Notice is hereby given that on December 15, 2009 the Sawyer CounTy Zoning Board of Appeals
approved the application for variance for the following proposal:
Town of Winter—Gerhard H. Noegel. Lot 1, being part of the SW 1/4 SW 1/4, S 10, T 38N, R
4W;Parcel 11.3. Volume 320 Records page 292. 5.100 acres total. Property is zoned Residen-
tiaURecreational One. Application is for the installation of a driveway access on to County High-
way W at a setback distance of 249' from an adjacent driveway. Variance is requested as Section
4.23, Sawyer County Zoning Ordinance, would require a minimum setback distance of 300' be-
tween driveways accessing this highway.
The Sawyer County Board of Appeals approved the application as submitted with the fol-
lowing conditions: (1) approval of the Town of Winter Town Board is required, (2) a wet-
land delineation must be performed and submitted to the DNR, (3) required approv-
als/permits are obtained from the DNR and (4) any required approvals/permits are ob-
tained from all other agencies/departments.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.

yellow a DNR review of their work will not be required. Notice that two of those
delineators are located relatively close to Winter—Tim King, Rice Lake, WI and Ann
Michalski, Ashland, WI. If you select one of the other delineators a DNR review of their
work will be required.

Bill,
We are not going out to do wetland determinations anymore as part of our budget crisis.
Unless it is related to an actual permit application or enforcement, we are not supposed
to go into the field. With that said;
If the variance application has a hint of wetland involved, then the DNR formally goes on
record as opposing the granting of the driveway setback variance for a number of reasons;
1) . The applicant has not provided a wetland delineation showing where the wetland(s) are
in relationship to the proposed driveway access.
2) . If the whole area is wetland, then Gerhard needs to apply and seek both COE and DNR
approval of any proposed wetland fill that may be related to his driveway
application/construction. That application is going to require a delineation too - so y�u
might as well go to item #1 above. That requires the complete alternative analysis of
avoidance (alternative access points/easement, elevated crossing, etc. ) before evaluation
of minimization. Driveway permit should not be issued in wetland situations until they
have a permit granted by COE and DNR.
At some point in the county issuance of driveway permits there has to be a determination -
up front - that the driveway point is upland. Not just in variance cases, but driveway
permits in general. We run into a finger pointing situation when a driveway permit is
issued and the bulldozer plows into an ash swamp. When DNR gets there the owner says he's
got his permit for the driveway. If driveway permit application are based on safety/line
of site, there needs to be a statement on the application or county permit that says
something about needing upland access and any questions whether it is upland needs to be
evaluated by a wetland delineator.

Gerhard Noegel has applied for a driveway setback variance for property that he owns east
of Winter. The property has 163' of frontage on Highway W all of it appears to be
wetland. The proposed driveway will cross approximately 50' of wetland. The driveway is
located at fire #3692N. His variance hearing is scheduled for Tuesday, December 15th.
Do you want to see this before the hearing? Let me know. I assume that you are out this
week as one of the ten hunters chasing one deer. Good luck.
