Judge made two very specific findings in his decision dated October 20, 2014. First he found that your hardship is not due to any unique characteristics of the property and the hardship is self created. Once the Judge makes these findings and because his decision was not appealed, the Board of Appeals is foreclosed from finding differently than the Judge. As such, a variance could not be granted in light of the Judge's conclusions. I am directing the zoning office to return your application along with your filing fee as it should not have been accepted in the first place. Should you have any questions, please advise.
