Notice is hereby given that on Tuesday,December 21,2010 the Sawyer County Zoning Board of
Appeals approved the application for variance for the following proposal:
Town of Round Lake—John Maher et ux.Lot 4,being part of the SW 1/4 NE 1/4,S3Q T 41N,
R 7W;Parcel 1305. Doc. #301824;CSM Volume 6 page 271, Volume 7 page 154. 0.48 acres
total. Property is zoned ResidentiaVRecreational One. AppGcation is for the construction of a 2
caz gazage 24'x 24'(26'x 26'with eaves)at a setback distance of 15'to the centerline of a pri-
vate access easement. Variance is requested as Section 4.21(6), Sawyer County Zoning Ordi-
nance, would require a minimum setback distance of 30 feet from the centerline of this road
easement.The Town Board denied the application with additional comments.
The Board approved the application for a garage with a maaimum size of 26' a 26' and
with a maaimum height of 14'6".Approval also contingent upon the relocation of the small
7'z T shed located near the water(Zoning staff to check for compliance in the spring)and
a two year time limit has been placed oo the approval for the procurement of a land use
permit.
Findings of Fact of the Board of Appeals:There would be no change in use in the zone district;it
would not be damaging to the rights of others or property values;it would be due to special con-
ditions unique to the proper[y.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of tlris notice.

Part 2: Three-Step Test.
To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. This is known as the "three-step test."
1) Unique Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) aze not a factor in deciding variances. Neazby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Boazd do not provide a basis for granting a variance.
Do unique physical characteristics of your pcoperty prevent compliance with
the ordinance?
�Yes. Where are they located on your property? Please show the
boundaries of these features on the site map that you used to describe
alternatives considered.
(e.g., "There is a wetland area that extends around one side of the house

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1)Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) naturai scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this variance would not harm the public interests
or how it may even enhance the public interests.

3) Unnecessary Hardship.
An applicant may not claim hazdship because of conditions which are self-
imposed or created by a prior owner(for example, excavating a pond on a
vacant lot and then azguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather thanjust a portion of the pazcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
azea variance, unnecessary hardship exists when compliance would
unreasonably prevent the owner from usinQ the vropertv for a permitted
purpose or would render conformitv with such restrictions unnecessarily
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs againsC the limitations full compliance
would impose on use of the property.

The seller, John Mayer, obtained the variance. It has been suggested that
we write a letter to the Board of Appeals stating that we as the purchasers agree
with the application for the variance signed by the seller John Maher, and so, we
are doing so. We agree acknowledge and agree with the variance application of
the previous owner John Mayer. We understand that the variance runs with the
land and that we as the current owners receive the bene�t of the variance.

I have been asked to give an opinion regarding the approval of the variance given to John Maher,
even though he was not the property owner at the time of the approval.
It is my understanding that Mr. Maher was the owner of the subject property at the time the
application for variance was filed, but sold said property prior to the approval. This is a unique
situation but my thought would be to require a letter addressed to the Board of Appeals from the
current owner acknowledging and agreeing with the variance application of the previous owner.
With that letter in hand I would say that the variance should be issued to the applicant. As the
variance runs with the land the current owner receives the benefit of the variance. This is a
common sense solution that avoids the necessity of holding another hearing with the same facts,
only a different owner.
Under Section 5.0 Application and Appeal Procedures under 5.7 the variance application must be
signed by the owner or be acknowledged in letter form by the owner. In the present case the
owner "at the time" did sign the application. I think by adding the acknowledgment letter we can
back up the decision to issue the permit.

Part of the contingency of the offer to purchase was "contingent upon seller
providing at seller's expense proof of Zoning Variance granted to build a two car
garage on the property.This offer is further contingent on Buyers acceptance of
variance and its dates and deadlines for completion of construction."
Closing to be no later than November 19, 2010
October 22, 2010- I(Dustin Beckwith-agent of seller) contacted Jay Kozlowski to
set up an appointment to meet at property for marking proposed garage location.
I was informed that earliest appointment available was Nov. 1, 2010 at 9:30 am.
November 1, 2010-Appointment with Jay K. at property and described where
potential garage would be.
November 3, 2010- I received the Sawyer County Zoning Administration
Inspection Report showing details and setbacks for garage
November 5, 2010-Submitted Variance application to Zoning with payment of
$350.00
Week of Nov. 15`h-19`h- Buyers(Darst) wanted to move forward with closing on
November 19`h.
Dustin Beckwith(agent of seller) informed Buyers agent(Bobbi Huot)that
meetings for variance with Round Lake Commission/Board was not until
December 8-9, 2010 and Sawyer County Board of Appeals until Dec. 21, 2010.
Buyer still moved forward with dosing.
November 19, 2010- Closing of property at 10346N Pheasant Lane, Hayward
December 8, 2010 - Attended RL Town's Plan Commission with Buyers
Agent(Bobbi Huot) in attendance. Presented variance application to Round Lake
Planning Commission. Planning Commission decided to "table" the application
because application was not in current owner's name.
December 16, 2010 - Found out that the variance application was "denied" by the
Round Lake Town Board because of:

The BOA approved a variance contingent on your approval. The short story is applicant owner applied for a
garage at a reduced road setback. Decided to sell property "contingent"on variance. New owner purchased
property. Still wants garage. Town Board denied because the owner wasn't the applicant.
I think the decision will hold, but the new owner will have to apply with $350 fee. I also don't think we should
return the prior applicanYs fee (the realtor said he paid it out of his pocket).

Dear Mr. and Mrs. Maher;
Your appGcation for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on: Friday, December 17, 2010.
This hearing will begin at 7:00 P.M. at the Sawyer County Courthouse, 10610 Main,
Hayward, WI 54843. It is recommended that either you or a representative be present at
the Hearing. A lack of information about the situation may result in unnecessary delay of
a decision. Failure to appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Alan Gerber, Chairman of the Board of Appeals. This statement
should include a description of the general tenain; surrounding development; your
proposed intentions; and the purpose of the request. Photographs of the property and/or
buildings are requested. Explain the undue zoning hazdship inflicted upon the owner by
confornung to the required minimum regulation, which induced the variance request.
Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will also go before the Town Board. Some townships also have a
