Notice is hereby given that on July 17, 2009 the Sawyer County Zoning Committee
approved the following application:
Part of the NE 1/4 NE 1/4, 528, T 38N, R 8W; Parcel 1.2. Doc# 360062. 5 acres
total. Property is zoned Agricultural One. Permit is desired for the construction of
a single family dwelling, owner not being engaged in agricultural activities. The
Town Board has approved the application.
The Sawyer County Zoning Committee approved the application as submitted.
Findings of Fact of the Zoning Committee: It would not be damaging to the rights of
others ar property values. It would not destroy prime agricultural lands. It would be
compatible with surrounding uses and the area.
The approval of the conditional use will expire on July 17, 2010, if application for the
actual permit to use/construct is not made by that date.
Any person or persons jointly aggrieved by the decision of the Zoning Committee may
commence an action with the Sawyer County Board of Appeals to review the decision in
whole or in part, within thirty (30) days of the date following the date of the signing of
this letter.

My name is Jesse Hoff. I along with my partner Peter McGee are leasing
the Smith Lake Pavilion with the intent to purchase at the end of our
lease. We are asking for a conditional use permit in order to put in an
outdoor patio for the bar. The new name of the bar is Tiki Pete's Beach
Bar. As you can tell from the name we are trying to create a one of a
kind atmosphere for the people in Hayward to come and enjoy. The
most important part of what we are trying to create is our outdoor
patio area. Our design calls for a 3,200sq.ft. patio which would put us at
1,350sq.ft. over allowable hard surface area. We understand why the
hard surface area is set at 15%when within 300' of a lake and we
respect that. Maintaining the integrity of the lake is of the utmost
concern of ours as well. We propose to drain tile the entire patio as
well as gutter the entire existing Pavilion and channel all the water into
a cistern. Which we will then use as the water for our irrigation system.
This will dramatically reduce the amount of run off that already exists
without the patio. It is Smith Lake itself which gives us the opportunity
to have this unique outdoor area, the last thing we would want to do is
cause any damage that may harm the lake, or the area around it.

Dear Mr. Hoff,
We would like to remind you that the conditional use public hearing approval for the
portion of your patio that brings the total impervious surface over 15% to 23%, which
was approved at public hearing on July 17, 2009, expires on July 17, 2010.
The Land Use Permit that was issued June 12, 2009 covered the first part of the
construction (1600 sq ft) that did not exceed the impervious surface limit of 15%. You
need to complete this permit process for the remainder of the patio.
If the application is not returned by July 17, 2010, it will be necessary to go through the
public hearing process again. The Sawyer County Zoning Office can issue citations,
including fines, if the construction is completed without the proper permits.

Dear Mrs. Schultz:
On July 17, 2009 the Sawyer County Zoning Committee approved an application for a
conditional use permit for the above property—"the construction of a 3,200 sq ft patio at
an existing bar/business, exceeding the allowable 5,850 sq ft of impervious surface by
1,350 sq ft to a total of 23% (by the purchaser)." A condition of approval was that"Any
further paving would require filing for the appropriate public hearing (conditional use or
variance)."
The purpose of this letter is to clarify that should you not take advantage of this CUP that
the parking lot could be paved without the prior issue of a permit by this office. Of
course you must take every precaution to ensure that any run-off/sedimentation resulting
from paving the parking lot remains on your property and shall not adversely affect other
properties or the lake.

It is my understanding that the proprietor of Tiki Petes intends to improve che existing site and provide water treatment forthe
runoff generated on the1.01 acre site.l disclose that I am licensed professional engineer(in the State of MN,not WI)and I am
familiar and experienced providing design5 fegarding water resources engineering.
The previous conditlon of[he site allowed concenirated runoff to o[cur from the rooftop of the building.The drainage patterns
ofthe lot are generally towards Smith Lake.Jesse Hoff intends to install a patio with an area ot o.D7 acres,or3200 square feet
�sf).This area previously contained packed gravef and lawn area,in addition to a large rubbish pile.To further improve the
runoff conditions,Jesse Hoff intends to install rain gutters that will capture the roof drainage and direc[i[into a rain garden
(approximately 1200 sfj.
At completion,the proposed site will contain a patio area that is sloped towards the perimeter where it will enter a subgrade
draintile that surrounds the patlo area.This drain-tile will direct mnaff into a small rain garden,where it will collect.Certain
large storm events will cause the drainage to overtop the garden and travel over a rip-rapped overflow wtlet.However,for the
majority of rain eventr,the patio and roof runoff will infiltrete into the rain garden,increasing water quality for ihe surrounding
area.The rain garden will be constructed using native species induding Canada Anemone,Purple Dome Aster,Great Blue
Lobelia and other native plantings surrounded by a wood mulch.The plantings are chosen based on aes[hetics,but mamly for
their ability to en[ou rage infiltration into the groundwater 5V5tem.
The proposed site generates a lower peakflow rate of runoff than the existing condition.For example,during a significant
storm(2.7"rainfall event)the ezisting conditions produce a peak runoff rate of 1.4 cubic feet per second(cfs),while the rate
forthe pmposed site is only 13 cfs.The difference is due to the waterthat infiltrates Into the ground.The proposed rein
garden provides filtration that wasn't provided by the former site,and is constructed In the vicinity of the large rubbish pile that
was removed.The provided sketch is a conceptual drawing of the propased conditions based on mul[iple dlsassions with Jesse
Hoff.

Re: Conditional Use Application—Public Hearing Notice
Deaz Mr. and Mrs. Schultz;
Your application for a Conditional Use will be considered at a Public Hearing before the
Sawyer County Zoning Committee on July 17, 2009.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the application may result in uruiecessary delay of a decision. F�ilure to
appear may also result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement in
care of this office directed to James Bassett, the Chairman of the Zoning Committee. This
statement should include your proposed intentions, the purpose of the request, and a
description of the general terrain and surrounding development. Photographs of the
property and surrounding area is encouraged. Indicate how the proposed use would not
be contrary to the public interest, et cetera.
