Kozlowski explains the Motion that was made adjourn that additional information was needed for
engineering,for a driveway, grading for the building and driveway permit from the County. The
adjournmen[never specified a deadline. Andy Phillips, Lega/Counsel the word adjoummenf is confusing.
It's not an adjournment, it is a postponement. When there is a postponement there needs to a[ime
certain so his recommendation is to set that dote so ZoningDepartment has the necessary information to
give[he owner for when the materials is due back for the Commi[tee. Motion by Buckholtz to set the due
for November 1,20��, semnd by Shuman. All in favor.

3.54 total acres; Zoned Residential/Recreational One (RR-1 ). Located at 2892N County Hwy F
Request: Purpose of request is to have up to a 1200 square foot commercial building for
recreational sales and marina including convenience store and bait shop as per section 17.2(B)(3)
of the Sawyer County Zoning Ordinance.
Project History & Summary of Request: As per the applicant's statement they are requesting to
build an approximately 1 ,000 sq ft building (not to exceed 1 ,200 sq ft) on the property that would
serve as a dock/lift service center but also have other aspects of a marina that would rent boats,
minor repair parts, and possible bait sales. The building would include a front office area, small
break room, boat parts for basic repairs, bait sales, and a small pavilion. Future storage sheds for
slip customers would also be included as part of this request but would need to meet applicable
setbacks.
At this time no formal plans or building layouts have been discussed with the Sawyer County
Zoning & Conservation Department. The Zoning & Conservation Department would have an
onsite inspection conducted after spring melt to accurately layout building location. As part of one
of the conditions for potential approval it would be recommended that a licensed engineer would
sign off on site stability and erosion control plans for building proposal. This would only be for a
potential approval of the conditional use permit. This site certainly has some topography
challenges with it but through careful planning and water diversion techniques this site could be
developed. The owner would work with the Conservation Department to ensure site stability.
The boat slips and marina aspects as they relate on-water would already require DNR approval or
meet the specified guidelines from the DNR included within the "pier planner" infonnation
distributed by the DNR.
This CUP request originally started back in March of 2022. At that time, a motion was made to
adjourn the case for additional infonnation far an engineered driveway, grading for building and
driveway permit from County. It was later brought back to ZC in June in that this originally
adjournment never had a set deadline as to complete these requirements. In June a motion was
made that the applicant would need to provide information by November 1, 2022. In October 2022,
the Zoning Committee made a further motion that due to vague language of the first motion that
the Committee would rehear this case including wiping out any previous conditions and
adjournments and that the application be reheard at the December Zoning Coinmittee Meeting.
It should be noted that the applicant has secured a driveway permit from the County Hwy
Department and a Grading Permit from Sawyer County Zoning to start construction of a driveway
installation.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than�nerely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use pennit and that reasonable persons would accept in support of a
conclusion. If an applicant agrees to ineets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use pennit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must deinonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which inust be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

17.2 RR-1:Residential/Recreational One District
This district is intended to provide for residential development and essential recreation
oriented-services in areas of high recreational value where soil conditions and other
physical features will support such development without depleting or destroying natural
resources.
A)Permitted Uses
1)One-family and two-family dwellings.

Request: Purpose of request is to have a 1000 square foot commercial building for recreational
sales, marina, and bait shop as per section 17.2(B)(3). This request would be only for the land
East of County Hwy F between the road and Lake Chetac; approximately 3.06 acres.
Project History & Summary of Request: As per the applicant's statement they are requesting to
build an approximately 1 ,000 sq ft building on the property that would serve as a dock/lift service
center but also have other aspects of a marina that would rent boats, minor repair parts, and possible
bait sales. The building would include a front office area, small break room, boat parts for basic
repairs, bait sales, and a sinall pavilion. Future storage sheds for slip customers would also be
included as part of this request but would need to meet applicable setbacks.
At this time no formal plans or building layouts have been discussed with the Sawyer County
Zoning & Conservation Department. The Zoning & Conservation Department would have an
onsite inspection conducted after spring inelt to accurately layout driveways and buildings. As part
of one of the conditions for potential approval it would be recommended that a licensed engineer
would sign off on plans for the driveway installation and building proposals related to grading and
erosion aspects. This site certainly has some topography challenges with it but through careful
planning and water diversion techniques this site could be developed. The owner would work with
the Conservation Department to ensure site stability.
The boat slips and marina aspects as they relate on-water would already require DNR approval or
meet the specified guidelines from the DNR included within the "pier planner" information
distributed by the DNR. The owner will also need to obtain a driveway permit for the Sawyer
County Hwy Department for access onto County Hwy F.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the pennit must be supported by substantial evidence.

Your application for a Conditional Use will be considered at a Public Hearing before the Sawyer County
Zoning Committee on February 18,2021. This Hearing will begin at 8:30 A.M.in the Sawyer County
Courthouse, 10610 Main Street, Hayward,Wisconsin.
It is recommended that either you or a representative be present at the Hearing. Enclosed is virtual
attendance information.A lack of information about the application may result in unnecessary delay of a
decision. Failure to appear may also result in the denial of the application.
If it is impossible for you or a representative to be present, please submit a written statement directed to
Ronald Buckholtz,Chairman of the Zoning Committee addressed to this office.The statement should
include your proposed intentions or purpose of the request and a description of the general terrain and
surrounding development. Indicate how the proposal would not be contrary to the public interest.
Photographs of the property and surrounding area are encouraged.
Your application will also go before the 7own Board for their review. Some townships also have a
