This application has been tabled from the February PubGc Hearing to allow time for the Town Planning Committee to review and recommend a decision and to allow the purchaser the opportunity to attend this hearing. The Town Board has denied the application with comments. Findings of Fact of the Zoning Committee: It would be damaging to the rights of others aud property values; the decision supports the Town of Winter Planning Commission and the Town Board recommendation. Approximately 35 people were in attendance, the greatest majority of them residents of the immediate Barber Lake area, if not water front property owners. Mr Craig Barrett, applicant, was also present and spoke about his intentions for the property, and answered questions about the intended camp. The Town Board decided to postpone a decision on this application until the March 2011 meeting, and have the Town of Winter Plan Commission make recommendation to them on it. The Town of Winter Plan Commission held a public hearing on the matter on February 16, 2011. Approximately 40 persons attended that meeting—almost all residents of the immediate Barber Lake area. A citizen's petition with 30 signatures of people asking for denial of the Conditional Use was presented to the Plan Commission for their consideration. All were original signatures of persons living on or near Barber Lake. The ariginal copy of that petition is attached. Mr Craig Barrett was present and again gave a presentation on his plans and answered the questions and concerns of those present. One citizen spoke in favor of the camp. Ultimately the Plan Commission voted 3-2 to recommend denial of the CUA, citing the residential zoning of that neighborhood as well as the local opposition to the proposed plan. The Town of Winter Board again addressed the question at their monthly meeting on March 9, 2011. They received the Plan Commission's recommendation for denial, a copy of which is attached. Approximately 40 citizens were present at the meeting. Numerous letters and emails were received requesting denial of the CUA, and all board members and the clerk received phone calls in opposition. One board member reported also receiving calls in favor of the application. A petition was presented to the board requesting approval of the CUA. The petition contained approximately 90 signatures. Five signatures were of people from the Barber Lake area, but were "proxy" signatures—signed by someone else after a telephone conversation. Several of the remaining signatures were of non- residents. The original petition is attached.
