My person or persons jointly aggrieved by the decision of the Zoning Committee may
appeal the decision to the Sawyer County Board of Appeals to review the legality of the
decision within 30 days after the date of this notice.

Dear Mr.Miller:
Enclosed you wili find the Inspection Reports and Notices of Non-Compliance for the two projects for which
Mr.John Knight started prior to the issuance of Wisconsin Uniform Building Permits in the Town of
Weirgor in Sawyer County.Our Inspector has written orders showing the two projects have been
abandoned as required by Supplemental Order#27 given to the Inspection Agencies when the contracts
were issued.It should be noted,abandoned projects may be reinstated upon submission of a Wisconsin
Uniform Building Permit Application and documentation showing compliance with all the requirements of s.
COMM 20.09 and s.COMM 21.33.
As required by Supplemental Order# 27,Wisconsin Uniform Building Permit Applications have been
forwarded to the Division of Safety and Buildings highlighting the fees retained for both projects for which
Wisconsin Uniform Building Permits should have been issued before any on-site work, including bringing
soil onto the site which required soil erosion control measures to be installed. Permit fee increases are non
refundable.
We have also received documentation from the Sawyer County Zoning Department stating both of the
sites for which dwellings will be built on are in a Flood-plain and therefore subject to all the requirements
of s. COMM 21.33.The owner/permit applicant failed to inform this Inspection Agency that the dwellings
were being built in a flood-plain, in any event Mr. Knight has met compliance with s.COMM 21.33(3)for
the one project. He will also need to show compliance with s.COMM 21.33(3)before Sawyer County will
issue a zoning permit for any future projects in the flood-plain.As you aware,we are required by contract
to foster interagency cooperation with the various entities we interact with.Therefore we do not issue UDC
building permits until all state and local permits have been issued.The owner/permit applicant has been
issued a privy permit by Sawyer County for one project.Via this letter we like to remind the owner/permit
applicant there may be additional requirements by other state agencies,as well as federai requirements
for building in a flood-plain.
The permit applicant's appeal rights are highlighted in the Inspection Reports and Notices of Non-
Compliance.We have also enclosed the disapproved plan review documentation and the documentation
forwarded by Sawyer County for your review. Pictures have been taken of both projects and are available
upon request.The disapproved plan review documentation has been previously forwarded to the owner,
along with Wisconsin Uniform Building Permit Applications that may be submitted to reinstate these
projects.

Dear Mr. Knight,
I measured the ground elevations on the gravel building pads on Lot 5, CSM 6177 in Section 35, T38N, R7W
and Lot 10, CSM 3408 in Section 2, T37N,R7W. The elevations are referenced to the National Geodetic
Survey Vertical Control Monument L 147. The published elevation of L 147 is 1220.51 feet, based on vertical
datum NAVD 88. The elevation of L 147 converted to the NGVD 29 datum is 1220.58 feet. The FEMA
Regional Flood Elevation maps are based on the NGVD 29 datum. The FEMA flood elevation downstream of
the Litke Road bridge is 1189 feet. Litke Road is about 1200 feet upstream of the lots.
The ground elevations on the comers of the gravel building pad on Lot 5, CSM 6117 aze:
1190.3 feet
1190.3 feet

The center of the building pad is ll 899 feet.
I found a 60d spike in a 16" maple on Lot 5 for a benchmazk. The elevation of the spike is 1190.5 feet.
The ground elevations on the corners of the gravel building pad on Lot 10, CSM 3408 are:

The center of the building pad is 1190.1 feet.'
I found a 60d spike in a 16"white oak on Lot 10 for a benchmark. The elevation of the spike is 1190.2 feet.
I also checked the ground elevations on a cleazed building site on Lot 6, CSM 6117. There is no gravel
building pad at this time. The elevations of the corners of the staked building are:

John,
We have started doing research on the parcels of property that you wish to build on and have
discovered that they are located in the flood fringe area.
Your next step is to have a surveyor locate the elevation on the corners of the building which
includes the 15 feet beyond the limits of the structure overhangs. Once established, the surveyor
must provide us with a plot plan or letter indicating the elevation. Also on the Weirgor property
you have shown 70 feet from the ordinary high water mark and you must be 75 feet from the
ordinary high water mark. I have enclosed a list of Local Wisconsin Registered Surveyors for
your convenience.

Dear Mr.Christman:
I measured ground elevations on the above parcel to determine if there is a building site above the regional flood elevation
of the Brunet River. Mr.Dan Zigmund asked me to send you this letter so that you could determine if the building site is
above the flood elevation. I took three elevations across the proposed building site as shown to me by Sheldon Petit. The
elevations were as follows: 1307.6 feet
1309.1 feet
1311.7 feet
I established a benchmark which is a 60d spike in the east face of a 8"aspen on the north side of the building site. The
elevation of the spike is 13]5.5 feet.
The elevations are based on B.M.1068-B,which is a bronze tablet set in the top of the center downstream pier of the Lake
Winter Dam. The published elevation is 1320.75 feet MSL.

Dear Mr. Lein:
I measured ground elevations on your lot on the cleared building site. The elevations are on the top of the
ground on the cleared and leveled azea. The elevations are based on National Geodetic Survey Monument
X 41, PID QN0185. The published elevation on the monument is 1244.23 feet based on NAVD 88 Datum.
The NGVD 29 Datum height is 1244.32 feet.
The 100 year Flood Elevation of the Chippewa River on the Radisson Flowage is approximately 1229 feet near
the bridge downstream of the building site. This elevation is shown on the Flood Insurance Rate Map,
Communiiy Panel Number 550591 0215 B, dated September 14, 1990. A copy of the data was provided to me
by Sawyer County Zoning.
The NGVD 29 elevations on the building area are: NW corner 1234.9 feet
SW corner 1234.7 feet
SE corner 1235.1 feet
NE corner 1235.4 feet
I set benchmarks on the site: Spike in the north face of a 6" aspen, elevation = 1235.0 feet.
Spike in the west face of a 9" white birch, elevation = 1236.8.0 feet.

Re: DOT Regional Flood Elevation(RFE) Information—Barker Lake Road Bridge
Deax Mr. Love:
I was able to obtain RFE information for the Barker Lake Road bridge from the DOT. It
appears that the RFE was determined to be 1330.16' as referenced to two benchmarks
(BM1 and BM2 indicated on the General Plan diagram. Your next step is to have a
surveyor locate the benchmarks and then establish the RFE on your property. Once
established,the surveyor must provide me with a plot plan or letter indicating the
elevation of the crawlspace floor with respect to the RFE. Hopefully,the crawlspace
floor will be above the RFE.

Letter of Map Revision Based on Fill (LOMR-F, may be filed. Applicants should be
informed that they must meet the requirements of s. NR 116.18,Wis. Admin. Code as
well as 44 CFR 65.5. Specifically, no property may be removed from the flood fringe
unless technical data regarding the proposed development's effect on flood heights has
been submitted and approved, the structure is placed on fill to the flood protection
ele�Tation, the area filled extends at least 15 feet beyond the limits of the structure, and the
property has dryland access. Contact the DNR Regional office for detailed information.
Step 3 For projects in the flood fringe, determine the project's use and if it is a new structure or
an addition/modification.
— If it is a prohibited use, then deny the permit application.
— If it is a permitted use, then issue the permit after ensuring it complies with the following
standards for the Elood zone [s. NR 116.13 (1), Wis. Admin. Code] as well as any other
applicable standards:
• compatible with local land use plans or if no such plan has been adopted, with
permitted uses in adjoining districts;
• doe� not cause an obstruction to flood flows of any drainage systems to the
tributary; and
• does not affect the conveyance capacity of a stream system such that it causes a rise
in regional flood heights or discharges.
— If it is a nonconforming use or structure, then go to Step 4.
— If the applicant does not agree with the determination of the local official, then an appeal
may be filed with the local Board of Adjustment/Appeals.
— If the applicant wishes to remove the property from the determined flood zone, then a
Letter of Map Revision Based on Fill (LOMR-F� may be filed. Applicants should be

the addition.
— If the cost of the project is equal to or more than 50% of the current equalized assessed

Dear Mr.Keller:
A residence may be constructed in a floodplain area if it conforms to the requirements of
the Sawyer County Floodplain Zoning Ordinance.I am enclosing Section 43-
STANDARDS FOR DEVELOPMENT IN FLOODFRINGE AREAS,Sawyer County
Floodplain Zoning Ordinance,which details the location/elevation requirements of a
residence location.Basically,the]owest floor of the residence must be located a
minimum oftwo feet above the regional(100 yeaz)flood elevation.A driveway must also
be located above the regional flood elevation to provide emergency dryland
ingress/egress for local residents in case of a flood.
The process for the construction of the dwelling/driveway will be as follows.
♦ The property owner submits an Application for Land Use Permit for the
construction of a dwelling and driveway to the Zoning Office.FEMA Flood
Insurance Rate Maps are reviewed to determine if the proposed activities will
occur within a floodplain.The application will be denied if the activities are
within the floodplain boundaries.
♦ Ii tne appiication is denied,a letter of denizl is sent:o?he applicant with a
copy forwarded to Frank Dallem,DNR Water Regulation and Zoning
Engineer(715)635-4064).
♦ Mr.Dallem will decide what information will be required to make the
determination of the regional flood elevation.Mr.Dallem's request for
information is passed through the Zoning Office to the applicant.
♦ The applicant hires a Certified Land Surveyor to provide the requested
information.
♦ The information is then forwarded through the Zoning Office to Mr.Dallem.
♦ Mr.Dallem uses a modeling program to determine the regional flood
elevation.
' ♦ The regional flood elevation information is forwarded through the Zoning
Office to the applicant who can then have the Land Surveyor locate this
elevation at the building/driveway site.
♦ The Land Use Permit will be issued after it has been determined that all
activities will be in accordance with the elevation xequirements of the
Ploodplain Ordinance.
This entire process can take 90 days or longer and this delay should be planned for as a
part of the construction process.
The short answer to your questions is that the driveway and residence may be constructed
if the requirements of the Floodplain Ordinance are met.

Mr. Keller purchased the property on July 31, 1998. Prior to purchasing the property, Mr. Keller
worked with you and the Sawyer County Zoning Department to determine whether or not
improvements could be constructed on the property given the fact that portions of the property
were within flood plain districts. Based upon work done by your office in determining
elevations, Mr. Keller was advised by the Sawyer County Zoning Office that the property was
buildable. Relying upon the elevations established by you, Mr. Keller completed the closing and
spent approximately$15,000 in constructing an access road into the property. Further, in
reliance upon the elevations determined by your company, Mr. Keller bought adjacent land to
develop.
It has recently come to Mr. Keller's attention that the elevations set by you in 1998 are inconect,
and that the property purchased by Mr. Keller on July 31, 1998 is not buildable, nor is the
property which he subsequently purchased buildable.
As the result of the errors made by your company in doing the ]998 survey work, Mr. Keller has
been damaged. His damages include, but are not limited to the diminution in value of the
property due to the parcels not being buildable and the improvement costs which he incurred in
developing the property into what he believed were to be buildable lots. As indicated above, Mr.
Keller has expended approximately $15,000 solely for road wark. �

to discuss the matter. Before proceeding with any claim against Mr. Mulock, we want to be sure
that his work was incorrect and it was that incorrect which lead to the zoning office indicating to

We were hired by Loren Keller to survey and divide his lands in Govemment Lot 4, Section 35, T38N-
R7W, which we did.
We also ran relative elevation of the property basecf upon bridge work done upstream designed by
Engineer Firm Ayers 8� Associates for the Wisconsin Department of Transportation, from whom we got a
bench maric from, field work 1991.
I will emphasize we were not hired to determine the regional flood elevation.
For your information, if you were not aware, the regional flood elevation of the Chippewa River at Keller's
property had not been established in 1998, nor to the best of my knowledge, it still has not been
established.
Kellers property is located about a quarter mile down stream €rom where the last hydrology studies were
done by FEMA to establish the regional flood etevation.
Dan Pleoger purportedly did a survey, which bears out my results in the elevation differentiaf exactly. I
have not seen a copy of Pleoger's survey, only a letter dated October 20, 2003. It appears Pleoger did
not recover any elevation reference marks used by FEMA for the regional flood study.
In addition, Pleoger's letter does not mention anything about regional flood elevation of the site.
The resolution of this matter for Keller is to hire an engineering firm to do the hydraulic and hydrology
studies to determine the regional flood elevation.

I measured the ground elevations on your cleazed building sites in Section 35,T38N,R7W and Section 2,
T37N,R7W. The elevations aze referenced to the National Geodetic Survey Vertical Control Monument L 147.
The published elevation of L 147 is 1220.51 feet,based on vertical datum NAVD 88. The elevation of L 149
converted to the NGVD 29 datum is 1220.58 feet. The FEMA Regional Flood Elevation maps aze based on the
NGVD 29 datum. The FEMA flood elevation downstream of the Litke Road bridge is ll 89 feet.

I also checked the elevation of the bridge deck across the Chippewa River at Litke Road. The elevation is
1200.0 feet. Please note that the 1991 bridge plan by Owen Ayres and Associates lists the elevation of the
bridge deck at about 1203 feet. Ayres'elevations are based on a spot elevation at the center of Litke Road and
STH 40 and aze not referenced to NGVD 29.
