Marcon, husband and wife ("Marcon"), are seeking a three (3)yeaz renewal of a regular Condi[iona] Use Permit for non-metallic mineral extraction of an existing sand and gravel pit, crushing and processing operations (portable plan[), and the use of a portable hot-mix asphalt plant The existing pit is located on land owned by Ronald and Eileen Marcon in the Town of Edgewater, Sawyer County. An Access Road Agreement was drawn between TKC Real Estate Holdings, LLC ("TKC"), a wholly-owned subsidiary of Kraemer, and Derrick Bacha (`Bacha") in 2010 now Schenker. The origival permit was approved on July l5, 1988 and most receutly renewed for another[hree(3)year term o�June 2013. The properties aze described as follows: Marcon - A 10-acre plot in the South one-half of the Northeast One-quarter of the Southeast One-quarter of the Southeast One-quarter and the North one-half of the Southeast One-quarter of the Southeast One-quarter of the Southeast One-quarter, all in Section 30,Town 37 North,Range 9 West,Town of Edgewater,Sawyer County,Wisconsin. Bacha —The existing access located on the Bacha property in Outlot 3 of Certified Survey Map #7645 in the Southwest One- quarter of the Southwest One-quarter,west of CTH F,Section 29,Town 37 North,Range 9 West,Town of Edgewater,Sawyer County,Wisconsin. The request £or the Conditional Use Permit renewal encompasses roughly 10 acres, of which approximately 10 acres are currentty or will be disturbed by the mining operation under the original tertn of the permit. The unused will remain in cropland until such time as they aze needed and will serve as a buffer between the mining operations and the surrounding landowners. The mining operation consists of the eatisting pit,access road,stockpile azeas,and futiue reserves. [n view of the fact that: l) the land is curre�tty zo�ed Agricultura]-t, 2) an active pit presently exists on the property; 3) sig�ificant amounts of sand and gravel reserves exist on the property; 4) mazkets exist for the mined products i� [he form of state, county, and local road materials, 5) mining represents one of the highest and best uses of the property and; 6) the location of the property would allow mining to be done in such a manner that harm to surrounding interests would be avoided, Kraemer hereby submits the following data in support of the Conditional Use Permit renewal application. OWNERSHIP AND MANAGEMENT DATA In 2011, The Kraemer Company, LLC ("Kraemer") created a real estate subsidiary, TKC Real Estate Holdings, LLC ("TKC"). Owned and leased real estate is handled by TKC while quarry and gravel pit operations aze managed by Kraemec Kraemer and TKC are both headquartered in Plain, Wisconsin. During the construction season, the Company employs over 200 people. The Company and its subcontractors aze fully insured and Kraemer and TKC have public liabiliry coverage in excess of 20 million dollars. Kraemer operates sand and gravel pits and quarries in over 25 Wisconsin counties. Thus, Kraemer has acquired a great deai of expertise in opening operating and restoring pits and quarries and has satisfied the concerns and requirements of rowns, villages, counties and the State of Wisconsin, including the Department of Natural Resources and the Department of Transportation. As high quality aggregate sources become increasi�gly scazce, it is Kraemer's intention to utilize existing sources to their fullest potential in an environmentally acceptable manner. OPERATIONSPLAN The operations on the subject site will continue to be handled by Kraemer and entail the mining of sand and gavel and the subseqoent crushing and sizing of it into mazketable products. The layout of the present and planned pit operations is depicted on [he Operations Plan Map Figure A-4. The size of the future pit excavation within the pertnit boundary is expected to be approximately ten(10) acres. Due to the varying nature of the economy and the aggregate industry it is difficult to determi�e the exact lifespan of the pit. Mining operations at the subject site will consist of several distinctive and progressive stages: L Overburden Removal: The overlying topsoil and unsuitable soiUrock materials (overburden) are removed from the minable reserves and kept in separate stockpiles for future restoration use. Erosion control measures will be implemented as needed on the stockpiled material so as to prevent off site erosion. The area to be stripped of topsoil and overburden and the location of the associated stockpiled materials are shown in Figure A-4. The Kraemer Company,LLC 1 Marwn Property 2. Processine Onerations: The sand and gravel will be extracted along the existing face to the east and the sou[heast once the ' overburden has been removed. After extraction,the sand and gravel will be crushed and sized into the needed products. Portable equipment will be utilized to do any processing. Such equipment will consist of various combinations of crushing and screening units along with supporting equipment such as front-end loaders, backhoes, bulldozers, trucks, conveyors, etc. Because of the varying nature of the aggregate industry, a scale, scale house, and portable sanitary facilities may be placed in the pit as needed. All equipment will be on site only while needed for overburden removal and processing operations. A loader may be kept on site to load customers'trucks and will only be utilized when necessary. Additionally, renewal approval is requested for the placement of a portable temporary hohmix asphal[plant on site,to be used on an"as-needed"basis. At this time,there will not be a need for any water in the processing operations. Any water needed for dust control will be brought on site. No extraction will occur within the defined setbacks for County(Class B)and Town (Class C)roads. The maximum relief of the undisturbed property ranges from about 1250 to 1280 feet. The pit floor extends approximatety 25 feet below the original grade. Considering the natural setting and topography of the azea and the nearest residence distance from the mining operations, the perception of disageeable or uncomfortable noise levels is not anticipated. The azea is sparsely populated, with the Marcon's being the closest residents. The plants will be set at locations greater than 1000 feet from neighboring dwellings. Potential impacts to surrounding residents are restricted because the bulk of the operations will take place in the pit. The undisturbed higher gound at the working face will deflect a large portion oF the sights and sounds generated from the pit. Noise due to aggregate processing is variable in nature and the perception of disagreeable levels depends on the hearer's distance from the source. The monitoring of noise levels is an ongoing worker safety program and is done on a random unannounced basis both by Mine Safety and Health Administration (MSHA) and Kraemer's safety personnel. Some representative noise levels in decibels are: 130 Jet engine Q 00 feet away) 1]0 Jack hammer 80 Hazley Motorcycle 70 Rock Crusher 60 Average conversation ]0 Whisper Mining activiry at the pit is normally limited to the spring summer,and fall construction seasons,bu[often processing operations must be done in the winter to accommodate the early spring construction seasons. The number of[imes a crushing plant and asphalt plant is within the pit and the duration of each operation are lazgely dependent on the quantiry and type of product being produced. Typically,the crushing plant is in the pit an average of two to three times a year for two to four weeks at a time, likely every other year. Likewise, the hot-mix plant would be used, if needed, for about a two week period. As the demand for aggregates in the area increases it may be necessary for the crushing plant and/or hot-mix plant to remain in the pit for longer periods of time. Kraemer proposes to process material from 5:00 am to 10:00 pm with the option to operate 24 hours, 3-4 days in a row, as long as the neighbors are contacted with days and hours, Monday through Saturday, as was approved in the 2010 renewal permit. If required, it is proposed that the hot-mix plant would operate from 5:00 a.m. until 10:00 p.m., Monday through Saturday. When artificial lighting is required, it will only be used to illuminate the work area. 3. Access Road: Access to the pit will continue to be along the present routing via CTH F located on the eastem side of the property on the Bacha property. Dust control measures will be implemented, if a dust problem along the access road should arise. A locking gate is installed at the pit entrance for security and to limit access mto the pit area. EROSION CONTROL AND RECLAMATION The materials placed in temporary or permanent stockpiles will be shaped to blend with the surrounding nahual topography and erosio� control measures (seeding, silt fences, bale checks, etcJ will be implemented as needed until such time as permanent placement, shaping, and seeding is possible. Seeding and mulching will be done with mixtures as per the Wisconsin Department of Transportation standazd specifications for mulching and seeding, Section 627 and 630, respectively (Appendix B). The "Wisconsin Construction Site Best Management Practice Handbook" will also be utilized as a guide to control any erosion, as will the recommendations of the Sawyer County ASCS office. The area cited for crushing and stockpile srorage is relatively flat a�d reduces a potential runoff problem. Additionally, this area is permeable and will allow any runoff waters to infiltrate the substrate. The surrounding azea is vegetated and provides additional protection against fugitive runoff. If needed, silt fences and/or hay bales will be used to control runoff. The present pit operations do not use water and portable sanitary facilities are provided at the site when needed. All fuel storage is above ground and all waste oil and petroleum products are collected and disposed of offsite as required by state and federal regulations. Kraemer must abide by the following environmental regulations enforced by the Wisconsin Department of Natural Resources: NR 135 Nonmetallic Mining Reclamation NR 216 Storm Water Discharge NR 400 Air Quality The Marco� Pit holds a WPDES Pertnit (No. WI-004651 IS-3) with the Wisconsin Department of Natural Resources. The pi[ is intemally drained and therefore the impact to the surrounding surface waters is negligible. Any storm water or melt water that enters the site will remain onsite until it evaporates or infiltrates into the pit floor. If offsite drainage of sediment-laden water should occur, the problem will be fixed immediately with bes[management prac[ices that may consist of a combination of water diversions, berms, silt fencing and/or hay bale check installation. The undisturbed portion of the property drains towards the ponds to[he northeast and noRhwest of the pit or to the low-lying areas to the south. In order to successfully complete this operation, Kraemer recognizes the importance of site reclamation. Sawyer Counry has approved the submitted NR135 Reclamation Plan and a copy is available from the Sawyer County Zoning Departrnent. Marcon Property Operations Plan Map APPENDIX B Wisconsin Department of Transportation Standard Specifications (Section 627:Mulching and Section 630:Seeding) Section 627 Mulching 627.7 Description �,� This section describes furnishing, placing, and anchoring a mulch cover, usually in connection with seeding the surfaces of the roadway. 627.2 Materials �,� Mulching material consists of straw or hay in an air-dry condition,wood excelsior fiber, wood chips, or other suitable material of a similar nature that the engineer approves, and is substantially free of noxious weed seeds and objectionable foreign matter. �z� If using tackifer, the department will prequalify it before use. Select tackifiers from the department's erosion control product acceptability list(PAL). The contractor may obtain a copy of the PAL and the prequalification procedure for products not on the PAL from the department. 627.3 Construction 627.3.1 General c,� Unless directed othervvise, place the mulch on the specified area within 2 days after completing the seeding. �z� The contractor shall not perform mulching during periods of excessively high winds that might preclude proper mulch placement. �a� Place the mulch loosely or open enough to allow some sunlight to penetrate and air to slowly circulate, but thick enough to shade the ground, conserve soil moisture, and prevent or reduce erosion. �n� Maintain the mulched areas and repair all areas damaged by wind, erosion, traffic,fire or other causes. 627.3.2 Placing �,� The contractor may perform the work as specified in one of the following ways: Method A, Method B, or Method C, or a combination of the 3, unless a specific method is specified in the contract. 627.3.2.1 Method A, Netting �,� Uniformly spread the mulching material over the designated areas to a loose depth of 1/2 to 1 1/2 inches. Use a specific rate of application; dependent on the character of the material, that results in a cover conforming to the requirements specified above in 627.3.1. Loosen or make fluffy the mulch material from compacted bales before spreading in place. Unless direded othervvise, begin mulching at the top of the slopes and proceed downward. �z� Securely anchor straw or hay muich by using engineer-approved netting anchored to the ground with pegs or staples to prevent it from floating as the vegetation grows. Instead of this anchorage, the contractor may secure mulch by heavy biodegradable twine fastened by pegs or staples to form a grid with 6 to 10 feet spacing. �s� The contractor may use department-approved erosion control mats, listed in the PAL, instead of separately applying mulch and netting. 627.3.2.2 Method B,Tackifier �,� Treat straw or hay with a tackifier, blow from a machine, and uniformly deposit over designated areas in one operation. Place straw or hay unifortnly over the area 1!2 to 1 inch deep, using 1/2 to 3 tons of mulch per acre. Mix and place tackifier according to the PAL. Within the above limits, the engineer will determine, on the job, the application rate of the mulch and the tackifier, and the engineer may vary the rates during mulching to produce the desired results. Use an engineer-approved machine to place the mulch that blows or ejects by constant air stream a controlled amount of mulch and applies a spray of tackifier to partially coat the straw or hay, sufficient to hold together and keep in place the deposited straw or hay. The contractor may apply the tackifier as an overspray in a separate operation after placing the straw or hay. iz� Apply wood fiber, wood chips, or similar material with engineer-approved blowing machines, or other engineer-approved methods, that place a controlled amount of mulch uniformly over the area 1/2 to 1 1/2 inches deep. Treat areas receiving wood chip mulch,with one pound of available nitrogen per 1000 square feet before or after applying the chips. �a� Throughout the process, feed the mulch material into the blowing machine to produce a constant and uniform ejection from the discharge spout, and operate in a position to produce mulch of uniform depth and coverage. EHecfive with the December 2015 Letting 411 2076 Standard Specifications 627.3.2.3 Method C, Crimping �,� Spread[he straw or hay mulch uniformly over the designated areas to a loose depth of 1/2 to 1 1/2 inches, using 1/2 to 3 tons of mulch per acre, by blowing from a machine, as specified in Method B, or by other engineer-approved methods. �z� Immediately after spreading, anchor the mulch in the soil by using a mulch crimper consisting of a series of dull, flat discs with notched edges. Space the 20 inch diameter discs at about 8 inch centers. Equip the crimper with a ballast compartment to allow adjusting the weight for depth control. �3� Impress the mulch into the soil 1 1/2 to 2 1/2 inches deep in one pass of the crimper. The department will not allow mulch crimpers to operate on slopes so steep that damage to the mulch, seedbed, or soil occurs. Anchor the mulch on these areas by one of the following methods: Method A or Method B. Equip and operate tractors to minimize disturbing or displacing the soil. This process may require more than one pass of the crimper to ensure adequate anchoring of the mulch. �a� The contractor shall not use Method C if it cannot impress the mulch to a minimum of 1 1/2 inch. 627.4 Measurement �,� The department will measure Mulching acceptably completed by the square yard or by the ton,whichever the contract specifies. �z� If ineasured by the square yard, the measured quantiry equals the number of square yards of surface area that the contractor applied the mulch. �ai If ineasured by the ton, the measured quantity equals the number of tons of mulch provided, placed, and acceptably completed. �a� Tackifiers or nitrogen used for treating mulch are incidental to the cost of the work. 627.5 Payment �,> The department will pay for measured quantities at the contrad unit price under the following bid items: ITEM NUMBER DESCRIPTION UNIT 627.0200 Mulching SY 627.0205 Mulching TON �z� Payment for Mulching is full compensation for providing ali materials, including tackifiers or nitrogen;for all hauling, treating, placing, spreading, and anchoring of the mulch material; and for maintaining the work and repairing all damaged areas. �a� If the contractor opts to use department-approved erosion controi mats instead of separately applying mulch and netting, the department will pay for it at the contract unit price for Mulching only. Follow the inoculation instructions that come with the culture purchases. If applying the seed according to method B, 630.3.32, treat seeds requiring inoculation with 5 times the amount of inoculant recommended in the instrudions. �z� Avoid exposure of the culture or inoculated seed to the sunlight, and in no case shall any exposure exceed �/2 hour. 630.2.1.4 Storing Seed i,� Store any seed delivered before use in a way that proteds it from damage by heat, moisture, rodents, or other causes. Place topsoil as specified in 625.3.3. 630.3.3 Sowing �,� Seled the method of sowing from either method A, method B, method C, or an appropnate combination of inethods A, B, and C. Obtain the engineer's approval for the sowing method and specific procedures used for each seed mixture used before sowing that mixture. 630.3.3.7 Method A c,� Sow the selected seed mixture using equipment adapted to the purpose, or by scattering it unifortnly over the areas to be seeded. Lightly rake or drag to cover the seed with approximately 1/4 inch of soil.After seeding, lightly roll or compact the areas usi�g suitable equipment, preferably the cultipacker type,when the engineer judges the seedbed too loose, or if the seedbed contains clods that might reduce seed gertnination.The contractor shali not roll sfopes steeper than '1:3. �z� If scattering seed by hand, peAorm this work with satisfactory hand seeders and only when the air is calm enough to prevent seeds from blowing away. 630.3.3.2 Method B �i� Sow or spread the seed upon the prepared bed using a stream or spray of water under pressure and operated from an engineer-approved machine designed for that purpose. Place the selected seed mixture and water into a tank, provided within the machine, in sufficient quantities that when spraying the seed on a given area it is uniformly spread at the required application rate. During this process, keep the tank contents stirred or agitated to provide uniform distribution. Spread the tank contents within one hour after adding the seed to the tank. The e�gineer will reject seed that remains mixed with the water for longer than one hour. The engineer will not require dragging or rolling. 630.3.3.3 Method C �,� For spring seeding of seed mixtures 70 and 70A into existing ground cover, mow existing vegetation to 4 inches or less in height 2 to 4 weeks before seeding. Ten to 14 days after mowing, spray with vegetation control herbicide confortning to 6322.12. �z� For fall seeding of seed miutures 70 and 70A into existing ground cover, mow existing vegetation to 4 inches or less in height 4 to 6 weeks before seeding. Ten to 14 days after mowing, spray with vegetation control herbicide conforming to 6322.12. Retreat with vegetation control herbicide 10 to 14 days after initial application if live vegetation persists.
