Property is zoned Residential/ Recreational One. Application is far the construction of an approximately 39'x42' base- ment beneath an existing dwelling approximately 30' in height and located 50' to the or- dinary high water mark of Round Lake. There is already an existing partial basement in this location. The dwelling has an existing footprint of 2,290 sq ft and habitable area of 2,626 sq ft. The habitable area will increase to 4,264 sq ft with the construction of the basement. Variance is requested as Section 4.421(2)(b)(4) & (5), Sawyer County Zoning Ordinance, would restrict the total dwelling footprint to not more than 1,500 sq ft, the habitable area to not more than 3,000 sq ft and the maximum dwelling height to 26 feet. The Town Board has approved the application. The Sawyer County Board of Appeals denied the application as submitted. Findings of Fact of the Board of Appeals: It would not be due to special conditions unique to the property. Increasing the sq ft would make it more non-conforming. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice.
