Notice is hereby given that on Tuesday,November 15,2011 the Sawyer County Zoning Boazd of
Appeals approved your application for variance with conditions for the following proposal:
Part of Godt lot 3,526,T 40N,R 9W;Parcel 5303. 18 acres total.Property is zoned Residen-
tiaURecreational One. Applicarion is for the construction of a fiill(8')hand dug basement under
an existing 26'x 24'dwelling.The basement would not extend under the porch azea.The e�cist-
ing porch area is located 22'from the ordinary high water mark of Grindstone Lake.The pro-
posed basement would be 24'at the closest point to the ordinary high water mark.Variance is
requested as Section 4.421(2)(a)(1),Sawyer County Zoning Ordinance,would require the prior
granting of a variance for a new basement on a non-conforming principal structure located closer
than 40'to the ordinary high water mark of the lake.
The Board approved your variance with the following conditions:1)Access to basement only
at reaz(north side)2)material extracted from site to be removed on a daily basis;3)basement
addition not to exceed 8 feet or 12 courses of block;4)Top of slab to top of peak not to exceed
24 feet(no second story);5)A plan for storm water run off shall be approved by Zoning&Con-
servation;6)A plan to prevent erosion control shall be approved by Zoning&Conservation;7)
Mitigation shall be conduc[ed;8)No part of the structure shall be cioser to the lake than it cur-
rently is;9)A two yeaz time limit to procure a land use pernvt.
Findings of Fact of the Board of Appeals:It is not contrary to others;there is no change is use in
the zone district and it is due to special conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.

3) Unnecessary Hardshi�.
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
area variance, unnecessary hardship exists when compliance would
unreasonabl�prevent the owner from usin�the propert f�permitted
purpose or would render conformity with such restrictions unnecessarily
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the

To qualify for your requested variance, you must e`Q�t�Tate that your proper meets '
the following three requirements. This is known as the "tl:ree-step test."
1) Unique Property Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.

This hearing will begin at 7:00 P.M, at t6e Sawyer County Courthouse, 10610 Main,
