amended your application for variance for the following proposal:

cel-4.6.2.Application is for the construction of a 30'x 34'addition with loft storage area,onto
an existing non-confoaning detached gazage that is located 31'6"to the centerline of Peninsula
Road(a Town road). The proposed addition will be located 31'to the centerline of the road and
will replace an existing 15'x 21'garage located 29'from the centerline of the road. Variance is
requested as Section 4.21,Sawyer County Zoning Ordinance,would require that the addition be
located at least 63'from the centerline of the road and Section 10.2 would require that the con-
struction cost of the proposed addition not exceed 50%of the current estimated fair mazket value
of the existing garage.The Town Board has approved the application with additional comments.
On October 19,2010 the Board of Appeals approved the application with the jo[lowing restric-
tions:1)addition to not exceed 30'x 34';2)no second story;3)height not to erceed a 4/12
pitch;4)a two year time limit to procure a land use permit
At the November 16,2010 Public Hearing,a request for a clari,fication was made regarding
the pitch of the roof. The Board of Appeals amended the application regarding the 4/12 pitch
and instead restricted the height af the siructure not to exceed 16 feet All other restrictions
placed on the approval of the October 19,2010 hearing still apply.
Any person or persons jointly aggrieved by this decision of the Boazd of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision wittwi
30 days after the date of this notice.

Notice is hereby given that on Tuesday, October 19, 2010 the Sawyer County Zoning Board of
Appeals approved the application for variance with restrictions for the following proposal:
Town of Hayward —Robert L. Brueggeman et ux. The W 1/2 of Lot 6, Round Lake Park Subdi-
vision. 523, T41N, R 8W; Parcel -4.62. WD Volume 519 Records page 421. 0.77 acres. Prop-
erty is zoned ResidentiaURecreational One. Application is for the construction of a 30' x 34' addi-
tion with loft storage area, onto an existing non-confornung detached garage that is located 31'6"
to the centerline of Peninsula Road (a Town Road). The proposed addition will be ]ocated 31' to
the centerline of the road and will replace an e�cisting 1 S x 21' garage bcated 29' from the cen-
terline of the road. Variance is requested as Section 421, Sawyer County Zoning Ordinance,
would require that the addition be located at least 63' from the centerline of the road and Section
102 would require that the construction cost of the proposed addition not exceed 50% of the
current estimated fair market value of the existing garage. The Town Board has approved the ap-
plication with additional comments.
The Board of Appeals approved the variance with the following restrictions: 1) addition
not to eaceed 30 ft a 34 ft; 2) no second story; 3) height not to exceed a 4/12 pitch; 4) a two
year time limit has been placed to procure a land use permit
Findings of Fact of the Boazd of Appeals: It would be due to special conditions unique to the
property; it would not be damaging to the rights of others or property values; there would be no
change in use in the zone district.

To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. Tl:is is known as the "t/:ree-step test."
1) Unique Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violaYions, prior vaziances or lack of objections from neigbbors or
the Town Board do not provide a basis for granting a variance.
Do unique physical characteristics of your property prevent compliance with
the ordinance?
❑ Yes. Where are they located on your property? Please show the
boundaries of these features on the site map that you used to describe
alternatives considered.
(e.g., "There is a wetland area that extends around one side of the house
and also behind the house.").
❑ No. A variance cannot be granted.
2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this variance would not harm the public interests
or how it may even enhance the public interests.
3) Unnecessary Hardship.
An applicant may not claim hazdship because of conditions which aze self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot azea, or height. For an
area variance, unnecessary hardship exists when compliance would
unreasonablv prevent the owner from using the propertv for a permitted
puroose or would render conformitv with such restrictions unnecessarilv
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on
October 19, 2010
This hearing will begin at 7:00 P.M., in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Alan Gerber, Chairman of the Board of Appeals. This statement
should include a description of the general terrain; surrounding development; your
proposed intentions; and the purpose of the request. Photographs of the property and/or
buildings are requested. Explain the undue zoning hardship inflicted upon the owner by
conforming to the required minimum regulation, which induced the variance request.
Convenience and financial loss or gain does not constitute zoning hardship.
Your application will come before the Town Board for their review. Some townships
also have a Planning Commission. Please contact the Hayward Town Clerk, Shannon

confirm the date of the Planning Commission and Town Board meetings for your
attendance or the attendance of your agent.
