Notice is hereby given that on September 18,2012 the Sawyer County Zoning Boazd of Appeals
approved with conditions, your application for variance for the following proposal:
Town of Bass Lake-Paul Eckerline.Lot 1,being part of Godt bt 1,S3,T 39N,R 9W;Parcel 5104.
Property has 0.54 acres. Property is zoaed Residential/Recreational One.The construction of a 48'x 32'
(50'x 34'with eaves)dwelling located 51'at the closest point to a navigable cFiaiwel that connects Lac
Courte Oreilles to a back lagoon.Variance is requested as Section 14.1,Sawyer CounTy Zoning Shoreland-
Wetland Protection Ordinance,would require the prior granting of a variance for any structure located
closer than 75'to the ordinary high water mark of navigable water.The Town Board has approved the ap-
plication with additioual comments.
The Board of Appeals approved the application with the following conditions:1)The eaist-
ing cabin and deck be removed prior to new construction;2)the asphalt boat ramp shall be
removed;3)mitigation shall be done in accordance with a plan by Sawyer County Zoning
and Conservation Department; 4)size of the structure is not to exceed 29'a 50';5)a two
year time limit is placed to procure a land use permit.
Findings of Fact of the Board of Appeals:It would not be the basis of economic gain;it would
not be a self-created hardship;there would be no change in use in the zone district;it would not
be damaging to the rights of others or property values and it would be due to special conditions
unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.

Part 2: Three-Step Test.
To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. This is known as the `Yhree-step test."
i) Unique Propertv Limitations.
Unique physicai limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant(growing family,
need for a lazger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.

the ordinance?

2) No Hann to Public Interests.
A vaziance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5)minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.

3) Unnecessary Hardship.
An applicant may not claim hardship because of conditions which are self-
imposed ar created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hazdship does not
justify a variance. When determining whether unnecessary hazdship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot azea, or height. For an
area variance, unnecessary hardship exists when comnliance would
unreasonably nrevent the owner from usine the propertv for a permitted
purpose or would render conformitv with such restrictions unnecessarilv
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the re'striction aze weighs against the limitations full compliance
would impose on use of the property.

A��eals The Board of Appeals would like your cooperation in stating the reasons or comments why you
�approved, denied, or tabled the variance application.
Re: paul Eckerline
The variance would not be contrary to the public interest and would be in compliance
with the spirit and intent of the Sawyer County Zoning Ordinance and the Town of Bass
Lake Comnrehensive Plan (Section 8.10) because:
1) There would be no change in the use in the zone district
2) It would not be damaging to the rights of others or property values
3) It would be due to special conditions unique to the property
The Town of Bass Lake Planning Co�i.ttee reco�ended approval by the Town Board with the
condition that the buildin is 2Q'��x 50' with eaves with no further variance for a
Qara�e and that the current cabin and ramp are removed prior to construction.
