Summary of Request: The applicant(s) are requesting for the relocation of an existing cocktail
lounge. As per section 17.2 (B)(3) of the Sawyer County Zoning Ordinance recreational service
oriented use such as "cocktail lounges" is a use authorized by conditional use.
Project History: Since the location of the existing use on the same parcel is being relocated and
no record of an existing CUP for the cocktail lounge was found it was determined by the Sawyer
County Zoning Department that a new CUP must be granted for this request. The new structure
is to meet all setbacks, be of similar size, and have the same type of existing use (cocktail
lounge/paper food service only).
The existing cocktail lounge is approximately 1700 square feet. The new structure would be
approximately 2000 sq feet but the applicant would like to keep options open for future
expansion if needed. As part of this request the existing cocktail lounge would be razed.
This property is subject to the 100' bufferzone requirement setbacks unique to the Chippewa
Flowage. The proposed structure would meet these setback requirements.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.
Possible Conditions for Approval: (choose from list below) (add or delete from list below)
1 Land Use Permits are required for all structures; this would also include impervious
surface requirements.
2 All other town, County, State, Federal Laws are followed
3 Any and all signage must meet Sawyer County Zoning Ordinance requirements.

I'll have to run to the Register of Deeds to confirm,but I believe their entire parcel is encumbered by the 100'covenant

NOTICE OF PUBLIC HEARING DATE
CUP 19-047; Big Musky Resort LLC
Your application for a Conditional Use will be considered at a Public Hearing before the Sawyer County
Zoning Committee on December 20,2019.
This Hearing will begin at 830 A.M. in the Sawyer County Courthouse, 10610 Main Street, Hayward,
Wistonsin.
It is recommended that either you or a representative be present at the Hearing. A lack of information
about the application may result in unnecessary delay of a decision. Failure to appear may also result in
the denial of the application.
If it is impossible for you or a representative to be present, please submit a written statement directed to
Ronald Buckholtz, Chairman of the Zoning Committee addressed to this office. The statement should
include your proposed intentions or purpose of the request and a description of the general terrain and
surrounding development. Indicate how the proposal would not be contrary to the public interest.
Photographs of the property and surrounding area are encouraged.
Your application will also go before the Town Board for their review. Some townships also have a
Planning Commission. Please contact the Town Clerk,Patricia Swaffield at 715-462-9429 or email at
townhunter@centurvtel.net for the day and time of the Planning Commission and Town Board meetings
for your attendance or the attendance of your agent.
