Findinzs of Fact: It would not create an air quality,water supply,or pollution problem. It would not
create traffic or highway access problems. It would not destroy prime agricultural lands.
The Sawyer County Board of Supervisors must ratify the approval of the change in zone district before it
becomes final. This will be scheduled for the County Board meeting on Mav 18.2017 at 6:30 P.M.,in the
Circuit Courtroom of the Sawyer County Courthouse.
Any person(s)jointly aggrieved by the decision of the Zoning Committee may appeal the decision to the
Sawyer County Board of Appeals to review the legality of the decision within 30 days after the date of this
notice.

Notice is hereby given that on May 18, 2017 the Sawyer County Board of Supervisors ratiflied the
approval of a change of zone district of the following described real estate to Residential/Recreational
One(RR-1).
Case#16-031, Billings Trust
Property description: Part Government Lot 2;09,T39N, R09W; Parcel#026-939-09-5203; 6.50 total
acres; Doc tt402994;Change from District:Agricultural One(A-1) to District: Residential/Recreational
One(RR-1).
Purpose of request:To correct zone from (A-1)to(RR-1)to match remaining property that is zoned (RR-1)
Rezone conditions:
1. Subdivision of the property shall be limited to a total of four(4) buildable lots,consisting of two
(2) lots on each side of Fleur De Lane Road.
2. A forested area 75 feet in width shall be maintained along the full length of the west boundary of
the property to buffer the adjacent agricultural lands.
3. The rezone shall take effect only upon the recording of a Certified Survey Map consistent with
Condition No. 1, and Declaration of Covenants and Restrictions in the form attached hereto as
Exhibit A.
4. The rezoning of any lands by this Amendatory Ordinance that does not take effect within two (2)
years of the County Board's adoption shall become null and void and the zoning for such lands
shall revert to the designation in effect on the day prior to such adoption.

Dear Chairman Bassett, Zoning Committee Members and Mr. Olson:
This letter is to advise that my clients have reached an agreement with the applicant in the above-
referenced matter to resolve previously identified concerns with the proposed rezone of property adjacent
to Lac Courte Oreilles from Agricultural One to Residential-Recreational (RR-1). In exchange for the
Billings Trust's stipulation to conditions limiting subdivision and maintaining a designated forested
buffer area, the petitioners Mimi Dahlby and Lori R. Osendorf Trust, together with Lane and Patty
Jorgensen, hereby withdraw the protest petition and their opposition to the rezone application.
Enclosed are two documents designed to formalize the conditions of the rezone. The first is a
proposed amendatory ordinance in the form utilized by Sawyer County. The second is a recordable form
of a Du:laration of Covenants and Rcstrictions, which is referenced as an exhibit to the amendatory
ordinance. The ordinance also contemplates the recording of a certified survey map as a condition of the
rezone. I am authorized to state that Attornev Mackenzie Campbell on behalf of the Billin¢s Trust
concurs in the fore�n�re�resentations and in the form of the enclosed documents.
In light of the stipulation between the applicant and the objectors outlined herein, we do not
anticipate appearing at this Friday's zoning committee meeting. Please contact myself or Attorney
Campbell if you have any concerns with the form of the proposed decision documents.

between the lands zoned Residential/Recreational One (RR-1) and adjacent lands zoned Agricultural One (A-1).
2.2. The Restricted Property shall contain no more than four buildable lots as shown on Certified Survey

"Ille Trust�s application for re-zone should be ratif�ied because most of the suri'ounding parcels
are zoned RR-1 and it is consistent witl� the surrowlding uses. Attached as Exhibit B is a��
aunotated map of the area that includes the "l�rust property as well as il�e other sw�rounding
parcels showing the various zoning designations. Eleven of the twelve surrounding shoreline
parcels a��e zoned RR-1 and five of the uine surrounding back parcels are zoi�ed RR-1. Thus,
92% of the sun'ounding front shoreline parcels and 56% of the back parcels immediately
sw�rounding the 'l�rust property are roned RR-1 and the "Trust's application to zone the back
portion of the property from A-1 to RR-1 is consistent with the surrounding uses. Considering
the"I�rust l�as no plans to put structiu�es ou the back parcel,this strougly supports ratification of

Several objections have been submitted regarding the potential environmeutal impact of the
Crust's re-zone application. Whilc thc concerns tl�at have been raised are important
cousidcrations they should uot liinder the��'nist's application. First and foremost, the Trust has
no plans to change anything about the back parcel except to change the zoning desig»ation.More
importantly, the rc-zone of U�e property will likciy not have a significant adverse impact �ipon
water qualiYy and habitat because the land sought to be re-zoned is surrounded by land that is
already zoi�ed KK-1. Lasdy, co��cerns were raised witl� regard to the maintenance of a buffer
zoi�e fi'om the waterfront by opposing aA�y �roposed sn'ucturc on land within 1,000 feet of Yhe
ordinary l�igli watermark."I'his rypc of�concern may be valid but it also interferes with tlic rights
of property owners to use their property consistcnt with thc surrounding uses. I[owever, in
recognition of ihis concern and assuming die re-zone is ratified,tlie"Trust has and will contimie
to engage iu negotiatio��s for the sale of the back parcel to neighboring property owilers tl�at inay
self-impose sueh a restriction on the lai�d.
I,astly, the objections to the re-zone of the "I'rust property conceri�ing tl�e scope oi�poteillially
permitted uses of RR-1 property years down tl�c road are too far removed fi�om tl�e decision tlie
Board is being asked to ratify. Again,there are no plans to change tl�e nauu'e of the use of tl�e
back parcel. The fcar that sometime, down thc road, another la��dowuer may usc his or her

Dear Chairman Kinsley and Supervisors:
This letter is written in connection with the Board's consideration of Agenda Item 6A. of
the March 16 meeting, Amendment to Zone District Maps—Case#1601 l, Sharon Billings
Revocable Trust. The neighborin�property owners, Lori R. Osendorf Trust and J. Mimi Dahlby,
have duly filed a Protest Petition under Section 59.69(5)(e)Sg. of the Wisconsin Statutes, in
opposition to the requested rezone. Pursuant to statute,the Protest Petition triggers a 3/<
supermajority vote requirement for approval. For the reasons stated below, we conclude that the
Zoning Committee's review of the rezone application was legally deficient. The objectors
therefore request that the Board return the application to the Committee to consider whether the
requested rezone is consistent with County zoning standards, and whether conditions should be
imposed protect against negative impacts to property and environmental values.
The Billings' rezone application states that the purpose for the requested amendment is
simply to allow the subdivision of the lalcefront portion of the tax parcel into two lots. But in the
absence of restrictions, the requested re�one would allow substantial additional land division and
sizeable development of both the lakeshore dnd rear portions of the tax parcel without further
rcview. The range of development permitted under the RR-1 zoning classification is not limited
in any respect by the applicant's current plan to subdivide the lakefront portion into two lots.
The specter of uncontrolled development creates a significant risk for negative environmental
impacts to Lac Courte Oreilles by the removal of a"buffer" area between the lake and adjacent
agricultural properties.
The rezone request was not properly vetted according to the County's own procedures
and standards, as reflected by the record of the public hearing and the Committee's very brief
deliberations. The Committee recommended approval of the rezone on a 3-2 vote, after less

than a minute of discussion. The Committee's finding that the rezone"would be compatible
with the surrounding uses and the azea"is azbitrary,capricious and unsupported by the record.
The Committee proceeded under an incorrect theory of the law. We have been advised that in
considering rezone requests,the County acts primarily according to the recommendation of the
town in which the property is located. Indeed,the Minutes of the public hearing reflect that the
Committee did nothing more than reiterate the Town's reasons for recommending approval.
This practice is an abdication of the County's statutory authority and responsibility to ensure that
County ordinance standazds aze met.
The Committee could have,but failed to address whether conditions should be attached
to the limit the rezone to development consistent with the applicant's proposal. The practice of
attaching conditions to a rezone for this purpose has been approved in Wisconsin since the
19'70s. The County has clear authority under Wisconsin law to impose conditions on a rezone,to
ensure that the ordinance amendment meets the standazds set forth in the zoning ordinance.
Here,the Committee could have conditioned its recommendation on:(1)the recording of a
certified survey map subdividing the]akefront part of the tax parcel as represented by the
applicant;and(2)prohibiting the subdivision of the portion of the lot west of Fleur de Lane,
consistent with the present zoning classification. Given that increased density of development
and impervious surfaces that would be permitted as a matter of right under RR-1 zoning
classification will substantially threaten the existing character and environmental values of the
property,the Committee should have imposed conditions consistent with the applicant's stated
proposal.
We request that the Board deny the rezone application based on the Committee's failure
to apply the proper standazd under the County zoning ordinance. T'he Boazd may wish to
consider retumin�the matter to the Zoning Committee to make a recommendation as to whether
a rezone with conditions as outlined above would adequately protect the surrounding properties
and the water quality of Lac Courte Oreilles.

As reflected by the Minutes and audio recording of the November 18`� public heazing
before the County Zoning Committee, the Committee recommended approval of the rezone by a
baze 3-2 majority, afier receipt of written and verbal objections at the heazing, and afrer less than
one minute of discussion.
The abutting property owners, Lori R. Osendorf Trust and J. Mimi Dahlby,joined by
Lane and Patry Jorgensen, the owners of residential properey at 6756N Fleur de Lane, object to
the proposed rezone because there is no rational basis for the County to approve the requested
rezone in the complete absence of information concerning the applicant's proposed development
on the pazcel.
The enclosed zoning district map shows that the Subject Property is comprised of two
pazcels on either side of Fleur de Lane. The applicant proposes to split the easterly (lakefront)
parcel, which is currently zoned RR-1, into two lots. But the applicant has no proposal for
development ofthe westerly portion which is zoned A-1 agricultural and for which the rezone is
sought. This is an undeveloped, heavily wooded tract.

The application states that the purpose for the requested rezone from A-1 agricultural to
RR-1 residential-recreational is "to correct zone [from] A-1 to RR-1 to match remaining majority
of property that is zoned RR-]." There is no evidence in the hearing record from which to
conclude that any "correction" is warranted, because there is no evidence that the original zonin�
designation was in some way unintended.
The current A-1 zoning designation for the Billings parcel, together with the vast
majority of the parcels west of Fleur de Lane which are also zoned .A-], appropriately provides a
buffer zone between the agricultural lands to the west and Lac Courte Oreilles to the east. Given
that any developmei�t will substantially change the existing character and environmental values
of the property, the applicant should have been required to provide information concerning the
need for the rezone based on a specific development proposal.
The Subject Property lies within the shoreland of Lac Courte Oreilles, and therefore the
purpose and intent of the Sawyer County Zoning Shoreland-Wetland Protection Ordinance must
be considered in connection with the request for rezoning. Further, as a matter of Wisconsin
law:
The pertinent inquiries go to whether the rezoning is consistent with long-range
planning and based upon considerations which affect the whole community. 1'he
nature and chazacter of the pazcel, the use of the surrounding land and the overall
scheme or zoning plan aze also relevant. Finally, the interests of public health,
morals and safety must also be considered, as well as the promotion of public
welfare, convenience and general prosperity.
Step Now Citizens Group v. Town of Utica Planning&Zonrng Camm., 2003 WI App 109, P29.
In the absence of a concrete development proposal, it is impossible to determine whether the
requested rezone is consistent with these purposes, or with the Zoning Committee's criteria for
approval of rezones. Thus, the Committee's finding that the rezone"would be compatible with
the surrounding uses and the area" is azbitrary, capricious and unsupported by the record.
The most significant eonsequence of a rezone would be to increase the density of
permissible development on the parcel. As measured by the Sawyer County GIS system, the
azea of the portion west of Fleur de Lane is approximately 3.8 acres. Approval of the rezone
would allow this portion of the propert}�to be subdivided into as many as four 100 x 200 fr. lots
for residential deve►opment as a permitted use. The Zoning Committee and the Board must be
able to evaluate the impacts of this and other potentially significant changes in use and land
cover(including environmental, water quality, increase in impervious surfaces, noise, traffic
safety and congestion)to deteanine whether the requested rezone is an appropriate exercise of
the Board's discretion.

Re: NOTICE OF PUBLIC HEARING DATE
Dear Sharon Billings Trust,
Your application for a Change in Zone District will be considered at a Public Hearing before the
Sawyer County Zoning Committee on November 18, 2016.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main Street,
Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the application may result in unnecessary delay of a decision. Failure to
appear may also result in the denial of the application.
If it is impossible for you or a representative to be present, please submit a written statement
addressed to James Bassett, Chairman of the Zoning Committee to the above address. This
statement should include the purpose of the request or your proposed intentions and a
description of the general terrain and surrounding development. Photographs of the property
and/or buildings would be beneficial. Indicate the undue hardship inflicted upon you by
conforming to the present zone district and the compatibility of the proposed use with the
surrounding land uses and indicate how your proposal would not be contrary to the public
interest.
Your applicatio� will also go before the Town Board for their review. Some townships also
have a Planning Commission. Please contact the Town Clerk, Elaine Nyberg to confirm the
date and time of the Planning Commission and Town Board meeting for your attendance or
the attendance of your agent.
