Notice is hereby given that on Tuesday, May 19, 2015 the Sawyer County Zoning Board of Ap-
peals approved the application for variance for the following proposal:
Town of Sand Lake -Walter Herrman Rev. Trust d/b/a Stone Lake Lumber—Paul Manka, Agent. Lots
8-12, Block 11 Village of Stone Lake Original Plat. S 19, T 39N, R 9W; Parcel 0800. Site address:
#16853W Main Street/Sand Lake Road. Doc# 393948. Property is 0.379 acres and is zoned Commercial
One. Application is for the construction of an 80' x 50' pole shed addition with attached 16' x 60' lean to
onto an existing non-conforming commercial building based on road setbacks. An existing 85' x 24' and
32' x 19' portion of the exiting building would be removed for the proposed expansion. The construction
cost of the addition will exceed 50% of the current estimated fair market value of the existing building.
Variance is requested as Section 10.21, Sawyer County Zoning Ordinance, would require the prior grant-
ing of a variance for any structure exceeding 50% of the current estimated fair market value of an exist-
ing non-conforming building. The Town Board approved the application.
The Board of Appeals approved the application as presented with the condition that the
guttering system that owner proposed are added to help divert the water runoff. Applica-
tions can be obtained at the Zoning Office.
Findings of Fact of the Board: The Board found that based on the testimony that was given, the
plan is a viable one. Just in hard surfacing the storage area to keep the sand and gravel out of the
existing water runways will be a positive thing for the entire village and all the residents that are
on the down side of the slope. The request doesn't seem to be extravagant or unnecessary and
shouldn't be any burden to any of the other dwellings or residents around the site. The special
conditions of the property call for the kind of plan that is proposed and when it is executed, eve-
ryone will be happy with the proposed aesthetic appearance. The unique property limitation is
due to the slope of the hill and the old plats that were developed in the village; it would not the
basis of economic gain or loss as it is something that the business should have had a long time
ago; it is improving the public health, safety and welfare of the people and the natural beauty.
There would be no change in use in the zone district; it would not be damaging to the rights of
others or property values; it would be due to special conditions unique to the property; it would
not be the basis of economic gain as its more of a necessity for the building and business and will
improve the landscape; and it is due to a safety concern in getting the materials under cover vers-
es out in the open. No time limit was imposed to obtain the land use permit.

Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.
