Parcel # 028-742-19-2301 ; approximately 3.5 total acres of a 40 acre parcel zoned Forestry One (F-1) Request: Request is to rezone the approximately 3.5 acres of legal description above from Forestry One (F-1) to Commercial One (C-1). Summary of Request: The applicant(s) are requesting to rezone approximately 305 acres to G1 to allow for a permitted commercial use as described in the Sawyer County Zoning Ordinance Section 17.6(A) , which allows "public and semi-public buildings and institutions" as a permitted use. This permitted commercial use would be within an existing structure on the property and would be subject to a Ground Lease between Sawyer County and the American Birkebeiner Ski Foundation (ABSF) because ABSF owns the building and the County owns the land upon which the building sits. The ground lease and an update MOU agreement are in draft form waiting to be finalized at County Board. Zoning Committee Public Hearing Information: The Zoning Committee spent over 4 hours considering this rezone request at its October and November meetings. The Committee reduced the size of the requested rezone from 13.5 acres to approximately 3.5 acres which encompasses the parking lot, building, and a small outdoor exercise area. The Zoning Committee also wanted to view the draft versions of the ground lease and MOU which were taking into consideration as part of the rezone request. Since the County owns the land under the building, it can control what commercial activities go on in the area rezoned as commercial through the ground lease and MOU. It's important to note that \ due to specific case law that conditions should not be tied to the rezone itself. There were several people in attendance at the November 15, 2019 Zoning Committee public hearing that were in objection to this proposed rezone request and a few in support. It was also mentioned at the public hearing that other organizations besides the ABSF inay be interested in selling food and merchandise in the parking lot of the County 00 Birkie building during their events. If the parcel is not rezoned commercial these organizations would not be permitted to do so. After much debate and discussion the Sawyer County Zoning Committee made the recommendation for approval of the rezone request in a vote of 4-1 with the findings of fact o£ 1 It would not be damaging to the rights of others or property values 2 It would not create an air quality, water supply, or pollution problem. 3 It would not create topographical problems such as run off, drainage, erosion, flooding, or vegetative cover removal Project History: This type of rezone is something that should have been done initially when the ABSF "warming building" was first built in 2017. The ABSF had secured a conditional use permit (CUP) from the Town of Spider Lake for the said recreation maintenance and warming building (included in packet). After the structure was built it was later discovered that the ABSF wanted to also have a small coffee shop area included within the warming building's kitchen. This type of use however would only be allowed in a commercial zoned district. If the rezone is approved ABSF would be responsible for complying with any and all other federal, state, and local laws. Additional Information/details: See attached additional maps included in this packet. The Town of Spider Lake as part of Town's Comprehensive Plan indicated both the existing and future use of this area as forestry and rural forested/open area. As noted above, the Town granted a CUP for the building in 2017 It should also be mentioned that as per WI Stats 59.69(9),"the county board may by ordinance zone and rezone lands owned by the county without necessity of securing the approval of the town boards of the towns wherein the lands are situated and without following the procedure outlined in sub. t>t, provided that the county board shall give written notice to the town board of the town wherein the lands are situated of its intent to so rezone and shall hold a public hearing on the proposed rezoning ordinance and give notice of the hearing by posting in 5 public places in the town." The Town has been notified and the notice of the public hearing, which the County Zoning Committee is conducting on October 18, 2019, and it has been posted in 5 public places. Two of the public postings are in both of the County's newspapers which has a circulation in the Town. The 3 other places are at the public bulletin boards in Spider Lake. While the Town of Spider Lake was not obligated to take action on this matter, note that the Town Board approved the rezone on October 9, 2019. No other property owners were sent"rezone petition letters" because Sawyer County (Sawyer County Forest Crop) owns all of the other adjacent properties. All of the other surrounding zone districts in this area are zoned F-l. This may be viewed as spot zoning, but spot zoning is not necessarily illegal because such zoning is not necessarily inconsistent with the purposes for which zoning ordinances can be passed. However, rezoning should be consistent with long-range planning and based upon considerations which affect the whole community. Therefore spot zoning should only be indulged where it is in the public interest and not solely for the benefit of the property owner requesting the rezoning. The ability to serve coffee in a warming building or conduct other limited commercial uses in a recreational area and trail system that is open to the public with no other such structures nearby may be viewed as a benefit to the public.
