Dear Mr. Kaye,
On June 19, 2007, the Sawyer County Board of Appeals approved with conditions your appli-
cation for variance on the following described real estate to wit:
Unit #1, Grand Pines Condominium South, S 36, T 41N, R 8W, Parcel -36.1. Doc #33207. .90
acres. Property is zoned Residential/Recreational One. Application is for an after-the-fact vari-
ance for the construction of a "non-open" fence consisting of two segments. Fence segment#1 is
35' long and is located 40'/43' from the centerline of County Highway B. Segment #2 is 100'
long, not less than 8' in height and is located on the right-of-way of county Highway B and ap-
proximately 22' to the ordinary high-water mark of Little Round Lake. Variance is requested as
Section 4.21(2), Sawyer County Zoning Ordinance, would requrie that the fence be located not
less than 82' (40' right-of-way plus 42') to the centerline of County Highway B and Section
4.49(4) would require that "open"fences only may be constructed as close as 40' to the ordinary
high-water mark of the lake. The Town Board has approved with conditions.
The Sawyer County Board of Appeals approved the application as follows: Section 3 to be recon-
figured to an open fence, not to exceed 6' in height, with no more than 2 rails; the most westerly
8' of section 2 to be reconfigured to an open rail fence, no part of section 2 to be closer than 38'
to the centerline of County Hwy. B; corrections to be completed by September 19, 2007.
Findings of Fact: There would be no change in the use in the zone district. It would not be dam-
aging to the rights of others or property values. It would be due to special conditions unique to
the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 07-006.

Your request for an extension of the September 19, 2007 compliance date imposed by the
Sav�ryer County Board of Appeals is denied. It seems reasonable that that part of the
fence that is not now in compliance can be removed by September 19th. The replacement
for this fence section can be installed at any time provided that it meets the Board's

Part 2: Three-Step Test.
To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. This is known as the "three-step test."
1) Unique Property Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.
Do unique physical characteristics of your property prevent compliance with
the ordinance?
�Yes. Where are they located on your property? Please show the
boundaries ot these features on the site map that you used to describe
alternatives considered.

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of �
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this variance would not harm the public interests
or how it may even enhance the public interests.
3) Unnecessary Hardship.
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
area variance, unnecessary hardship exists when compliance would
unreasonabl�prevent the owner from using the property for a permitted
pur�ose or would render conformity with such restrictions unnecessarilv
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

Re: Fence Issues: #12469 W County Highway B
Dear Mr. Kaye:
I understand from talking to Gary Gedart, Highway Commissioner, that you have made
application for your fence, part of which is to be located on the County Highway B right-
of-way. Section 4.21 -Setback Requirements on Highways and Roads and Section
4.49(4) - Setbacks from Navigable Water are the applicable sections of the Sawyer
County Zoning Ordinance that pertain to the placement of this fence.
Section 4.21(2)requires that structures adjacent to County highways be located at least
75' from the centerline of the highway or 42' from the right-of-way, whichever setback
provides for the greater setback distance. However, there is an exception [(Section
4.21(5)] to this setback requirement in that the ordinance does allow for minor, readilv
removable structures such as open fences to be located closer to the highway. But, the
ordinance does not allow for structures to be built within the road right-of-way.
Section 4.49(4) - Setbacks from Navigable Water states:
(4) Fences within 75 feet of the ordinary high-water mark shall meet the following
criteria:
(a) Open fences may be allowed no closer than 40 feet to the ordinary hi�h-water
mark, shall not exceed 6 feet in height and shall not obstruct the adjoining
property owner's view of the water.
(b) A permit is not required to construct a fence.
My interpretation of the ordinance as it applies to the fence is:
• No part of the fence shall be located on the road right-of-way.
• No part of the fence shall be located closer than 40' to the ordinary high-
water mark of the lake.
• An open fence is required.
• The maximum height of the fence at all points within 75'of the ordinary
high-water mark,to include the top of posts,shall not exceed six(�feet.
The prior approval of a variance is required to exceed these requirements. A completed
vaziance application was mailed to you on January 29,2007. A reminder letter was
mailed to you on February 22,2007 concerning submission of the application for an April
2007 public hearing.
I will be out of the office for the remainder of this week retuming on Monday,March
12�h. Please let me know on the 12�h what your plans aze for the fence:remove the fence,
return the variance application etc.

Enclosed please find a copy of the drawing provided by the Sawyer County Board of
Appeals which illustrates an open fence.
If the non-compliant portion of your existing fence is going to be replace after removal, it

Dear Mr. Kaye:
I understand from talking to Gary Gedart, Highway Commissioner, that you have made
application for your fence, part of which is to be located on the County Highway B right-
of-way. Section 4.21 -Setback Requirements on Highways and Roads and Section
4.49(4) - Setbacks from Navigable Water are the applicable sections of the Sawyer
County Zoning Ordinance that pertain to the placement of this fence.
Section 4.21(2) requires that structures adj acent to County highways be located at least
75' from the centerline of the highway or 42' from the right-of-way, whichever setback
provides for the greater setback distance. However, there is an exception [(Section
4.21(5)] to this setback requirement in that the ordinance does allow for minor, readily
removable structures such as open fences to be located closer to the highway. But, the
ordinance does not allow for structures to be built within the road right-of-way.
Section 4.49(4) - Setbacks from Navigable Water states:
(4) Fences within 75 feet of the ordinary high-water mark shall meet the following

(a) Open fences may be allowed no closer than 40 feet to the ordinary high-water
mark, shall not exceed 6 feet in height and shall not obstruct the adjoining
property owner's view of the water.
(b) A permit is not required to construct a fence.
My interpretation of the ordinance as it applies to the fence is:
• No part of the fence shall be located on the road right-of-way.
• No part of the fence shall be located closer than 40' to the ordinary high-
water mark of the lake.
• An open tence is required.
• The maximum height of the fence at all points within 75'of the ordinary
high-water mazk,to include the top of posts,shall not exceed six(6)feet.
The prior approval of a variance is required to exceed these requirements. A completed
variance application was mailed to you on January 29,2007. A reminder letter was
mailed to you on February 22,2007 concerning submission of the application for an April
2007 public heazing.
I will be out of the office for the remainder of this week retuming on Monday,March
12�'. Please let me know on the 12�'what your plans are for the fence:remove the fence,
return the variance application etc.

This morning John Czarncki (Sawyer County Highway Department) and I visited your
property regarding the fence adjacent to County Highway B. During the visit it was
determined that the fence is in violation of Sawyer County Zoning Ordinance fence

The Sawyer County Zoning Ordinance, Section 4.49(4) SETBACKS FROM
NAVIGABLE WATER states:
(4) Fences within 75 feet of the ordinary high-water mark shall meet the following criteria:
(a) Open fences may be allowed no closer than 40 feet to the ordinary high-water mark, shall not
exceed 6 feet in heieht and shall not obstruct the adjoining property owner's view ofthe water.
(b) A permit is not required to construct a fence.
Earlier this year I was contacted by Gary Gedart, County Highway Commissioner, about
your proposed fence. I and another staff inember visited your property and flagged the
40' setback from the ordinary high-water mark of Little Round Lake. The fence is now
located approximately 21 ' to the lake. Also, the fence is a closed (not open) fence with a
height of approximately eight (8) feet, not the maximum height of six (6) feet as required
by the zoning ordinance.
Additionally, I understand that during your communications with the County Highway
Department that you were told that the fence could be located no closer than 40' (the
highway right-of-way setback) to the centerline of County Highway B. The majority of
the fence is actually located within the highway right-of-way.
Mr. Kaye, the fence must be made complaint by January 1, 2007:
• No part of the fence shall be located closer than 40' to the ordinary high-
water mark of the lake.
� The fence may be located as close as 40' to the centerline of County
Highway B provided that you enter into a written a�reement with the
Countv Hi�hway Department.
• An open fence, not a closed fence, shall be constructed.
• The maximum height of the fence at all points, to include the top of posts,
shall not exceed six (6) feet in height.
Failure to attain compliance by that date will result in the issue of a citation in the amount
of$375.00 for the violation of lake setback requirements.

I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Application for Variance—Additional Information,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
You should review the inspection report and application for correctness. If correct, si�n
the application and return it to this office with a check in the amount of$250.00 made out
to the "Sawyer County Zoning Administration"by Friday, August 4, 2006 for hearings in
September 2006.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Hayward at 7:00 P.M., Tuesday, September 12, 2006. You
should contact Arlene Mizerka, Town of Hayward Clerk, at (715) 634-4123 (Town Hall)
to confirm this date. It is very important that you contact Mrs. Mizerka as soon as
possible, as the Town of Hayward may require that you attend a meeting of the Town's
Planning Commission prior to your appearance before the Town Board.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, September 19, 2006 in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Hayward is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).
Mr. Kaye, today I was talking to the surveyor who created the Grand Pines Condominium
South Plat. He informed me that any structural change to any of the buildings in any
condominium that changes the square footage of that building would require a revision to
that condominium's plat. Furthermore, he stated that at least 80% of the association
members must agree to that revision. My recommendation would be that if a revision to
the plat will be required for your garage that it may be more appropriate if the revision
was to include a separate garage for your unit in the area where the other units (2-5) have
their garages. A variance would not be required to construct a garage in that location.
I suggest that you contact the attorney who assisted in creating the condominium for
advice on this matter.

Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on: Tuesday June 19, 2007.
This hearing will begin at 7:00 P.M. at the Sawyer County Courthouse, 10610 Main,
Hayward, WI 54843. It is rewmmended that either you or a representative be present at
the Hearing. A lack of information about the situation may result in unnecessary delay of
a decision. Failure to appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Raymond Zubrod, Chairman of the Boazd of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will also go before the Town Board. Some townships also have a
Planning Commission. Please contact your Town Clerk Shannon O'Hare; 715/634-
4123 for the day and time of the Planning Commission and Town Board meetings
so you or your representative may appear.

The purpose of this letter is to remind you that your signed variance application,
completed "Application for Variance - Additional Information" and $350 application fee
must be returned to this ofFice not later than Friday,Mazch 2, 2007 for hearings in April
2007.
The"Vaziance Application" will be reviewed at two public hearings. The first heazing
will be held by the Town of Haywazd at 7:00 P.M., Tuesday, April 10, 2007. You should
contact Arlene Mizerka, Town of Haywazd Clerk, at(715) 634-4123 (Town Hall) to
confirm this date. It is very important that you contact Mrs. Mizerka as soon as possible,
as the Town of Hayward may require that you attend a meeting of the Town's Planning
Commission prior to your appearance before the Town Board.
The Sawyer County Boazd of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, April 17, 2007 in the Assembly Room located in the Sawyer CounTy
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Boazd of Appeals can grant
the variance,the decision of the Town of Haywazd is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
