Notice is hereby given that on Tuesday,April 19,2011 the Sawyer County Zoning Board of
Appeals approved application for variance with conditions for the following proposal:
Town of Hayward—Thomas Connell et ux.Part of Gov't lot 3,S 14,T 41N,R 8W;Parcel:3.6.
Volume 729 Records page 1.0.71 acres total.Property is zoned ResidentiaVRecreational One.
Application is for the construction of an 8'x 24'addition onto an e�sting dwelling and the re-
placement of the roof over the entire dwelling at a setback distance of 44'(with eaves)to the
right-of-way of State Hwy 77.Currently,the dwelling is located 47'from the right-of-way and
170'from the centedine of the highway.Also,the construction of a 16'x 16'addition meeting all
requ'ved setbacks all at a cost exceeding 50%of the current estimated fair market value.Variance
is requested as Section 4.21(1),Sawyer County Zoning Ordinance,would require that the pro-
posed addition must be a minimum of 66'from the right-of-way to this highway and Section
10.21(2)requires the prior granting of a variance for non-conforming sUvctures with the cost of
construction exceeding 50%of the current estimated fair market value.The Town Board has ta-
bled their decision until ne�ct month.
Variance was approved as is with the following conditions:The portable carport is to always
remain portable/removable with no sides or foundation.A two(2)year time limit was also
placed for the procurement of a land use permit.
Findings of Fact of the Board of Appeals: It would be due to special conditions unique to the
property;it would not be a self created hardship;it would not be the basis of economic gain;it
would not be for the convenience of the owner,and it is not contrary to public interest.
On 4/20/2011,Cindy Yackley called Chairman Gerber to clarify t6e Boards decision$s ta
whether the approval of the variance was contingent upon the Town Board's approval
since the Town Board has not heard this application.Chairman Gerber stated that the de-
cision was not continQent upon the Town Boards decision and that the decision was made
and stands as approved regardless as to what the Town Board decides.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.

a) Alternatives Considered: Space on eost side would interfere with the existing well head.
b) Alternatives requiring s lesser variance: Attach the goroge to the house. rhis became inodvisable due to roofline
structural issues and stormwater runoff issues.
Describe the impact on vour propertv and adiacent properties if the variance is�ranted.
Immediate start. Enhanced structure will provide a good image to the public and adjacent properties.
Part 2:Three-Step Test
1) Unique Propertv Limitations.
YES The home pre-existed the Hwy 77 construction/reconstruction. The Hwy 77 ROW Boundaries make the
homestead non-conforming to the 66 foot set-back rule. The homestead should have been given more berth
from the Hwy.
2) No Harm to Public Interest.
1) Public Health&Safety: Decreased chance of fire with modernizing the strudure. Increased safety/integrty
of the roof structure. Decreased chance of children/vermin contact.
2) Scenic beauty: Enhanced structure will provide a good image to the area. Natural landscaping will occur.
3) Unnecessary Hardship
YES. The older portion of the home predates the Hwy 77 ROW. It therefore does not comply with the current
+66 foot rule. It does,however,fall well within the 130'or more range. The atypical widening of the ROW
causes a hardship in this case.
Project Description
Basically, the small 8X24' addition is the reason for the variance. Due to the fact the HWY 77 ROW
begins to widen it causes this area to be increasing the non-comformity by 2 feet. It is a very small
cornerofthe house.
The reason for the addition here is to square off the house structure so a new roof can be installed all
the way to the back of the house with no valleys. We have had problems with the valleys on this current
roofline.
The other possible non conformities may include 2 foot eaves on the front making the measurement
45' and 51' from Property line and a small entranceway 6'X10' to the front door on the existing deck
(16'X22') see drawings for detail.
Request relief from the +66 foot rule (home is already nonconforming to that rule and is 47' from the
property line at its nearest point). However,the house is 172' feet from the centerline of Hwy 77.
The house predates the Hwy.
In order to finance the small addition and replace the roof we seek relief from the 50% rule for the cost
of the remodel and update.

Re: Notice of Public Hearing Date
Dear Mr. and Mrs. Carroll;
Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on: Tuesday, April 19, 2011.
This hearing will begin at 7:00 P.M. at the Sawyer County Courthouse, 10610 Main,
Hayward, WI 54843. It is recommended that either you or a representative be present at
the Hearing. A lack of information about the situation may result in unnecessary delay of
a decision. Failure to appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Alan Gerber, Chairman of the Board of Appeals. This statement
should include a description of the general terrain; surrounding development; your
proposed intentions; and the purpose of the request. Photographs of the property and/or
buildings are requested. Explain the undue zoning hardship inflicted upon the owner by
conforming to the required minimum regulation, which induced the variance request.
Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will also go before the Town Board. Some townships also have a
Planning Commission. Please contact your Town Clerk Shannon O'Hare; 715/634-
4123 for the day and time of the Planning Commission and Town Board meetings
so you or your representative may appear.
