Volume 626 Records page 481;CSM Volume 14 Page 260. 1.85 acres to- tal.Property is zoned Residential/Recreational Two.Application is for the construction of a 24'x 29'addition onto an e�cisting dwelling that is located approximately 39'to the ordinary high-water mazk of Clear Lake. The proposed addition will be located appro�rimately 3T to the ordinary high-water mazk of the lake. This variance has been previously approved by the Spider Lake Township Zoning Board of Appeals with conditions.Variance is requested as Section 4.21(2)(a), Sawyer County Zoning Grdinance,would require the prior granting of a variance fo:any expan- sion of this dwelling as the dwelling is located less than 40'to the ordinary high-water mazk of the lake.Conditions placed as followed: 1)move shed to the location noted in the variance peti- tion documents; 2) continue buffer zone restoration; 3) provide a drainage system for rainwater from the house&garage to minimize impact on the adjacent wettand;4)move present structure two(2)feet north so that no part of the structure is less than 40 feet from the ordinary high water mark;5)two(2)year time limit. To qualify for your requested variance, you must demonstrate that your property meets the following three requirements. This is known as the "three-step test." 1) Unique Property Limitations. In applying this test, the Board of Appeals must consider impacts of your proposal and the cumulative impacts of similar projects on the interests of the neighbors and the entire community. Courts have also determined that economic or financial hardship does not justify a variance. When determining whether unnecessary hardship exists, the property as a whole is considered rather than just a portion of the parcel. You are applying for an "area variance.' An area variance relaxes a dimensional standard such as a setback, frontage, lot area, or height. For an area variance, unnecessary hardship exists when compliance would unreasonabl�prevent the owner from usin�the property for a permitted purpose or would render conformity with such restrictions unnecessarily burdensome. Subject: Variance Application Per our recent discussion, I am enclosing the materials for our petition for variance which we submitted to the Town of Spider Lake. As I mentioned to you, one of the items discussed at the hearing was the potential to move the current structure beyond the 40 ft. OHWM of the water to the south of the existing structure and then potentially a variance would not be needed. Steve Boss confirmed that this would be allowed per the Town of Spider Lake ordinance but he did not know if this was allowed per the Sawyer County zoning ordinance. At this point we are not certain we want to move the existing structure. The variance as granted gives us the option to move the entire structure or build the addition a foot or two to the north so it does not extend beyond the 40' point from the OHWM of the water to the south of the structure. Alternative locations of the structure and/or addition do not exist. • A variance will not be contrary to the public interest because the plans do not impact the publicly used navigable lake. The mitigation plan improves overall public health and safety due to improvements in prevention and control of water pollution, protection of fish and aquatic life, control of building site, and preservation of natural beauty. See Figure 1 for the Property location. Ms. Michalski met with Mr. Dave Kafura (Wisconsin Department of Natural Resources), Mr. Steve Boss (Town of Spider Lake), and Mr. George Hrdlicka (Contractor) to discuss the proposed project and the location of wetland and ordinary high water mark (OHWM) setbacks. The intent of the visit was to determine the wetland and OHWM locations on your property for purposes of determining building setbacks for proposed future expansion of your cabin. Ms. Michalski flagged the �vetland boundary in the vicinity of the cabin, garage, and shed during the site visit. The wetland boundary was determined based on observations of wetland vegetation, hydrology, and soils. Mr. Kafura then identified the OHWM at the Property and placed a flag along the shoreline to the south of the Property. Mr. Kafura observed the wetland to the south of the cabin and indicated that this area would be considered lakebed wetland but that he did not consider it to be "navigable" per the definition. On August 6, 2008, a Registered Land Surveyor (RLS) from Northern Environmental surveyed the OHWM elevation and carried the elevation through the remainder of the property. The final OHWM location is indicated on Figiire 2. The surveyor also mapped the wet(and boundary, all structures, the driveway, dry well, and availabie corner markers. Figure 2 indicates the site layout, as well as all setbacks including side-yard setbacks, OHWM setbacks, and wetland setbacks. Figure 2 also indicates the location of the proposed addition to your cabin. You have indicated that you intend to take several steps toward reducing the impacts of the proposed addition including restoratian of the 35-foot shoreline buffer zone, moving the shed which is currently located to the south of the cabin, constructing a rain garden between the wetland and the main structure, and stabilizing the area between the wetland and the cabin with native plantings to prevent soil erosion.
