Dear Mr. and Mrs. Zahler,
On August 21, 2007, the Sawyer County Board of Appeals approved as amended your applica-
tion for variance on the following described real estate to wit:
Lot 2, being Part of Govt Lot 2, S 5, T 37N, R 9W, Parcel :2.8. Doc #326794; CSM Vol
10 Page 288. .45 acres. Property is zoned Residential/ Recreational One. Application is
for the construction of a 22'x30' (24'x31' with eaves) addition onto an existing dwelling
at a setback distance of 58' to the ordinary high water mark of Lake Chetac. Variance is
requested as Section 4.421(2)(b)(3), Sawyer County Zoning Ordinance, would require
that the addition be constructed no closer than 75' to the ordinary high water mark of the
lake. The Town Board has approved with comments.
The Sawyer County Board of Appeals approved the application with the following conditions:
Complete removal of the deck; removal of shed from where it sits to at least 75' back from the
water; restoration in the 35' buffer zone in accordance with a plan approved by Land and Water
Conservation; a rain garden as suggested by the Town of Edgewater after construction; a double
permit fee is to be charged; and with a 2 year time limit.
Findings of Fact: An unnecessary hardship is present. It would not be for economic gain or for
the convenience of the owner.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 07-014.

Part 2: Three-Step Test.

the following three requiremenLs. Thls fs known as the "three,rtep test"
1) Llnique Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent comPliance with
ordinance requiremrnts. The circumstances of an applicant(growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinence violations, prior variances or lack of objections from neighbors or
the Town Boazd do not provide a basis for granting a variance.

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. fn
applying this test, the Board of Appeals must consider impacu of your
proposal and the cumulative impacts of similar projects on the interests of die
neighbors and the entire community. Some, but not necessarily all of these
considerations ere: (1)Public health, Safety and welfare, (2) water quality, (3)
fish and wildlife habitnt, (4) naturel scenic beauty, (5) minimization of
property damages and(6)achievement of eventual compliance for
nonconfomung uses, structures and lots.

3) Unnecessary Hardship.
An applicant may not claim hardship becausc of conditions whieh nre self-
imposed or created by a prior owner(for example, excavating a pond on a
vacant lot and then azguing ihat ihera is no suitable location for a home.).
Courts have also determinad that economic or financial hazdship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel,

During the onsite inspection on 7-23 , 2008 of your property on Lake
Chetac, it was observed that your septic system is in need for an "order for correction"
I have reviewed your previous Land Use Permits (LUP) 07-497 and 07-498. The
LUP required you to provide an accurate plot plan of the existing structures,proposed
additions, and to include the location of the existing sewer system(s). I inspected the
sewer system locations and placed them on the LUP. At time on inspection I discovered
the following:
1.) Cabin#1, (by the road)—2 stacked 55 gallon steel drums on the north side of
the cabin (illegal) acting as the septic tank. The outlet pipe flows to the N/NE.
System location is unknown.
2.) Cabin#2, (nearest to the lake) older addition to the North was constructed over
the existing septic tank (illegal). System location is unknown.
Both Cabin#1 and#2 have non code complying septic tanks. State private sewage
codes requires that you replace the illegal failing septic tanks and have the plumber
exainine the remaining part of the system for code compliance within 1 year from the
date of this letter--08-15-08. Please review the enclosed inspection report dated 7-23-08.
Should you disagree with my opinion of a failed system for not meeting code compliance
you may contact a licensed plumber to confirm or deny my observations.
Enclosed is a listing of plumbers and sol testers. Due to your sloping lot and
limited room, I suspect that you may very well end up with holding tanks. Your
plumber/soil tester will make the determination of the type of system and the location.
Should you disregard this notice and deadlines a citation for non-complianee will
be issued on 8-15-09 for $753.00 (see attached citation documentation)
To correct this problem in the most efficient manner, here are the initial steps to take:
l. You must obtain a Certified Soil Test, which will enable the determination of
what type of system is suitable for your specific location. A list of area soil
testers has been enclosed for your convenience.
2. Contact a Wisconsin licensed master plumber to obtain possible plans and prices.
Your plumber will be able to answer many questions regarding your new system
and will provide your necessary Sawyer County sanitary permit.
Should you should have any questions, please do not hesitate to call the Zoning office at
634-8288, Monday through Friday, 8-4.
