the SHORELINE VEGETATION PROTECTION AREA on said real estate shall be restored in accordance
with the Mitigation Plan and Implementation Schedule approved by the Sawyer County Zoning Department.
The owner(s)hereby agrees that at all times in the future,the real estate subject to this Agreement shall comply
with all shoreland vegetalive buffer requirements of the Sawyer County Zoning Ordinance in effect on the date
that the Land Use Permit is issued by the Zoning Office. The owner(s) fiuther agrees to allow authorized

On August 19, 2003, the Sawyer County Boazd of Appeals approved your application for vari-
ance on the following described real estate to wit:

the centerline of Peninsula Road (a town road). Vaziance is requested as Section

proved the application.
The Boazd of Appeals approved the application as amended: 1 year time limit.
Findings of Fact of the Boazd of Appeals: It would not be the basis of economic gain or loss. It
would not be a self-created hazdslup. There would be no change in the use in the zone district. It
would not be dmaging to the rights of others or property values. It would be due to special con-
ditions unique to the property, being the shape of lot and bounded by lake and road.
Any person or persons jointly aggrieved by this decision of the Boazd of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please

I have received and am reviewing your application for Land Use Pernut. I am writing for additional
information.
Sawyer County adopted new Shoreland Protection Regulations on January 5, 2004. Part of these
regulations requires the preservation and/or restoration of the Shoreland Buffer Zone. The buffer zone is
parallel to the Ordinary High Water Mark, landward and is 35 feet in width. This buffer zone should be all
natural vegetation with an exception for a viewing and access corridor. This corridor has a maximum of 30
feet or 30% in any 100 feet.
If your buffer zone is not in-tact it must be restored. This is usually accomplished by establishing a "no-
mow" zone.
Enclosed you will find two Shoreland Protection Agreement documents. One has a number 1 in the top
right-hand corner. This one is for shorelands that are not in-tact. The other has a number 2 in the same
comer. This one is for shoreland buffer zones that are in-tact. Please choose the appropnate document,
sign it and return it to me.

Re: Shoreline Vegetatioo Protection Area Inspection
Dear Joe and Julie:
On June 11, 2004, you applied for a Land Use Permit for construction activities on your
property. Section 4.419 MITIGATION REQUIREMENTS, ofthe Sawyer County Zoning
Ordinance requires, that as a conditio� for the issue of this permit, that you certify the
condition ofyour property's shoreline vegetatioa urotection area (SVPA). The SVPA is
defined as: "A strip of land 35 feet wide inland from the ordinary high-water mark of any
navigable body of water, including but not limited to: streams, rivers, ponds, flowages and
lakes. Term used synonymously with buffer zone, buffer area and buffer strip." You did
not indicate on your permit application whether the SVPA on your property requires
miti a� tion. Mitigation is defi�ed as: "The requirement to restore shoreline buffer functions
that have been lost or adversely affected through development."
On June 25, 2004, I visited your property to verify the condition ofthe SVPA. During my
visit I flagged the SVPA with blue flags stating "35' buffer zone". It is my determination
that the SVPA does require mitigation. Since mitigation is required, you must now allow
this area to return to its natural state in accordance with Section 4.410 SHORELINE
VEGETATION PROTECTION AREA — copy attached. You can accomplish the
required mitigation by what is commonly referred to as "no-mow" — allowing the
vegetation in the SVPA to return to its natural state.
