Application is for the expansion of an existing electrical substation resulting in a fence/retaining wall located 15' to a wet- land boundary. Variance is requested as Section 4.2, Sawyer County Zoning Ordinance, would require a minimum setback distance of 40' to this wetland area. The Town Board has approved this application. The Sawyer County Board of Appeals approved the application with a 2 year time limit from the time the permit is issued by zoning. Conclusions of Law and Findings of Fact: The hardship is due to physical limitations of the property because of the position of the existing substation as is and the extension to happen within that area. You're working within the confines of what was there years ago. And doing best to provide to the community. The variance will not be contrary to the public interest and will ob- serve the purpose of the ordinance and do justice because there is no change in the zoning and it will not be damaging to others ar property values. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice. Zoning Administrator notified me regarding potential well water concerns due to the pumping of raw sewage from the holding tank onto the ground at the above property. As part of Mr.Maki's stipulations regarding this issue,you were advised to sample the well water to ensure that the well is not polluted. In looking at the copy of the lab results from your water sample collected on November 27, 2007,I see that the sample was only analyzed for nitrates. While the nitrate result is below the drinking water standard of 10 mg/1 nitrates and nitrogen,this analysis alone, is not sufficient to assure that your water is not polluted. Coliform bacteria are microorganisms found in surface water, soil and in the feces of humans and animals. A water bacteria test should have also been collected from your well water to assure that the water is bacteriologically safe to drink. The presence of coliform bacteria in a water sample indicates that fecal wastes could be contaminating the water and that pathogenic (disease-causing) organisms could be present. If E.coli bacteria(a specific form of coliform bacteria) are found in the water, it indicates fecal contamination of the water. Pathogenic bacteria,viruses and parasites are often present in fecal matter and illness can result from drinking contaminated water. Because raw sewage was reportedly pumped onto the ground, it is important that you also sample the well far coliform bacteria.With the holidays coming up and labs closed during the holidays,you will want to collect a sample early next week if possible. Should you get a positive sample for bacteria, do not drink the water until the well is thoroughly disinfected and a bacteriologically safe sample is obtained. The results of the water bacteria test need to be provided to the property owner and Mert Maki. I have attached a brochure on bacteriological contamination in well water for your information. If you have any additional questions regarding your sample results or follow up work that may be needed to assure the safety of your well water,you may want to contact a licensed well driller or pump installer. As the County Soil Tester, I am very familiar with the soils and types of septic systems in the Namekagon Trail area. I believe there is a chance you would be able to have a shallow conventional pump up septic system installed near the road. Mr. Phillips, the neighbor across the road, installed a conventional system last year. I would recommend if you are interested in looking further into this, you contact a plumber/soil tester to conduct a soil evaluation. If you could install a conventional system, it would cut down on the high cost of pumping the holding tank. Enclosed please find a list of plumbers and soil testers. Dear Mr. Dettmann, Sue Miller, WI DNR Warden, has recently notified me of this septage violation. As Sawyer Counry Sanitarian, I am compelled to follow up this violation also. The holding tank was installed on August 11, 2005 and the rental unit was occupied shortly thereafter. Septage pumpers are required by State and County law to report all septage pumping. Our records indicate that the holding tank has been pumped only once, on Noveinber 13, 2006, for 1,500 gallons (see copy enclosed). If you have had it pumped more often by a licensed pumper, please provide my office and the DNR with documentation of pumping, ie: cancelled checks, receipts, pumpers name and phone number. The DNR will follow up this violation; however, I will caution you that I will follow up on any further pumping violations. Enclosed please find our citation schedule, pumping violation 1 L 18 3) (b) $748.00. I will not issue this citation at this time due to the pending DNR citation. However, any future violations will be followed up by our office. According to Sue Miller, you have been pumping the raw sewage onto the ground in the backyard. Do you realize the potential health hazard you created to your family, your well water, the neighbor's wells, the groundwater and pond in your backyard by this soil contamination? Do you realize the amount of raw sewage you have illegally pumped? It appears that you have illegally pumped for approximately 25 months. A calculation averaging daily usage at 100 gallons per day times 760 days is equal to 76,000 gallons total pumped out onto the ground surface and into the environment. I will set forth the following stipulations: 1. Immediately discontinue illegal pumping. 2. I will require that you submit documentation to me of all pumping for a period of 12 months—November 2007 through November 2008. Provide our office with the septic pumpers name, address and phone number. 3. Provide me with a well water quality test within 30 days or no later than December 7, 2007. There is a chance that your well water may be polluted. A copy of�this letter will be mailed to all parties concerned. Your cooperation would be appreciated. Safe levels of these chemicals or bacteria do not guarantee that your water is free of alt toxic chemicals. Bacteria die-off in samples over 30 hours old may render results inaccurate and are therefore deemed inconclusive. INTERPRETING YOUR DRINKING WATER QUALITY TEST . RESULTS: IDENTIFYING PROBLEMS AND SOLUTIONS Byron Shaw, Christine Mechenich and Jim Peterson University of Wisconsin - Extension University of Wisconsin - Stevens Point and University of Wisconsin - Madison Nitrate and Nitrite Nitrogen Nitrate nitrogen is a commonly used lawn and agricultural fertilizer. It is also a chemical formed in the decomposition of waste materials, such as manure or sewage. If infants less than six months of age drink water (or formula made with water) that contains more than 10 mg/L nitrate nitrogen, they are susceptible to methemoglobinemia. This disease interferes with the blood's ability to carry oxygen. Recent studies also suggest that high nitrate water may be linked to birth defects and miscarriages, so pregnant women should avoid drinking high nitrate water. High nitrate levels also suggest that other contaminants might be present. The natural level of nitrate in Wisconsin's groundwater is less than 0.2 mg/L. Nitrite is an unstable form of nitrogen which might be found in small amounts along with nitrate. Less than 2 mg/L is preferred. When reported as nitrate (NO3- ), the acceptable level is 45 mg/L or less. Sources: Fertilizer, septic system effluent, and animal waste. In most cases, elevated nitrate levels indicate general contamination of the aquifer(water-bearing formation) at the depth of the welL Corrective Action for Nitrate Nitrogen -Change the depth of, repair, or replace the welL -Eliminate contamination source. -Carry or buy drinking water, or connect to a public`supply. -Use a water treatment device (reverse osmosis; distillation; or for nitrate alone, anion exchange). ' Coliform Bacteria Coliform bacteria are microorganisms found in surface water, soil and in the feces of humans and animals. They do not usually cause disease. However, their presence indicates that fecal wastes may be contaminating the water and means that pathogenic (disease-causing) organisms could be present. If human or animal wastes are contaminating the water, gastrointestinal diseases, hepatitis, or other diseases may result. Many laboratories can also test for a specific fecal coliform bacteria, E. coli. The presence of E. coli in a water sample is more conclusive evidence of fecal contamination which represents an even greater health risk than the presence of total coliform bacteria. 0 Safe, Unsafe, not present any present Acceptable results: 0 coliform/100 milliliters of water (ml). If you have coliform bacteria present in a water sample, you should resample. If a second test shows coliform, take corrective action. Sources: Coliform bacteria occur in soils and in the feces of humans and animals. In areas using fractured bedrock or coarse sand and gravel aquifers, coliform bacteria may contaminate groundwater. More often, they are an indication of well construction and maintenance faults (also called sanitary defects). Corrective Action for-Coliform Bacteria Resample first, using careful technique. Check well for sanitary.defects. Examples include: ' -Well cap or seal not on tightly, or cap on tightly but not vented. -V��ring not i� conduit. -Well in a pit or basement. -Well casing not at least 12 inches above grade. -Casing cracked or rusted through. -Pitless adaptor poorly welded. -lnadequate grout (seal or fill around well casing). Some defects are easily viewed; others may require excavating around the well or opening the well. After correcting visible defects, disinfect the welf with a dilute chlorine bleach solution and resample after all traces of chlorine have dissipated. Test again one month later to ensure that the contamination source has been eliminated.
