With the Public Service Commission it's a done deal. The approval of the conditional use will expire on April 20, 2008, if application for the actual permit to use/construct is not made by that date. Application has been sent to Ben Hock, American Transmission Company. Any person or persons jointly aggrieved by the decision of the Zoning Committee may commence an action with the Sawyer County Board of Appeals to review the decision in whole or in part, within thirty (30) days after the filing of the decision in the office of the Committee. Box 676 10610 Main Street Hayward, WI 54843 RE: Stone Lake Substation—Conditional Use Permit and Variance Permit Applications Dear Mr. Christman: Thank you for your assistance in preparing the variance and conditional use permit applications that were filed on behalf of American Transmission Company(ATC) on Thursday, January 25, 2007. I appreciated your insight as to the zoning board review and approval process. During our discussion we concluded it was best to complete a Conditional Use Permit (CUP) application to cover both phases of the Stone Lake Substation project, Phase 1 (after-the-fact construction) and Phase 2, because of the uncertainty as to whether the Public Service Commission of Wisconsin (PSCW) had granted authority for Stone Lake Phase 1 in the Arrowhead-Weston Certificate of Public Convenience and Necessity(CPCN) order. In reviewing the CPCN, I have verified that Phase 1 of the Stone Lake Substation was one of the approved order points by the PSCW. I hope this clarifies that portion of the CUP application. Even though Phase 1 was part of the original order, I see no need to remove it from the conditional use permit application as submitted unless you advise otherwise. In a related matter, we also discussed the detention pond located just south of the Phase 2 location. During our conversation you indicated that it was not necessary to include the detention pond as part of any application, please confirm this point for me.
