Enclosed please review documentation, on-site inspection report dated 9-12-05,
tax parcel information, certified survey (CSM) #593 dated 9-15-74 and plat of survey

Our office received a complaint of a possible sewer encroachment onto DNR
land. The new sewer system was installed by A-1 Plumbing, Robert Vitcenda on May
20, 2005.
I called Mr. Neal Kephart, Chippewa Flowage Properiy Manager to make an on-
site property inspection on September 12, 2005, from 10:00 to 10:30 AM. Prior to our
inspection, I conducted a document research of the property. I discovered an older CSM
by surveyor Mr. Swanson dated 9-15-74, and a more recent "plat of survey" by surveyor
Mr. Mulock dated 7-24-02. Mr. Mulock shows a detail survey of building locations and
building encroachments.
Please refer to my inspection report. Mr. Kephart and i found the property line pin
to the southwest of the lakeshore cabin. It appeared that the new septic tank was
encroaching onto DNR land. Then we used thick line cord to run a straight line along the
property line to the encroaching two bedroom cabin. We used Mr. Mulock's detailed plat
of survey to confirm our property line location.
It appears that the septic/pump tank is approximately 3' over onto DNR land and
must be moved onto your property. Department of Commerce regulations require a 2'
setback from the property line.
Please consider this letter as an "Order for Correction". The tank must be moved
on or before August 1, 2006.
Please contact a plumber, get a sanitary reconnection permit, and have the
plumber move the tank and call our office for a final inspection. As the owner of the
property you are responsible to show the plumber the accurate property line locations.
While on the property, we looked at the encroaching buildings and other sewers
along the western property line. We did locate the northwest property line pin
approximately 31' from the northwest cabin.
Our encroachment observations are as follows:

#L The septic sewer that serves the upper two cabins encroaches onto DNR property
approximately 11'. I will allow it to stay as is until it fails,then the replacement must be
placed on your own property.
#2. The existing two bedroom cabin noted on both surveys encroaches onto DNR
property approximately 19'.
#3. The new 4" diameter PVC sewer pipe servicing the two bedroom cabin is on DNR
property.
#4. The 10'x10' shed encroaches approximately 19' onto DNR property. A smaller shed
(structure) by the 10'x10' shed also encroaches onto DNR property.

Mr. Kephart and I conducted a thorough inspection using general field techniques.

techniques only.

Dear Mr. Maki,
Enclosed please find a copy of an executed Land Use Agreement that�vas granted by the Wisconsin Department of
Natural Resources to Thomas and La Vonne Verway to resolve an encroachment of structures on Department lands
located on the Chippewa Flowage in Sawyer County.
The encroachment was documented by an on site inspection performed by you and myself on September 12, 2005
and followed by your"Order for Correction" letter on March 31, 2006.
After evaluating the options and discussing the situation with the Verways it was determined that a land use
agreemcnt was the best method to resolve this issue. In return for the land use agreement the Department was
granted a first right of refusal on the Verway property.
The Verways are allowed to use and maintain the existing facilities that encroach onto adjacent lands owned by the
State of Wisconsin DNR for single family residential uses currently permitted by the existing zoning ordinances of
Sawyer County, Wisconsin.

This agreement,made this 1�day of September,2006,by and between the State of Wisconsin Department of Natural Resources(Owner),and Tom and Bonnie Verway,
(Permittee),to enter upon artd use the following described land located,in Sawyer County,Wisconsin more particulariy described as foliows:
All that portion of the NE'/.,SE'/.,Section 30,T40N,R7W,occupied by structures owned by Permi�ee as shown on the attached survey dated July 24,2002,by Apex
Surveying and on the attached sketch drawn by Sawyer County Zoning Department dated September 12,2005. The location of the encroaching structures are shown on the
survey andlor drawing with approximate encroachment distances described as follows:two bedroom cabin and associated septic pipe encroaching 19'onto Owners properiy;
septic field servicing two upper cabins-encroaching 11';septic pump tank-encroaching 3'; 10 x 10'shed encroaching 19'.
The purpase of this land use agreemer�is to allow the use and maintenance of existing facilities owned by Permittee that encroach onto adjacent lands of the Owner. In order
to accomplish this purpose the Permittee intends to continue the use of the above mentioned items at their current IocaGon for single family residential uses currently permited
by the existing zoning o�dinances of Sawyer Counly,Wiswnsin.
This agreement shall be in efiect for a period commencing the 1�day of September,2006,and ending the 30"�day of August,2021,for a rental fee of$1.00.and other good
and valuable consideration,the receipt of which is hereby acknowledged by Owner. It is the intention of both parties to renew this agreement at the end of the 15 year period,
in order to continue Permittee's uninterrupted use and enjoyment of the encroaching structures for as long as those structures are deemed functional.
In consideration of Owners's willingness to grant fhis land use pertnit the Permittee�rees to grant the Department of Na#ural Resources a Right of First Refusal regarding any
offers made to purchase the property identified as lot 1 and Lot 2 CSM#i593. The terms of said Right of First Refusal are more particularty described in Sections 1 and 2 of this
agreement
It is understood by the Owner and the Permitiee that this agreement is subject to the followir�g conditions:
1. The Owner may terminate this agreement by written notice'rf the Permittee breaches any terms or candition contained in this agreement
2. Neither this agreement nor any right or duty in whole or in part by the Permittee under this agreement may be assigned,delegated or subcontracted without the written
consent of the Owner.
3 No cutting or trimming of trees shall be done unless approved by the Owner.
4. All signs,postings and other markers shall be approved by the Owner.
5. The Permittee shall maintain the area under fhis agreement in a safe and sanitary condfion at all times.
6. The Permittee agrees to save,keep harmless,defend and indemnify the Owner and all its officers,employees and agenis,against any and all liabiliiy claims,costs of
whatever kind and nature,for injury to or death of any person or persons,and for loss or damage to any property(state or other)9ccurring in connection with or in any
way incident io or arising out of the occupancy,use,service,operation or performance of work in connection with this agreement or omissions of Permittee's employees,
agenis or representatives.
7. The Permittee shall not permit grazing on the subject property.
6. This agreement dces not give the Permittee,its members or agenis,any rights pedaining to hunting,fishing,or trapping. These rights remain under the control of the
State of Wisconsin.
9. The Permittee shall not disturb or molest wildlife or wildlife habitat
10. This agreement,together with the reterenced parts and attachmenis,shall constihrte the entire agreement and previous communications or�reements pertaining to this
agreement are hereby superseded. Any contractual revisions induding cost adjustrnents and time extensions must be made by an amendment to this agreement or
other written documentation,signed by both parties at least 30 days prior to the ending date of this agreement
11. Additional conditions specifically pertinent to this agreed land use will be valid'rf enumerated in the space provided behveen this condition and dosing signature. Every

� 12. No expansion or substantial improvement of the existing structures is allowed beyond ordinary maintenance and repair. In the event of septic system failure,or damage

13. Use of the encroaching structures is limited to those uses permitted by the zoning ordinaces of Sauryer County,Wiscosnin and this Land Use Permit shall not be used by
Permittee as the basis for any future request to change zoning or land use regulations that afiect fhe use of the encroaching structures.

which to exe�cise its right to purchase said property. Except that if the Offer to Purchase by the third party folbws an attempt to seil the properiy to the Deparfment under �
