Volume 813 Records Page 923; CSM Vol 23 Page 328 and CSM Vol 26 P 301 . Approximately 30.40 acres to be rezoned out of the total 57.75 acres. Approximately 24.85 acres is wetland and approximately 2.50 acres is already zoned ResidentiaURecreational One. Change from District Agricultural One to District ResidentiaURecreational One. Purpose of request is for the construction of a maximum of 28 single family condominium units. Application also made for Conditional Use for multi-family development. The Sawyer County Zoning Committee motioned to approve both applications with the following conditions: (amended Exhibit A, and maps Exhibit B) 1. Wetland Conservation Easements. Corps of Engineers permit 2007-2895-WMS requires that �vetland bogs identified in Map 1 be protected in perpetuity by a conservation easement or covenants recorded with the deed prior to starting any of the work authorized by the permit. The conservation easement for bogs A1 through A6 of Map 1 will have the terms and conditions following those outlined in DNR S�andard Grant Easement 9/O5. Cranberry Ridge, the Grindstone Lake Association and the Corps of En�ineers will jointly develop the easement. The easement will be registered with the Sawyer County Register of Deeds prior to starting any of the work authorized by permit 2007-2895-WMS. One of the conditions in the conservation easement is that homeowners will be able to clear view corridors not to exceed 30 feet. The easement will stipulate that Grindstone Lake Association will have the right to seek redress if ternis of the easement are violated. Also, there will be no boardwalks or access through these viewing corridars. When the vegetation reaches 15 feet in height within the viewing corridors the trees can be topped. 2. Monitoring for Compliance of Conservation Easement Terms and Conditions. The Grindstone Lake Association or its assignee will monitor compliance with the easement terms at least annually. A copy of its findings will be given to the Cranberry Ridge Home Owners Asssociation or the current o�vner of the property within 30 days of the physical inspection of the property. The Cranberry Ridge Home Owners Association or current owners of the property will annually contribute $500 to the Grindstone Lake Association to cover the cost of monitoring. These conditions will be incorporated in the aforementioned easement. �. Area to be Rezoned. Bog areas represented in Map 2 "Gene Skille Cranberry Marsh Proposed Rezone" will not be rezoned, approximately 24.85 acres. 4. Approved Construction Plans per Permit Requirements. Construction plans that apply to the Corps of Engineers and Wisconsin DNR permits granted to date have been distributed to the Town of Bass Lake, Sawyer County, Grindstone Lake Association, Wisconsin DNR, and the Corps of Engineers. The development of Cranberry Ridge will comply with these plans except that placement of the 28 housing units will be defined with the final plat. Placement of piers will be determined at a later date in cooperation with the Wisconsin DNR. 17 units of the 28 housing units to be built will have direct lake access. The actual lot/unit with direct lake access will be identified at the tiine of final platting. 5. Prohibit Further Agricultural Use of the Property. Cranberry production will cease when 7 lots/units are sold, if not sooner. If the sale of the 7t" lot occurs during the growing season beginning April 1 st of each year, that year's crop can be harvested. 6. Prohibit Storm Water Runoff to Grindstone Lake. Construction will be such that there will not be any storm water runoff into Grindstone Lake. 7. No Future Rezones of the Property. Property within Cranberry Ridge will not be further subdivided after the granting of this zoning request. 8. Only Single Family Homes on the Shore of Grindstone Lake. Housing units to be built on the lake shore will be single family, detached units. Site Reviews During Construction. Representatives of the Grindstone Lake Association will be invited by Steve Sletner or subsequent developer to review the construction progress. It is assumed during the peak of the construction this could be a weekly review. Approval of both applications is contingent on bringing back to the committee the Conservation Easement and that the committee review and approve the easement as well as the declaration and condo plat. This review is to be placed on the March 28, 2008 public hearing agenda. Findings of Fact of the Zoning Committee: It would not be damaging to the rights of others or property values. It would not create topographical problems such as runoff, drainage, erosion, flooding, or vegetative cover removal. It would not create traffic or highway access problems. It's in keeping with sections of the town's comprehensive plan and their decision. The Sawyer County Board of Supervisors must ratify the approval of the change in zone district before it becomes final. This will be scheduled for the County Board meeting on March 20, 2008, 6:30 P.M., in the Circuit Courtroom of the Sawyer County Courthouse. The approval of the conditional use will expire on February 15, 2009, if application for the actual permit to use/construct is not made by that date. This decision is a recommendation to the County Board of Supervisors. Any person or persons jointly aggrieved by the decision of the County Board may commence an action in the circuit court for writ of certiorari to review the decision in whole or in part, within thirty(30) days after the filing of the decision in the office of the Board.
