On lanuary 21, 2022, the Sawyer County Zoning Committee approved your application for a change of
zone distrid on the following described real estate to wit:

Residential/Recreational One(RR-1J. Purpose of request is to rezone approximately 5.40 acres of property
[o commercial one(C-I)for a mmmercial storage building.
Motion by Boettcher to approve the application,serond by Hessel. Roll call finds Pe[it—no, Boettcher—
yes, Hessel—yes, Buckholtz—yes. 30 to 1 in favor.
Findings of Fact:1)It would not be damaging to the rights of others or praperty values. 2J It would not be
dehimental to ecology, wild life, wetlands or shorelands. 3)It would not create an air quolity, water
supply or pollution problem.
The Sawyer County Board of Supervisors must ratify tbe approval af the change in zone distrid before it
becomes final. This will6e scheduled for the County Board meeting on Fe6ruary 17,2022 at 6:30 P.M., in
the Circuit Courtroom of the Sawyer County Courthouse.
This decision is a recommendation to the County Board of Supervisors. Any person(sJ join[ly aggrieved 6y
the decision of the County Board may rommence an action in the Circuit Court for Writ of Certiorari to

Request: Purpose of the request is to rezone approxiinately 5.40 acres of the total 18.39 acres to
Commercial (C-1 ). As per applicant's stateinent, `'This would be for a commercial storage
building.
Summary of Request & Project History:
The applicant(s) are requesting to rezone 5.40 acres of RR-1 to G1 (see attached map of
parcel). The proposed rezone would result in confonning lot dimensional requirements. The
purpose of this request would then be to have a pennitted use within the commercial-one zone
district. The use as specified by the applicant is for coinmercial storage building(s).
Additional Information/details:
See attached additional inaps included in this packet. The nearest C-1 zoned property in
relation to this property is approximately 6000' away to the North along the County Hwy E/F &
Hwy 70 intersection. Tlle future land use lnap for the Town of Sand Lake shows this area as
"shoreland" which is just indicating of a 1000' buffering around waterbodies. Which as part of the
Town's Comprehensive Plan still references the old Lake Classification system. The Town of Sand
Lake has approved the requested rezone request as it would not create a traffic or highway. There
are a few other residential structures within the i�ninediate area specifically north of the subject
property.
This inay be viewed as spot zoning, but spot zoning is not necessarily illegal because
such zoning is not necessarily inconsistent with the purposes for which zoning ordinances can be
passed. However, rezoning should be consistent with long-range planning and based upon
considerations which affect the wllole coinmunity. Therefore, spot zoning should only be
indulged where it is in the public interest and not solely for the benefit of the property owner
requesting the rezoning.
Zoning Committee Public Hearing Information:
There were 7 opinion letters sent to property owners within 300'. 1 returned with objections,
1 with no objections and read into record.
The Town of Sand Lake approved the rezone request on January l Oth at The Town Board
Meeting in that it would not cause any traffic issues.
At the Sawyer County Zoning public hearing meetiug on January 21, 2022 it was
recommended for approval to County Board by a vote of 3-1 with the findings of facts
determined as:
1 It would not be dainaging to the rights of others or property values
2 It would not be detrimental to ecology, wild life, wetlands or shorelands.
3 It would not create an air quality, water supply, or pollution problem.

� How the Map was Developed
Early in the plamiing process, surveys were distributed to all landowners in the town; the results
� of these surveys assisted the town planning committee in defining coinmunity issues and
opportunities. A series of goals and objectives were developed which embraced the coinmunity
vision as expressed by the citizens in their responses to the survey. These tools were utilized in
�� conjunction with an analysis of existing environmental, infrastructure, and transportation
conditions to determine the most appropriate locations for future growth and development.
� Finally, growth forecasts based on the projections found in the Issues and Opportunities and
Housing Elements provided the means to assess future needs related to land use. The
combination of public involvement, assessment of conditions, and expected future needs led to
�` the development of a future land use map and supporting narrative.
Future Land Use Cateqories
� The Town of Sand Lake Future Land Use Map delineates broad categories of future land use.
These categories are, in some cases, consistent with the existing land use classification and
simply represent a continuation of the existing situation. In other cases, the future category may
� be different from existing use and/or zoning classification, representing a recommended or
anticipated shift in use. When and whether these areas should be rezoned to be consistent with
the provisions of the Town of Sand Lake Comprehensive Plan is at the discretion of the both the
� Town of Sand Lake and the Sawyer County Zoning Committee based on a mutually agreed upon
decisions.
� Agriculture
Agricultural areas represent varying forms of activity. Areas defined on the map are generally
� those areas where future agricultural practices are expected to continue during the planning
period. Minimum density thresholds within this category are one home per five acres.
� Commercial

Summary of Request & Project History:
The applicant(s) are requesting to rezone 5.40 acres of RR-1 to C-1 (see attached map of
parcel). The proposed rezone would result in conforming lot dimensional requirements. The
purpose of this request would then be to have a permitted use within the commercial-one zone
district. The use as specified by the applicant is for coinmercial storage building(s).
Additional Information/details:
See attached additional maps included in this packet. The nearest C-1 zoned property in
relation to this property is approxiinately 6000' away to the North along the County Hwy E/F &
Hwy 70 intersection. The future land use inap for the Town of Sand Lake shows this area as
"shoreland"which is just indicating of a 1000' buffering around waterbodies. Which as part of the
Town's Coinprehensive Plan still references the old Lake Classification system. The Town of Sand
Lake has approved the requested rezone request as it would not create a traffic or highway. There
are a few other residential structures within the immediate area specifically north of the subject
property.
This inay be viewed as spot zoiling, but spot zoning is not necessarily illegal because
such zoning is not necessarily inconsistent with the purposes for which zoning ordinances can be
passed. However, rezoning should be consistent with long-range planning and based upon
considerations which affect the whole community. Therefore, spot zoning should only be
indulged where it is in the public interest and not solely for the benefit of the property owner
requesting the rezoning.
