Application is for the con- struction of a 10'x42' addition onto an existing dwelling with a dwelling setback of 66' to Lake Chippewa. The proposed addition will be located 76' from the ordinary high-water mark of the lake and will result in a total dwelling footprint of 1660 sq ft. Variance is re- quested as Section 4.421(2)(b)(4), Sawyer County Zoning Ordinance, would restrict the total dwelling footprint to 1500 sq ft. The Town Board has denied. The Board of Appeals tabled this application in January. The Sawyer County Board of Appeals approved the requested 10'x42' addition only if the exist- ing screen porch is removed. "The plan that they submitted showed that a roughly 20'x10' por- tion of the proposed addition would be screen porch and deck. If they don't want to use it for that and want to use it for year-round living space it's fine, as long as the footprint doesn't exceed the new proposed 10'x42'." Findings of Fact of the Board of Appeals: There would be no change in the use in the zone dis- trict. It would not be damaging to the rights of others or property values. It would be due to limi- tations unique to the property. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice. Current use of your property & improvements. Currently, the property is a condominium unit which is used for residential purposes. Describe the variance requested. The variance requested is to add a 10 foot by 42 foot addition to the side of the current residential condominium unit. Describe the effects on the property if the variance is not �ranted. The addition is required to upgrade the current cabin to include bathtubs in the bathrooms and protect the property value. Describe the alternatives to the requested variance such as locations, desi�ns and construction techniques. Attach a site map showin� alternatives that you considered in each cate�ory below. a.) Due to the cabin being located 66 feet from the ordinary high water mark of the Chippewa Flowage, we cannot add a second floor. If we could add a second floor, it would eliminate the need for the variance because we would not be expanding the footprints. In addition, the expansion area of the condominium declaration limits our area where we can expand. Describe the impact on vour property and adjacent properties if the variance is rag nted• The minimal increase in impervious surfaces of 400 square feet would be protected by gutters and downspouts to control water flow. Shoreline buffer is intact and would not be disturbed. Part 2. Three-Step Test. 1. YES. Unique Property/Phvsical Limitations. Due to condominium nature of the property, we have no ability to expand the cabin beyond a very limited expansion area. The cabin which was constructed in 1990 was inspected and approved by Zoning as meeting the 75 foot setback requirements. The fact that it is now out of compliance implies that erosion was the cause or contributed to the current non-compliance. 2. No Harm to Public Interests. The addition would not violate the impervious surface limitations nor would it be obtrusive when viewed from the lake. The addition is designed in a way to meet the 75 foot setback and not violate any Zoning requirements. 3. YES. Unnecessary Hardships Present. A hardship unique to this property is its location within the condominium unit. The unit is already at the minimum setback from the property line to the North. Its location within the condominium allows only a limited area for expansion. --� , � . Bodett variance #07-004. "Motion to approve the requested 10' x 42' addition on the west side of the existing cabin be allowed only if the existing screen porch is removed. The plan that they submitted showed that a roughly 20' x 10' portion of the proposed addition would be screen porch and deck. If they don't want to use it for that and want to use it for year-round living space—it's fine, as long as the footprint doesn't exceed the new proposed 10' x 42'." Second by Ray Zubrod. Motion carried. This morning I talked to Mr. Gerber about the intent of his motion. • Recognizing that the removal of the screen porch will then make the Bodett dwelling a conforming structure, is the addition stilllimited to a maximum of 10' x 42'? Yes. • Is vertical expansion allowed within the footprint of the dwelling, to include the 10' x 42' addition? Yes.
