Dear Mr. and Mrs. Kleczynski and Mr. and Mrs. Brand:
Please refer to the enclosed letter written by Sawyer County's Corporation Counsel,
Thomas J. Duffy regarding your recent application for variance. Also enclosed is your
refund of the filing fee ($450.00) as well as your recent original variance application as
suggested by Attorney Duffy.
Unfortunately, our office interpreted the Judge's ruling differently and apologizes for the
inconvenience this has caused you all.
I'm sure that you will have questions regarding this and they should be directed to our
Corporation Counsel, Thomas J. Duffy at 715-634-6470.

RE: Variance Request
Dear Mr. and Mrs. Kleczynski and Mr. and Mrs. Brand:
I have been advised by the Sawyer County Zoning Department that you have made an application
for basically the same variance that was denied by Judge Wright.
Judge made two very specific findings in his decision dated October 20, 2014. First he found
that your hardship is not due to any unique characteristics of the property and the hardship is self
created. Once the Judge makes these findings and because his decision was not appealed, the
Board of Appeals is foreclosed from finding differently than the Judge. As such, a variance
could not be granted in light of the Judge's conclusions. I am directing the zoning office to return
your application along with your filing fee as it should not have been accepted in the first place.
