COMM 20.09 and s.COMM 21.33. As required by Supplemental Order# 27,Wisconsin Uniform Building Permit Applications have been forwarded to the Division of Safety and Buildings highlighting the fees retained for both projects for which Wisconsin Uniform Building Permits should have been issued before any on-site work, including bringing soil onto the site which required soil erosion control measures to be installed. Permit fee increases are non refundable. We have also received documentation from the Sawyer County Zoning Department stating both of the sites for which dwellings will be built on are in a Flood-plain and therefore subject to all the requirements of s. COMM 21.33.The owner/permit applicant failed to inform this Inspection Agency that the dwellings were being built in a flood-plain, in any event Mr. Knight has met compliance with s.COMM 21.33(3)for the one project. He will also need to show compliance with s.COMM 21.33(3)before Sawyer County will issue a zoning permit for any future projects in the flood-plain.As you aware,we are required by contract to foster interagency cooperation with the various entities we interact with.Therefore we do not issue UDC building permits until all state and local permits have been issued.The owner/permit applicant has been issued a privy permit by Sawyer County for one project.Via this letter we like to remind the owner/permit applicant there may be additional requirements by other state agencies,as well as federai requirements for building in a flood-plain. The permit applicant's appeal rights are highlighted in the Inspection Reports and Notices of Non- Compliance.We have also enclosed the disapproved plan review documentation and the documentation forwarded by Sawyer County for your review. The elevations are referenced to the National Geodetic Survey Vertical Control Monument L 147. The published elevation of L 147 is 1220.51 feet, based on vertical datum NAVD 88. The elevation of L 147 converted to the NGVD 29 datum is 1220.58 feet. The FEMA Regional Flood Elevation maps are based on the NGVD 29 datum. The FEMA flood elevation downstream of the Litke Road bridge is 1189 feet. Litke Road is about 1200 feet upstream of the lots. The ground elevations on the comers of the gravel building pad on Lot 5, CSM 6117 aze: 1190.3 feet 1190.3 feet 1189.2 feeY 1189.4 feet The center of the building pad is ll 899 feet. I found a 60d spike in a 16" maple on Lot 5 for a benchmazk. The elevation of the spike is 1190.5 feet. The ground elevations on the corners of the gravel building pad on Lot 10, CSM 3408 are: ll90.�feet ll 90.2 feet 1190.1 feet 1190.0 feet The center of the building pad is 1190.1 feet.' I found a 60d spike in a 16"white oak on Lot 10 for a benchmark. The elevation of the spike is 1190.2 feet. I also checked the ground elevations on a cleazed building site on Lot 6, CSM 6117. Your next step is to have a surveyor locate the elevation on the corners of the building which includes the 15 feet beyond the limits of the structure overhangs. Once established, the surveyor must provide us with a plot plan or letter indicating the elevation. Also on the Weirgor property you have shown 70 feet from the ordinary high water mark and you must be 75 feet from the ordinary high water mark. The elevation of the spike is 13]5.5 feet. The elevations are based on B.M.1068-B,which is a bronze tablet set in the top of the center downstream pier of the Lake Winter Dam. It appears that the RFE was determined to be 1330.16' as referenced to two benchmarks (BM1 and BM2 indicated on the General Plan diagram. Your next step is to have a surveyor locate the benchmarks and then establish the RFE on your property. Once established,the surveyor must provide me with a plot plan or letter indicating the elevation of the crawlspace floor with respect to the RFE. This entire process can take 90 days or longer and this delay should be planned for as a part of the construction process. Mr. Keller purchased the property on July 31, 1998. Prior to purchasing the property, Mr. Keller worked with you and the Sawyer County Zoning Department to determine whether or not improvements could be constructed on the property given the fact that portions of the property were within flood plain districts. Based upon work done by your office in determining elevations, Mr. Keller was advised by the Sawyer County Zoning Office that the property was buildable. Relying upon the elevations established by you, Mr. Keller completed the closing and spent approximately$15,000 in constructing an access road into the property. Further, in reliance upon the elevations determined by your company, Mr. Keller bought adjacent land to develop. It has recently come to Mr. Keller's attention that the elevations set by you in 1998 are inconect, and that the property purchased by Mr. Keller on July 31, 1998 is not buildable, nor is the property which he subsequently purchased buildable. As the result of the errors made by your company in doing the ]998 survey work, Mr. Keller has been damaged.
