The Board of Appeals approved your request subject to the lot being divided equally be- tween the two parcels resulting in each lot having a minimum of five (5) acres. The Board cautions that the resulting shared lot line does not impose on the proposed building site. Findings of Fact of the Board of Appeals: Physical limitations of the property already exist; there is no basis for economic gain or loss; it is not a self-created hardship; it would not be damaging to the rights of others and it is due to special conditions that are unique to the property. Describe variance requested- We seek to build a'wheel chair accessible', 25 x 50 (1200 sq. Ft)home in our former garlic field,above grade,on a radiant heated concrete siab,with bathroom and living space located on the same`single story'floor, in order to accommodate Thomas,a service connected disabled veteran and co-owner of this properry. Describe the effects on the r�opgrty if variance is NOT granted- This variance will allow us to remain on this property,is absolutely required for future year round living, and will protect and improve current property and community value. A denial for variance would have the opposite effect. Simply put, If the variance is denied we will be forced to consider moving and/or abandoning our homestead of 31 years. All buildings create a 'greater impervious surface area.' However,we intend to control and divert water from the roof with gutters,downspouts and rain collection barrels used for watering our gardens. We don't plan on disturbing the pond shoreline buffer zone at all,other than the aiready existing single lane, mowed paths. We like it wild and want to keep it that way. We remain confidant that by granting us this variance,it would increase our overall property value, improve our lives greatly,allow us to remain on our property,all while creating more tax revenue and value for Sawyer County,Sand Lake Township and the State of Wisconsin,the proverbial`win-win'for all involved. � d Part 2: Three- Step Test 1) Unique �ro e�rt�imitations - Do unique physicai characteristics of property prevent compliance with ordinance? YES - As can be seen on the maps and photos supplied by us and those maintained by the Zoning Office, our 10.16 lot, while neariy 7/10's mile long is quite narrow, with the "un-named, non-navigable pond" to the south/east and the town road to the northwest. The site we have selected to build is the 'widesUdeepest' site available on the entire property and is abie to conform with current required set backs from pond (75') and town road (63'from center). 2) No Harm to Public Interests - 1) This variance request does not effect the public health or safety in any known way, other than the effect of 'improving our own' health and safety. 2) This variance will not adversely effect the surrounding water quality, 3) fish or wiidlife habitat or 4) the natural scenic beauty " It should be noted here that over our 31 years as owners of this property there has not been a single 'recreational watercraft' on the un-named, non-navigable pond, besides our own canoe. In fact; our land has the only viable access to the pond, located approximately 100' from the front door of our intended new home. 5) We feel the evidence will show that the variance requested will result in an improvementof the property, not any damage to it. 6) We feel the evidence wili also show that this variance request will harm no one, and while we will suffer the consequences of having our current home re-designated as "NON- CONFORMING", it remains in our best interests to do so. "'It should be noted here that due to the fluctuations of water levels observed over the last 31 years, the 'un-named' pond does not fit the description provided by the State of Wisconsin, as a navigable body of water."` 3) Unnecessary Hardshin - Is unnecessary hardship present? YES - If granted this variance will greatly improve our quality of life, particularly for Thomas, by eliminating _�urrent health and safety hazards , adversely contributing to his "service connected disabilities" which increasingly prohibits climbing/descending stairs. Simply put; "We must remove stairs from his life one way or another." '*It should be noted here that in our current home Thomas must make 41 steps, one way, including a narrow staircase, simply to get to the bathroom from the bedroom. He's not always able to make it." If granted this variance and subsequent single floor home will allow Thomas full access to all facilities of the home whenever his disabilities require his cane, walker or wheelchair without maneuvering stairs. The home has already been approved by the Department of Veterans Affairs and our Banker. Our contractors are ready to go as soon as the ground thaws. We hope to be able to take occupancy by Fall 2015. If this variance is granted we feel the 'besY possible way to split this lot would be to simply use the 'existing' SECTION Marker (as seen on maps) going right through the middle of our property aiready. To us, it just makes the most sense, is perhaps the most reliable and used reference point and results in a nearly even split. Unique property limitations — The depth limitation of the property is grandfathered and the 10. 16 acres lot would allow for dividing the lot into two equal parcels hence keeping within the intent and purpose of the W ilderness Lake Classification requirement of 5 acre minimum lot size for smaller bodies of water. 2. No harm to public interest — The propose of the Wilderness Lake Classification was to protect Sawyer County' s most vulnerable bodies of water from the effects of over- development and the reason for the 5 acre minimum lot size. All waters affect all other waters in one way or another. 3. Unnecessary Hardship — The unequal division of property is for the personal preference to create a larger lot for a new dwelling. Keeping the lot size to 5 acres does not keep the applicant from having reasonable use of property. Two 5 acre lots would not deny the building of a suitable dwelling (see attachment). None of the requirements for granting a variance have been met. This application would be for the convenience of the owner, it is a self-created hardship, and would not be in the public interest.
