Adennan C O U N T Y 9676N Kruger Road Hayward, WI 54843 Agent: Tim Butterfield Property Location & Legal Description: Located in Town of Sand Lake NW '/ of the SW '/; S14, T38N, R09W; Parcel #026-938-14- 3201 ; Tax ID#27904; 28 total acres with 11 acres in lake; Zoned Forestry One (F-1 ). Request: Purpose of request is to rezone all Forestry One (F-1 ) land above lake elevation to Residential/Recreational One (RR-1) to eventually create 2 or 3 separate lots. This would result in approximately 17 acres subject to the request. The Shoreland/Wetland District is not to be affected as part of this request. Summary of Request & Project History: The applicant is requesting to rezone the above described 17 acres of F-1 to RR-1 . The S/W District overlay is not part of the rezone request and would stay as an overlay. The F-1 zone district requirements would need a minimum of 5 acres and a 300' width requirement. Thus, the zone district change is being requested. The Town of Sand Lake comprehensive plan future land use shows this area as "shareland". Shoreland as defined by the Town of Sand Lake comprehensive plan still references the old Lake Classification system which is no long in effect. These Lake Classifications were initially intended to protect environmental sensitive bodies of water. This property is located on Rogers Lake and would have been classified as a "Wilderness" body of water which would have required a 300' wide lot of water frontage and a minimum land area of 5 acres. The Town Comp Plan references only up to the old Class 3 system which would have a minimum density of 1 home per 40,000 square feet of land area and 200' of frontage. The Town Plan further goes on to state, "When and whether these areas should be rezoned to be consistent with the provisions of the Town of Sand Lake Comprehensive Plan is at the discretion of both the Town of Sand Lake and the Sawyer County Zoning Committee based on a mutually agreed upon decision." If the property was rezoned to RR-1 the minimum lot sizes would be 100' of width of frontage and 200' of depth under the new shoreland zoning rules and most likely could "fit" 41ots on Rogers Lake with a separate easement or wetland fill access road to additional upland area. In conversations with the applicant the rezone is being requested in order to utilize the existing footprint of an existing cabin on this property that would be divided out on its own separate lot. A separate lot from where a new prirnary dwelling is currently under construction. The surrounding area is a mix of residential and farestry with only 1 other�3welling that has Rogers lake access. Zoning Committee Public Hearing Information: There were 4 opinion letters sent out, a114 returned with objections to the rezone and incorporated into the record. The Town of Sand Lake approved the rezone request on September 12, 2022. Aderman C O U N T Y 9676N Kruger Road Hayward, WI 54843 Agent: Tim Butterfield Property Location & Legal Description: Located in Town of Sand Lake NW '/ of the SW '/; S14, T38N, R09W; Parcel #026-938- 14- 3201 ; Tax ID#27904; 28 total acres with 11 acres in lake; Zoned Forestry One (F- 1 ). Request: Purpose of request is to rezone all Forestry One (F- 1 ) land above lake elevation to Residential/Recreational One (RR- 1 ) to eventually create 2 or 3 separate lots. This would result in approximately 17 acres subject to the request. The Shoreland/Wetland District is not to be affected as part of this request. Summary of Request & Project History: The applicant is requesting to rezone the above described 17 acres of F- 1 to RR- 1 . The S/W District overlay is not part of the rezone request and would stay as an overlay. The F- 1 zone district requirements would need a minimum of 5 acres and a 300' width requirement. Thus, the zone district change is being requested. The Town of Sand Lake comprehensive plan future land use shows this area as "shoreland". Shoreland as defined by the Town of Sand Lake comprehensive plan still references the old Lake Classification system which is no long in effect. These Lake Classifications were initially intended to protect environmental sensitive bodies of water. This property is located on Rogers Lake and would have been classified as a "Wilderness" body of water which would have required a 300' wide lot of water frontage and a minimum land area of 5 acres. The Town Comp Plan references only up to the old Class 3 system which would have a minimum density of 1 home per 40,000 square feet of land area and 200' of frontage. The Town Plan further goes on to state, "When and whether these areas should be rezoned to be consistent with the provisions of the Town of Sand Lake Comprehensive Plan is at the discretion of both the Town of Sand Lake and the Sawyer County Zoning Committee based on a inutually agreed upon decision." If the property was rezoned to RR- 1 the minimum lot sizes would be 100' of width of frontage and 200' of depth under the new shoreland zoning rules and most likely could "fit" 4 lots on Rogers Lake with a separate easement or wetland fill access road to additional upland area. In � conversations with the applicant the rezone is being requested in order to utilize the existing footprint of an existing cabin on this property that would be divided out on its own separate lot. A separate lot from where a new primary dwelling is currently under construction. The surrounding area is a mix of residential and forestry with only 1 other dwelling that has Rogers lake access. As we discussed the following are general comments regarding shoreland zoning as they relate to the requests. These comments relate to the requirements of the Sawyer County Zoning Shoreland-Wetland Protection Ordinance. Petit Rezone. The department supports the Sawyer County Zoning staff statement, "The Shoreland/Wetland District is not to be affected by the proposed rezone." A rezone from A-1 to RR-1 does not change the overlaying shoreland/wetland district and associated requirements. Grasee CUP. The department understands this request is far outside the ordinary high water mark(OHWM) setback and meets all shoreland zoning-related regulations. Thus the department has no comment on this request. Butterfield Rezone and CUP. Considering the noted isolated wetlands on the property in question the department recommends ensuring the applicant's operation meet applicable shoreland-wetland requirements, including remaining outside any wetlands and not creating discharge to any wetlands.
