On lune 20, 2022, the Sawyer County Zoning Committee approved your application for a chonge of zone
district on the following described real estate to wit�

This decision is a recommenda[ion [o the County Board of Supervisors. Any person(s)jointly aggrieved by

Request:
Purpose of request is to rezone the 18.9 acres of the F-1 to Residential/Recreational One (RR-1).
The included 3.47 acres of Shoreland-Wetland (S-W) is not to be affected by the rezoning. The
proposed rezone to Residential/Recreational One (RR-1 ) is requested in order to divide lot and
build lakeshore cottages.
Summary of Request & Project History:
The applicant is requesting to rezone the above described 18.9 acres of from F-1 to RR-l .
The F-1 zone district requirements would need a miniinum of 5 acres and a 300' width
requirement. Thus, the zone district change is being requested. The Town of Edgewater
comprehensive plan future land use shows this area as "shoreland residential". Shoreland
residential as defined by the Town of Edgewater comprehensive plan still references the old Lake
Classification system which is no long in effect. These Lake Classifications were initially intended
to protect environmental sensitive bodies of water. This property is located on Little Sissabagama
and an unnamed lake which were "Wilderness" bodies of water which would have required a 300'
wide lot of water frontage and a miniinu�n land area of 5 acres. The Town Comp Plan references
only up to the old Class 3 system whicll would have a ininiinum density of 1 home per 40,000
square feet of land area and 200' of frontage.
If the property was rezoned to RR-1 the minimum lot sizes would be 100' of width of
frontage and 200' of depth under the new shoreland zoning rules and most likely could "fit" 4 lots
on Little Sis. Also note that rezones cannot include conditions. With remaining F-1 the property
could be divided into 3 lots but only 1 of the lots would be allowed Little Sissabagama Lake access.
The surrounding land area is mixed between F-1 and other RR-1 properties with single
family dwelling development along Little Sissabagama Lake.

Zoning Committee Public Hearing Information:
The Town of Edgewater approved the rezoue request on February 8th at The Town Board
Meeting with a vote of 2-1.
There were 12 opinion letters sent to property owners within 300'. 6 returned with
objections, 1 with no objections and read into record. There was additional objections there
were heard at the Sawyer County Zoning Cominittee Meeting
At the Sawyer County Zoning public hearing meeting on April 22, 2022 the Zoning
Committee was unable to reach a decision. The vote was tied at 2-2. With no recommendation
to The County Board of Supervisors. This was then remanded back to Zoning Committee by
County Board and a new public heariilg was lleard on June 17, 2022. At that public hearing the
Sawyer County Zoi�ing Committee made to recoinmendation for approval to the County Board
of Supervisors by a vote of 3-2 with the finding of facts:
-It would be Consistent with the Town and/or County Comprehensive Plan.
-It would be compatible with the surrounding uses and the area.

Request:
Purpose of request is to rezone the 18.9 acres of the F-1 underlaying zone district to
Residential/Recreational One (RR-] ). The included 3.47 acres of Shoreland-Wetland (S-W) is
not to be affected by the rezoning. The proposed rezone to Residential/Recreational One (RR-1 )
is requested in order to divide lot and build lakeshore cottages.
Summary of Request & Project History:
The applicant is requesting to rezone the above described 18.9 acres of from F-1 to RR-1 .
The S/W District overlay is not part of the rezone request and would stay as an overlay. The F-1
zone district requireinents would need a �ninimum of 5 acres and a 300' width requirement. Thus,
the zone district change is being requested. The Town of Edgewater comprehensive plan future
land use shows this area as "shoreland". Shoreland as defined by the Town of Edgewater
comprehensive plan still references the old Lake Classification system which is no long in effect.
These Lake Classifications were initially intended to protect environmental sensitive bodies of
water. This property is located on Little Sissabagama and an unnamed lake which were
"Wilderness" bodies of water which would have required a 300' wide lot of water frontage and a
minimum land area of 5 acres. The Town Coinp Plan references only up to the old Class 3 system
which would have a minimum density of 1 home per 40,000 square feet of land area and 200' of
frontage. The Town Plan further goes on to state, "in some cases, natural features and resources
along lakes, rivers, and streams may not be conducive to all types of development. While the future
land use map has areas representing the 1 ,000 foot and 300 foot areas pertaining to development
requirements as specified by the lake classification system, the areas shown do not imply that any
and all development types are allowed. Specific review of the areas around lakes, rivers and �
streams must be performed.
If the property was rezoned to RR-1 the minimum lot sizes would be 100' of width of
frontage and 200' of depth under the new shoreland zoning rules and most likely could "fit"41ots
on Little Sis. Also note that rezones cannot include conditions. With remaining F-1 the property
could be divided into 3 lots but only 1 of the lots would be allowed Little Sissabagama Lake access.
The surrounding land area is mixed between F-1 and other RR-1 properties with single
fainily dwelling development along Little Sissabagama Lake.

conversations with the WI DNR the requests clearly needs to state that just the underlaying County

someone is truly attempting to rezone a S/W district which is extremely rare.

RESOLUTION TO AMEND SAWYER COUNTY OFFICIAL ZONING MAP
WHEREAS, Wisconsin law permits Sawyer County (the "County") to adopt certain
zoning ordinances and amend its existing zoning ordinances, including amendments to the
County's official zoning map;
WHEREAS,the owner of real property located at Part of Government Lot 4; 520, T38N,
R09W• Parcel #008-938-20-5402• 18 9 total acres• Zoned Forestry One (F-1) includin� 3.47 of
ShorelandlWetland as an overlav district. The "Property" and as more fully described as set
forth in Exhibit A which is attached hereto and incorporated herein, requested a rezonin�; of the
Pro,perty's zoning underla�in�desi�nation from (F-1 Forestry One to (RR-1)
Residential/Recreation One (the "Zoning Designation Amendment"); The included 3.47 acres of
Shoreland-Wetland (S-W�overlay is not to be affected bv the rezonin�.
WHEREAS, the Sawyer County Zoning Committee (the "Zoning Committee"), at its
meeting on April 22, 2022, reviewed the proposed Zoning Designation Amendment for the
Property;
WHEREAS, the Zoning Committee voted to recommend approval/denial of the proposed
Zoning Designation Amendment to the Sawyer County Board of Supervisors ("County Board");
as determined by findings of Fact included as Exhibit B.
WHEREAS,the County Board determined, at its meeting on Mav 19, 2022, that adopting
the proposed Zoning Designation Amendment for the Property is warranted to protect the health,
welfare and safety of its citizens.
NOW, THEREFORE BE IT RESOLVED,by the Sawyer County Board of
Supervisors approves the following:
1. Amendment to Official Zoning Map. The Property's zoning designation shall be amended �
to RR-1 Residential/Recreational One.
2. Additional Actions. The Sawyer County Department of Zoning and Conservation
Administrator (or his/her designee) shall take all necessary steps to ensure that the
amendment adopted herein is completed.

am opposed to Hathaway Lodge, LLC's proposed rezoning of iu property, Parcel #008-
938-20-5402,as proposed in file RZN 22-002.
2. I organized the protest petition to oppose HaYhaway Lodge,LLC's rezoning application.
3. As a part of my efforts, I spoke to each property owner who has signed the protest
petiuon, confirmed the owner's opposition to HaThaway Lodge, LLC's rezoning
application, and arranged for them to sign the protest petition. I arranged for signatures
between May 14 and May 16, 2022, and each si�ature is true and conect to the best of
my knowledge.
4. Every properry owner who has signed the protest petitioo has signed voluntarily.

Thank you for the time to discuss the requests appearing before the Sawyer County Zoning Committee tomorrow, and
for the opportunity to provide comments. As we discussed the following are general comments regarding shoreland
zoning as they relate to the requests. These comments relate to the requirements of the Sawyer County Zoning
Shoreland-Wetland Protection Ordinance.
Hathaway Lodge LLC Rezone. Considering the wetlands on the property in question the department recommends
ensuring the applicant's future plans remain outside any wetlands and not create discharge to any wetlands, as well as
meet applicable shoreland setbacks.
Larson CUP. Given the request is to build a garage prior to a future principal structure the department recommends the
location of the garage leaves sufficient space for legal placement of the desired future principal structure.
Zesiger Trust CUP. Considering the wetlands on the property in question the department recommends ensuring the
applicant's operation meet applicable shoreland-wetland requirements, including remaining outside any wetlands and
not creating discharge to any wetlands.
Thompson CUP. Considering the wetlands on the property in question the department recommends ensuring the
applicant's operation meet applicable shoreland-wetland requirements, including remaining outside any wetlands and
not creating discharge to any wetlands.
The department has no comments regarding any of the other requests.

Native Plants of the Wetlands of Little Sissabagama
The wetlands that are a large portion of the shoreline of the#22-002 rezone request are more
than likely the home of a number of sensitive plants,animals and fish.
In the summer of 2021,Paul Skawinski,UW Stevens Point Aquatic Plant Specialist and Scott
Van Egeren,DNR Biologist,did a preview survey of the aquatic plants on Little Sissabagama.
They reported a number of plants that were indicators of high water quality,plants that were
sensitive to human disturbance and indicated good quality habitat for fish and other insects
andinvertebrates.
The tamarack bog is the home of many sensitive indicator species,sort of a"canary in a coal
mine";warning us as they die off of cascading losses in the environmentat system of the land
and lake they are a part of.
Some of the rare and sensitive plants that have been recently identified on Little Sissabagama
or in iYs bogs are:
