Doc #344003; CSM Vol 7 Page 359. .46 acres. Property is zoned Residential/Recreational One. Application is for the construction of a 20'x28' (21'x30' with eaves) detached garage with a loft at setback distances of 62'/73' from the ordinary high water mark of Lake Chetac. Variance is re- quested as Section 4.49(1), Sawyer County Zoning Ordinance, would require a minimum setback distance of 75' to the ordinary high water mark of the lake. The Town Board has denied the application with additional comments. The Sawyer County Board of Appeals approved the application as follows: approve garage with loft if squared to lot line to meet 75' setbacl< to lake on north side, not to be closer than 6' paral- let to the side lot line, not closer than 75' and 62' lake setbacks; with rain garden, gutters and downspouts to be used at a minimlim on the south; with removal of steps and dock on east; with a 2 year time limit to take out permits. Findings of Fact of the Board of Appeals: It would be due to special conditions unique to the property by being on a peninsula on Lake Chetac. Can't construct anything without encroaching on the 75' lalce setback. It wolild not be contrary to the public interest. The Town Board has had its concerns met. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Cer�iarari to review the legality of this decision within 30 days after the date of this notice. To: Charles Briskey On July 9, 2007, our office received a Land Use Permit(LUP) application for the construction of a detached garage. The permit was issued by Deputy Zoning Administrator, Cindy Yackley, on July 24, 2007, based on the correct setback measurements as indicated on the permit. However, this information was brought to the attention of Bill Christman, Zoning Administrator, and I, and we knew that a variance was required in order to build a detached garage. Because of the incorrect information on the application, LUP #07-272 is now temporarily void, until after a variance has been approved. Unique physical limitations of the property such as steep slopes or wetlands that are not generally shared by other properties must prevent compliance with ordinance requirements. The circumstances of an applicant (growing family, need for a larger garage etc.) are not a factor in deciding variances. Nearby ordinance violations, prior variances or lack of objections from neighbors or the Town Board do not provide a basis for granting a variance. An applicant may not claim hardship because of conditions which are self- imposed or created by a prior owner (for example, excavating a pond on a vacant lot and then arguing that there is no suitable location for a home.). Courts have also determined that economic or financial hardship does not justify a variance. When determining whether unnecessary hardship exists, the property as a whole is considered rather than just a portion of the parcel. You are applying for an "area variance.' An area variance relaxes a dimensional standard such as a setback, frontage, lot area, ar height. For an area variance, unnecessary hardship exists when compliance would unreasonabl�prevent the owner from using the propert f�permitted purpose or would render conformity with such restrictions unnecessarily burdensome. The importance of the public purposes of the ordinance, the degree to which the restriction supports those purposes and the extent of the relaxation of the restriction are weighs against the limitations full compliance would impose on use of the property.
