Application is for the construction of a 6' x 8' addition onto an existing non-conforming structure withy an attached deck that is located 29'to the ordinary high water mark of Round Lake. The proposed addition would also be increasing the non-conformity to the side lot fine setback. The curcent dwelling is located 4.53'to the side lot line.(Applicant has also applied for a Zoning Committee variance to purchase additional area from a non-conforming adjacent lot.)Variance is requested as Section 4.421(2)(a),Sawyer County Zoning Ordinance, would require the prior ganting of a variance for any expansion of a dwelling located closer than 40'to the ordinary high water mark of the lake. And Section 4.417(1),and Section 18.Q Dimensional Requirements states that a primary dwelling shall be located no closer than 10'on one side lot line and at least 30'from the other side lot line. The Town Board approved the application with additional comments. 1'he Zoning Committee variance for lot line relocation has been approved at the July 15'"Public Hearing Conditions placed on the approval are as follows:a 6'a 8'addition is allowed on the back side of the cabin; A land use permit is required; an approved mitigation plan by Sawyer County Land &Water Conservation shall be required; a strip of land no less than 6' in width shall be purchased from the adjoining property owner(Andersen)resulting in a side lot line setback of 10'or greater from the Kettwig cabin eave overhang;a certified survey map shall be recorded of the strip of land purchased; a two(2)year time limit to procure a land use permit Findings of Fact of the Board of Appeals: It would be due to special conditions unique to the property;it would not be the basis of economic gain;it would not be a self created hardship and there would be no change in use in the zone district. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice. To qualify for your requested variance, you must demonstrate that your property meets the following three requirements. This is known as the `Yhree-step test." 1) Uniaue Prooertv Limitations. Unique physical limitations of the property such as steep slopes or wetlands that are not generally shared by other properties must prevent compliance with ordinance requirements. The circumstances of an applicant (growing family, need for a larger garage etc.) aze not a factor in deciding variances. Nearby ordinance violations, prior variances or lack of objections from neighbors or the Town Board do not provide a basis for granting a variance. Do unique physical characteristics of your property prevent compliance with the ordinance? Yes. Where are they located on your property? Please show the boundaries of these features on the site map ihat you used to describe alternatives considered. (e.g., "There is a wetland area that extends azound one side of the house and also behind the house."). "n S+-I.i c;M- J d-p,i z,tee,-, .Pi n Gi v d 5 i --a l .wu Uv i,Vl'Pno,., A 1lQf Lc.AIC.. ❑ No. A variance cannot be granted. 2) No Harm to Public Interests. A variance may not be granted which results in harm to public interests. In applying this test, the Boazd of Appeals must consider impacts of your proposal and the cumulative impacts of similar projects on the interests of the neighbors and the entire community. Some, but not necessarily all of these considerations are: (1) Public health, safety and welfare, (2) water quality, (3) fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of property damages and (6) achievement of eventual compliance for nonconforming uses, structures and lots. Explain how the granting of this variance would not harm the public interests ! [ Jor how it mra even enhance the public interests. , 1 1 - L 1 v r.VEYSG L ktc C/Y I-C..o. C4 1 Ui n „7 f G ,1 2 o r f i S Q.i riY , l, I 'h 0''^ l'J v ov-Q R l3 e V i S o r , S y I-e a9 S 1-e 1"`°1'd-- `,y 0 ' `,`,Q/ ' , 3) Unnecessary Hazdship. An applicant may not claim hazdship because of conditions which aze self- imposed or created by a prior ownec (for example, excavating a pond on a vacant lot and then arguing that there is no suitable location for a home.). Courts have also determined that economic or financial hazdship does not justify a variance. When determining whether unnecessary hardship exists, the property as a whole is considered rather than just a portion of the pazcel. You are applying for an "area variance.' An area variance relaxes a dimensional standazd such as a setback, frontage, lot area, or height. For an area variance, unnecessary hardship exists when compliance would unreasonablv prevent the owner from usin¢ the propertv for a permitted purpose or would render conformitv with such restrictions unnecessarilv burdensome. The importance of the public purposes of the ordinance, the degree to which the restriction supports those purposes and the extent of the relaxation of the restriction are weighs against the limitations full compliance would impose on use of the property. Is unnecessary hardship present? ] Yes.
