Thank you for providing the hearing notice and application packet regarding these requests,and to Pat for discussing the request with me. I am providing these comments in place of making an appearance in person. Please have these comments delivered to and read before the BOA. The department understands: * An existing nonconforming principal structure lies 69 feet from the ordinary high water mark(OHWMJ of Connors Lake,within the 75 foot OHWM setback required under s.12.0 and 14.1 of the Sawyer County Zoning Shoreland-Wetland Protection Ordinance. * A 16 foot x 10 foot(160 square footJ nonconforming accessory structure(lakeward attached deckJ lies 59 feet from the OHWM. * A 16 foot x 14 foot(224 square foot)accessory structure(attached deck)lies to the landward side of the nonconforming principal structure. * The applicant requests to construct a 16 foot x 10 foot(160 square footJ enclosed screen porch over the existing nonconforming attached deck that would lie 59 feet from the OHWM,within the 75 foot OHWM setback required unders.12.0 and 14.1. * There is not a fully compliant building location on the property. Under s.59.692(1KJ(aJ(2J,Stats.,an existing nonconforming structure can be reconstructed,maintained, remodeled,etc.,as long as the footprint of the structure is not expanded. Additionally,this provision pertains to work on a like nonconforming structure;meaning reconstructing an existing deck with a new deck,or patio with a patio,or shed with a shed,etc. It is not intended to allow the replacement of an open deck with an enclosed screen porch. Further,s.NR 115.05(1)(gJS, Wis.Admin.Code,allows for a maximum lifetime 200 square foot lateral expansion of a nonconforming principal structure if it is at least 35 feet from the OHWM and is not towards the water. This request would be towards the water,and would be an expansion of an accessory structure(see s.59.692(1J(eJ,Stats.J. References to Statute and Wisconsin Administrative Code are made as the existing Sawyer County Zoning Shoreland-Wetland Protection Ordinance has not yet been updated to reflect three separate Statute changes that had immediate effective dates. At this time Sawyer County has until October 1,2016 to make the revisions to its Shoreland-Wetland Protection Ordinance. The applicant must demonstrate meeting all three required variance criteria,and the request is to be for the minimum relief necessary to relieve unnecessary burdens(Anderson,Robert M.American Low of Zoning 3d, (1986J Vol.3,s.20.86,pp.624-SJ,to be granted a variance. The department does not believe these can be demonstrated based on the narrative in the application packet,highlighted by the following: i 1. The department does not believe an unnecessary hardship has been demonstrated. First the State vs Winnebago County decision (196 Wis. 2d 836, 844-45 n.8, 540 N.W.2d 6 (Ct. App. 1995JJ established that the property-as-a-whole (entire propertyJ is to be considered for variance requests. It appears a fully compliant screen porch, and one larger than requested, could be constructed over the existing attached deck on the landward side of the existing nonconforming principal structure. Any fears of runoff from this addition interfering with the sanitary system should be able to be mitigated via proper use of gutters, downspouts, and downspout extensions, and perhaps infiltration into a rain garden or other similar engineered system. Thus, the property-as-a-whole standard does not appear to be met for this request. Second, the Snyder vs Wauke.sha County Zoning Board of Adjustment decision (74 Wis. 2d 468, 478-79, 247 N.W.2d 98J made it clear a circumstance of the applicant is not a factor to be considered when deciding variances. While expanded room for a washer and dryer and other uses may be desired, it is not a factor to be considered when deciding variances. The reasons explained in the applicant's narrative in the application packet are considered circumstances of the applicant, and do not represent an unnecessary hardship. 2. The department is not sure a limitation unique to the physical property has been demonstrated. Do the physical attributes of the applicant's lot, including steep slopes, differsignificantly from the neighboring properties? And again, there is a compliant location to construct the requested screen porch. 3. It must be considered whether or not the construction of the requested items within the required 75 foot OHWM setback, when a compliant location exists on the property, represents the minimum relief necessary to relieve unnecessary burdens. 4. Given all of the above, and that the request is not in concert with some of the Sawyer County Zoning Shoreland-Wetland Protection Ordinance purposes identified in s. 4.0, it can be argued the request would cause some harm to the public interest. 5. Given 1-4, it is not unnecessarily burdensome to deny the variance request. For these reasons, the department recommends the request be denied.
