Dear Mr. Dwyer and Ms. Stapleton,
On October 16, 2007, the Sawyer County Board of Appeals approved your application for vari-
ance on the following described real estate to wit:
Lots 1 & 2, being Part of Govt Lot 5, S 30, T 41N, RSW, Parcels :5.2 and :5.17. Vol 486
Records Page 57, Doc #339191; CSM Vol 9 Page 309. 1.89 total acres. Property is zoned
Residential/Recreational One. Application is for the construction of an approximately
36'x72' irregularly shaped replacement dwelling with decks located 64'/75' to the ordi-
nary high water mark of Moose Lake. The dwelling is located on a peninsula and the re-
quired minimum setbacks cannot be met from the ordinary high water mark on each side
of the peninsula and it will replace an existing dwelling located 23' from the ardinary
high water mark of the lake. Variance is requested as Section 4.49(1), Sawyer County
Zoning Ordinance, would require that the dwelling be located no closer than 75' to the
ordinary high water mark of the lake. The Town Board has approved the application.
The Sawyer County Board of Appeals approved the application with a 2 year time limit, and re-
quiring the removal of existing cabin within 1 year of occupancy of new dwelling.
Findings of Fact of the Board of Appeals: There would be no change in the use in the zone dis-
trict. It would not be damaging to the rights of others or property values. It would be due to spe-
cial conditions unique to the property with the meandering shoreline and peninsula.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 07-024.

building project on Moose Lake.

• Completed "Application for Variance-Additional Information" form
• Corrected inspection report
• Corrected site map
The application documents you sent to us referred only to "lot 1" but the proposed project
includes both lots 1 & 2 so the pertinent information for lot 2 was added. In addition, the site map
had an incorrect impervious surface calculation for lot 1 so it was corrected.
Please advise us as to the status of the variance application. We would like to receive a copy of
the tax listers map and the list of the names and addresses of the individuals who are receiving
letters regarding the proposed project when they are available.

Part 2: Three-Step Test.
To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. This is known as the "three-step test."
1) Unique Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.

the ordinance?

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbars and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this variance would not harm the public interests
or how it may even enhance the public interests.

3) Unnecessary Hardship.
An applicant may not claiin hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
area variance, unnecessary hardship exists when compliance would
unreasonabl�prevent the owner fiom using the propert f�or a permitted
purpose ar would render conformity with such restrictions unnecessarily
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance �
would impose on use of the property.

Dear Mr. Dwyer:
As you are probably aware from your discussions with Nate Yoder, the department cannot
at this time issue the permit for the construction of your new home. The situation is that
the application is for a new dwelling with a main floor, unfinished basement and a loft
area. It is department policy not to issue permits for anything other than for what the
Board of Appeals has granted a variance. After reviewing the hearing minutes, the tape
recording of the hearing and your presentation documents, it appears that there was no
mention of either a basement or loft area. There is a reference about the dwelling's main
floor to be designed for senior living and wheelchair accessibility, which would infer that
there must be an additional floor within the proposed building, but there was no further
elaboration on this matter.
Yesterday afternoon Ray Zubrod, Chairman of the Board of Appeals, visited the office
and we discussed this situation. Ray believes that the Board members should be made
aware of the existence of the basement and loft area and that this should be done at the
March 18r�' public hearing. My personal opinion is that this is probably not a significant
issue for the Board members as the entire project will take place within the footprint and
setbacks approved by the Board at the October 16, 2007 hearing.
From our telephone conversation this morning I know that you plan on attending the
hearing. However, should you not be able to attend, I believe that Nate is sufficiently
familiar with the project that he could properly represent you before the Board.

Dear Kathy:
At 7:00 P.M., Tuesday, March 18, 2008 the Sawyer County Board of Appeals (BOA)will
review Variance#07-024 that the Board originally approved on October 16, 2007. Please
note that this is a review not a rehearing of this matter.
The issue is that the applicant has applied for a Land Use Permit to construct a
replacement dwelling containing a main floor, unfinished basement and a loft area.
However, after reviewing the BOA hearing minutes, the tape recording of the hearing and
the applicant's documents presented to the BOA, it appears that there was no mention of
either a basement or loft area. The BOA was probably under the impression that they
were dealing with a single story home without a basement or loft area.
There is a reference about the dwelling's main floor intended to be designed for senior
living and wheelchair accessibility, which would infer that there must be an additional
floor within the proposed building, but there was no further elaboration on this matter.
Since it is department policy not to issue permits for anything other than for what the
Board of Appeals has granted a variance, the question was whether this permit could be
issued.
After discussing this with Ray Zubrod, BOA Chairman, Ray believes that the BOA
members should be made aware of the existence of the basement and loft area and that
this should be done at the BOA March 18`h public hearing. My personal opinion is that
this is probably not a significant issue for the BOA members as the entire project will still
take place within the footprint and setbacks approved at the October 16, 2007 hearing.
Also, I do not believe that it was the intention of the applicant to mislead the BOA.
I have enclosed a copy of the Town Board's opinion, inspection report, the applicant's
presentation documents to the BOA and other documents related to this case. Please let
me know if the Town Board has any comments pertaining to the review of the variance
application.

Greetings!
It appeazs that WE WILL be having a March Public Hearing after all.The enclosed Public
Hearing Notice is for a clarification of a vaziance the Board approved in October of 2007.
The Dwyers have applied for a land use permit for the construction of their home now and
the plans call for a full basement which was never discussed at the hearing(Bill and myself
listened to the tape).The application is being brought back to the Board to see whether
the basement will make a difference in the decision that was made in October. Our office
does not issue Iand use pernuts for things the Board has not approved.
We have discussed this issue with Ray and it was determined that a meeting would need to
be held to discuss this issue so we've decided to hold a short hearing on March 18`� at 7
PM at the courthouse(the normal night for Board of Appeals). I will also send this
message by mail so that those who don't have e-mail will be notified.

I have enclosed the following documents with this letter.
• Inspection Report,
• Application for Variance—Additional Information,
• Board of Appeals Conclusions of Law P'orm (This is the form that the Board members
will use to determine if your situation meets the requirements far the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of$350.00 made out to the "Sawyer County Zoning
Administration" by Friday, September 7, 2007 for hearings in October 2007. Please
indicate on the application your anticipated time of presentation to the Board.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The"Variance Application"will be reviewed at two public hearings. The first hearing
will be held by the Town of Round Lake at 6:30 P.M., Thursday, October 11, 2007. You
should contact Kathy McCoy, Town of Round Clerk, at(715) 462-9271 to confirm this
date. It is very important that you contact Ms. McCoy as soon as possible as you may be
required to attend a meeting of the Town's Planning Commission prior to your
appearance before the Town Board.
The 5�.+�;ayer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday; October 16, 2007, in the large courtroom located in the Sawyer County
Courthouse. You ar your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Edgewater is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board(i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).

This hearing will begin at 7:00 P.M.at the Sawyer County Courthouse,10610 Main,

the Hearing. A lack of information about the situation may result in unnecessary delay of
