Carolus. Lot 4, being part of the SW 1/4 SW 1/4, 532, T37N R 7W; Par- cel 3308. Site address: (applied for) - Taylor Road. Doc#385953; CSM Volume 7 Page 117. Property has 9.64 acres and is zoned Forestry One. Application is for the after-the-fact construction of a 26' x 32' concrete slab for a primary dwelling located 15' at the closest point from a delineated non-navigable wet- land boundary. Variance is requested as Section 14.3, Setbacks from Navigable Water, Wetland and Bluffs, of the Sawyer County Shoreland-Wetland Protection Ordinance, would require the prior granting of a variance for any new structures located closer than 40' to the boundary of a non-navigable wetland. The Town Board approved the application with additional comments. The Board of Appeals denied the application based on the following findings: Based on the testimony, the contents of the variance application and the exhibits that were presented as well as the DNR's perspective, the Board found no unique property limitation exists. There is no unique slopes or unique parcel shape. To say that there is no solar power available in another locations would be a stretch regarding hardship. There is harm to the public interest due to the close prox- imity of the wetlands and the affect it would cause on the quality of wildlife and habitat. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice. Unique physical limitations of the property such as steep slopes or wetlands that are not generally shared by other properties must prevent compliance with ordinance requirements. The circumstances of an applicant(growing family, need for a larger garage etc.)are not a factor in deciding variances. Nearby ordinance violations,prior variances or lack of objections from neighbors or the Town Board do not provide a basis for granting a variance. A variance may not be granted which results in harm to public interests. In applying this test, the Board of Appeals must consider impacts of your proposal and the cumulative impacts of similar projects on the interests of the neighbors and the entire community. Some, but not necessarily all of these considerations are: (1) Public health, safety and welfare, (2) water quality, (3) fish and wildlife habitat, (4) natural scenic beauty, (5) minimizarion of property damages and (6) achievement of eventual compliance for nonconforming uses, structures and lots. An applicant may not claim hardship because of conditions which are self- imposed or created by a prior owner (for example, excavating a pond on a vacant lot and then arguing that there is no suitable location for a home.). Courts have also determined that economic or financial hardship does not justify a variance. When determining whether unnecessary hardship exists, the property as a whole is considered rather than just a portion of the parcel. You are applying for an "area variance.' An area variance relaxes a dimensional standard such as a setback, frontage, lot area, or height. For an area variance, unnecessary hardship exists when comoliance would unreasonablv prevent the owner from using the prope for a permitted pumose or would render conformity with such restrictions unnecessarilv burdensome. The importance of the public purposes of the ordinance, the degree to which the restriction supports those purposes and the extent of the relaxation of the restriction are weighs against the limitations full compliance would impose on use of the property. The Department is sending you this letter today to report/summarize those findings. May 7,2015 a site visit was conducted on your property to verify the presence and wetland boundary on your property to determine if wetland fill resulted from construction of the access drive and building pad. The Department determined that the access drive and building pad did not result in wetland fill that would have required written authorization pursuant to s.281.36,401 CWA,Wisconsin State Statute. It was found that an unauthorized discharge of fill material in a wetland did result from mechanized land clearing as part of the construction activities that had taken place on the property. The unauthorized wetland discharge was 50 feet long,20 feet wide,and a depth of 3-9 inches deep. The unauthorized wetland discharge is the compliance issue the Department has associated with this property,and not the access drive or building pad as previously stated. The Department and you have agreed to a voluntary wetland fill removal date of July 31, 2015. The Department is willing to closeout this compliance issue and take no further enforcement action upon satisfactory removal of the wetland fill by the agreed upon date. Finally as requested,the Department is also enclosing the Wisconsin Wetland Inventory Map of the property,and a publication explaining the Department's review process associated with wetland fill and the practical alternatives analysis. After much thought and research I embraced the idea of a solar system. I called the Sawyer county clerk and they were very kind,and walked me through the permit process on the phone as I took notes to make sure I was doing everything correct. Betty was kind enough to send me the important notice form. See Attachment)I began in September of 2014,by October I had all the permits they instructed me to get and I started construction project. I chose to hire local help and found H&S Excavating to put in a drive and pad for the cabin slab. Trees were removed close to the wetland to achieve 4 to 5 hours of sunlight.Using the wetland with it smaller trees and bushes for sun light but yet saving as the many trees as possible. The slab was formed and prepped the 1�t week in November by DC Create and they called an inspection and was inspected by T.A.K inspections,and was approved then we ordered the concrete and poured it on the first Friday in November.They poured a slab for the privy at the same time and was placed about 40 foot from the west property line. I planned on using a satellite holding tank to insure no waste would ever get into the ground water.To repeat there is no plumbing planed for inside the cabin. On November 18,2004 to my surprise I received a letter from Travis Holt with the DNR telling me to stop construction and a date of May 7,2015 was set for an inspection of the site. After meeting Mr.Holt on site he gave me a correct notice to remove some stumps from the wetland area. Keep in mind the lot was much dryer in the fall,then it was in the spring. The stumps where placed alongside some dead trees some maples,poplar,ash and a couple of small oaks.Travis told me that I was in compliance with the DNR except for the stumps. At that same meeting Pat Brown from Sawyer County Zoning&Conservation informed me of a 40'setback from the wetland boundary ordinance. I was told I could apply for a variance to resolve the issue. On May 12 I talked to Pat via a phone call and he told me he would send me the paper work right away. I called Pat two more times knowing the dead line to apply for the variance getting closer June 5`h.The application final arrived on June 150 This left me a very short window to react and prepare my application. On Tuesday on June 2n°I contacted a friend with a computer as I have no computer skills.In a short time he printed out the entire 36 pages of this document.
