Re: Public Hearing

The Sawyer County Zoning Committee, having held a public hearing pursuant to Section
59.69 (5) (e), Wisconsin Statutes, notice thereof having been given as provided by law
and being duly informed of the facts pertinent to the proposed changes, hereby
recommends that the petitions described as follows be approved:
TOWN OF SAND LAKE
1) Judy and W. Kevin Weaver. Lot A, being Part of the SWl/4 SW1/4, S 15, T 39N, R
9W; Parcel 11.2. Doc #316664; CSM Volume 1 Page 56. 2.51 acres. Change from
District Commercial One to District Residential/Recreational One. Purpose of request
is to make the zone district compatible with the present and future use. There is no
commercial activity taking place on the property. The Town Board approved the
application with comments.
Motion by Gundersen, second by Johnson to approve the rezone request. Motion
carried 4-1 (Zietlow).
Findings of Fact: It would not be damaging to the rights of others or property values.

On, Friday, July 2Q 2012, the Sawyer County Zoning Committee approved your
application for change of zone district on the following described real estate to wit:

CSM Volume 1 page 56. 2.51 acres. Change from district Commercial One to district
Residential/Recreational One.Purpose of request is to make the zone district compatible
with the present and future use. There is no commercial activity taking place on the
property.The Town Board has approved the application with comments.
The Sawyer County Zoning Corrunittee approved the application as submitted.
Findings of Fact of the Zoning Corrvnittee:It would not be damaging to the rights of
others or property values.
The Sawyer County Board of Supervisors must ratify the approval of the change in zone
district before it becomes final. This will be scheduled for the County Board meeting on
August 16, 2012 at 6:30 P.M., in the Circuit Courtroom of the Sawyer County
Courthouse.
This decision is a recommendation to the County Boazd of Supervisors. Any person or
persons jointly aggrieved by the decision of the County Boazd may commence an action in
the Circuit Court for Writ of Certiorari to review the legality of the decision within 30
days after the date the decision is ratified by the County Boazd.

Proposed Intentions:
Change zoning of properry from commercial one(1)to residential/recreational one(1).
Purpose of Request:
To make the zone district compatible with the existing and future use.There is no commercial activity
taking place on the property.
We have owned this properry for almost 9 years.The original plan was to operate the convenience store/
bait shop wlvch we did for 4-5 yeazs.Due to the increasing competition in the area,the increasing cost of
inventory and the failing economy as well as the need for health insurance,we made the decision to close the
store in 2007 and seek outside employment.I currently have a good job with benefits and am now focusing on
our retirement.
The plan now is to re-zone the property to residential use and expand the living area into the old retail
space and the property will be our primary residence.We love the area and are very comfortable here,we have
no desire to perform any commercial activity on this property.
The buildings on the properiy include the residence of about 1000 sq.fr.,attached to the retail space of
about 800 sq.ft.The retaii space is laid out in a manor that allows for easy conversion to expansion of the living
space.There is also a 26'X 40'garage/shop behind the residence.
The property is bordered on the front by highway 27-70,to the west by Counry"F",to the east by
residential property and to the rear by wooded property.A large portion of the property to the rear is wooded.
Across highway 27-70 is commercial property,Midway Automotive and to the northwest is commercial
property with storage and 3 occupied residences.To the west across highway"F"are several homes and
cottages on Sand Lake.
The changing of the zoning on this property really holds no impact on the community since there is a
larger convenience store/gas station 1 mile to the west and the grocery store has re-opened in Stone Lake
selling groceries and bait and also another bait shop just out of Stone Lake on`BB"
The majority of properties around us are private residences and we feel that allowing us to change the
zoning ou our property to residential will be a fine fit in the communiTy.

Re: Notice of Public Hearing Date
Dear Mr. and Mrs. Weaver:
Your application for a Change in Zone District will be considered at a Public Hearing
before the Sawyer County Zoning Committee on: Friday, July 20, 2012.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the application may result in unnecessary delay of a decision. Failure to
appear may also result in the denial of the application.
If it is impossible for a representative be present, please submit a written statement in care
of this office directed to James Bassett, Chairman of the Zoning Committee. This
statement should include your proposed intentions, the purpose of the request, and a
description of the general terrain and surrounding development. Photographs of the
property and/or buildings would be beneficial. Indicate the undue hardship inflicted upon
the owner by conforming to the present zone district and the compatibility of the proposed
use with the surrounding land uses. Convenience and financial loss or gain does not
constitute zoning hardship.
Your application will come before the Town Board for their review. Some
townships also have a Planning Commission. Please contact the Town Clerk, Elaine
Nyberg; 715/865-2006 to conGrm the date and obtain the time of the Planning
Commission and Town Board meetings for your attendance or the attendance of
your agent.
