Lodge Building as was her
original intention.
WHEREAS, the parties acknowlcdge and agree that under Wisconsin law a
reformation action could be instituted in the Sawyer County Circuit Court to correct the
1982 deed on the grounds of mutual mistake and to reform said deed to reflect Jean's
original intention to retain a life estate in only the Lodge Building and not in any other
portion of the Subject Property.

WHEREAS, Jean acknowledges and agrees that the portion of the 1982 Deed
indicating that she retained a life estate in the entire Subject Property was an error in
drafting by the attorney responsible for preparing the deed and constituted a mistaken
expression of her stated intentions at the time she executed such deed to retain a life estate
in only the Lodge Building.
WHEREAS, it is Jean's desire to avoid the unnecessary costs and expenses that
would be incurred in instituting a reformation action and she intends instead to execute
and record a correction quit claim deed conecting the 1982 deed to reflect her original
intention to retain a life estate in only the Lodge Building_
WHEREAS, Guy agrees that is desirable to avoid the costs and expenses that
would be incurred in instituting a reformation action and is willing to accept such
correction quit claim deed and enter into this Reformation Agreement in order to correct
and clarify the chain of title to the Subject Property to reflect that Jean holds a life estate
in only the Lodge Building.
NOW, THEREFORE,Jean and Guy hereby agree as follows:
1. Description of Life Estate and Recording of Ouit Claim Deed. Jean hereby
acknowledges and agrees that the 1982 Deed includes a mistake caused by the drafter's
error in that said deed indicates that she retained a life estate in the entire Subject Property
when it was her original and stated intention at the time she executed the 1982 Deed to
retain a life estate in only the Lodge Building. To correct this mistake, Jean hereby
agrees to execute a correction quit claim deed in favor of Guy correeting the 1982 Deed
and conveying to him the Subject Property sub}ect only to her life estate in the Lodge
Buitding.
2. No Other Interest. Jean hereby acknowledges and agrees that since she
executed the 1982 Deed she has had no interest in the Subject Property other than her life
estate in the Lodge Building and that subject to such life estate Guy has been and remains
the legal and beneficial owner of the entire Subject Property. Jean further aclrnowledges
and agrees that she has no right to share in any profits, gains or income derived by Guy
from the Subject Property other than her share of any sales proceeds attributable to the
value of her life estate in the Lodge Building in the event it is ever sold during her
lifetime.

3. Foregoing of Reformation Action. Jean and Guy each hereby agree that i[is
in their best in[erests to enter into this Rcforma[ion Agreement in order to avoid the costs
and expenses that would be incurred in instituting a court action as provided for under
Wisconsin law to reform the 1982 Deed on the grounds of mutual mistake to reflect the
fact that Jean holds a life estate in only the Lodge Building.
4. Further Assurances. Jean and Guy each hereby agree to execute such deeds,
endorsements,affidavits,evidences of conveyance and other instruments and documents
and shall give such other further assurances as shall be necessary to correct the 1982
Deed and clarify the chain of title to the Subject Property to reflect that since the 1982
Deed was executed and recorded Jean has retained a life estate in only the Lodge
Building.
5. Se�arate Le�al Representation. Prior to signing this Agreement,Jean and
Guy each consuited with an attorney of his choosing and each of them has received from
his or her respective attomey a full explanation of the terms and legal significance of this
Agreement and the effect it has on his or her respective interests in the Subject Properiy.

Dear Mr. Houston;
Your application for a Conditional Use will be considered at a Public Hearing before the
Sawyer County Zoning Committee on Friday, May 18, 2007.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the application may result in unnecessary delay of a decision. Failure to
appear may also result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement in
care of this office directed to James Bassett, the Chairman of the Zoning Committee. This
statement should inciude your proposed intentions, the purpose of the request, and a
description of the general terrain and surrounding development. Photographs of the
property and surrounding area is encouraged land uses. Indicate how the proposed use
would not be contrary to the public interest, et cetera.
Your application will come before the Town Board for their review. Some
townships also have a Planning Commission. Please contact the Town Clerk,
Charles Warner; 715/945-2902 to confirm the date and obtain the time of the
Planning Commission and Town Board meetings for your attendance or the
attendance of your agent.
