Prt NE 1/4 SW 1/4 and Prt NW 1/4 SW 1/4 S23 T37N R07W. Parcel# 030-737-23-3101 , -3201 .
Property is Zoned Agricultural One (A-1) and is 22.3 calculated acres. Current operation is
approximately 12 acres with proposed expansion up to 15acres. This is known as Blomberg Pit.
Request: The three (3) year renewal of conditional use permit #03-012 for the location of a non-
metallic mineral extraction operation, including rock crusher. The CUP was originally approved
at public hearing on December 20, 2003 and renewed most recently August 16, 2016.
Project History & Summary of Request
The renewal of CUP 03-012 is for the location of a non-metallic mineral extraction
operation including rock crusher. Originally this CUP was approved in Dec of 2003 and renewed
on time with every renewal deadline. On August 16, 2016 the applicant had requested an early
renewal on the existing CUP in order to amend the application to include an asphalt plant. The
asphalt plant in no longer in operation or is being requested as part of this renewal. If the
applicant was to renew the existing CUP when it was up for renewal it would have expired in
December 2019. In other words the use of the non-metalic mineral extraction and rock crusher
operation wouldn't have expired until December 2016 and a 3 year renewal would have been
granted from that time. For this reason the Zoning & Conservation Department has viewed this
as a standard renewal and not a "carry-forward".

The property is 22.3 acres and zoned� with the current mining site with potential
expansion being approximately 15 acres. The existing land use in this area is light residential and
agriculture. The nearest residence is over 1000' away.
The Sawyer County Zoning & Conservation Department currently does not have any
complaints for this file.
The normal hours of operation are 6 AM to 9 PM, Monday — Saturday, April 1 — Dec 1
with crushing from SAM-l OPM 1-2 times per year from.
Financial assurance has been received for$12,000 and would expire 12/1/19.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

Part of the N 1/2 of the SW '/4 of Section 23 T 37 N — R 7 W
3. Size of Property (acres)
This parcel is approximately 23 acres in size
4. Size of actual mine site
The original mine site was approximately 3 acres in size. Expansions could open the
mine site up to approxima#ely 15 acres in size.
5. Proposes activities
The appiicant plans to extract sand and rodc for the processing of gravel_ Activities will
be crushing, stxeening, and stockpiling of materials. Crushing and screening operations
will take place every 1 to 2 years. No, blasting will take place at the site.
6. Hours of operation
Normal hours of operation will be from 6 am to 9 pm. During this time, the loading of
trucks will take place.
Crushing and screening hours will be from 5am to 10 pm. These hours will be used
during crushing activities only.

The pit may be operated Monday through Saturday,April 1"through December 1".
However,operation wiil not be sbeady and wiil be based on dema�d for the product due
to projeds in the area.
8. Access route(s)
7he existing access on Whitiodc Road will be used to enter and exit the site. Trucking
routes will follow STH 40. Ail load restrictions will be following during spring thaw times.
No driveway permit will be required on Whitlock Road.
9. Major equipment to be used during the operation
Normal equipment to be used will be limited to dump trucks and loaders.
During time of crushing,screening and pit expansion,dozers,excavators,conveyors,and
mobile crushing and screening equipment will be present. The crushing operation will not
take place within 1000 feet of any residence.
10.Eucavation
The excavation will tertninate 15 to 20 feet below the roadway surface or at an elevation
of approximately 1185 SLD. The pit will be setback a minimum of 75'from all side and
rear lot lines. The existing woods will serve as a buffer on the south,east,and east sides
of the expvation.On the north side,the existing hill will be taken to the road bed surface.

The pit will not be directly adjacent to any lot lines.
12.Navigable water and wetlands

A NR 216 Storm water Pertnit has been obtained from WIDNR. The site will be bertned
shut so that there is no discharge of storm water. It is class�ed with the DNR as an
internally drained site.
14.Erosion control measures
Erosion control will be handled by keeping al storm water inside the pit. A topsoil berm
will be installed around the pit to insure that runoff is not discharged.

Dust will be handled with the spreading of water on hauls roads.
Vibration is not expected to be a problem since no blasting is to occur.
Screening will be done near Whitlock Road to minimize impact on adjacent properly
owners.
The spilling of fuel and other contaminarrts wiil not be allowed. In the case of an
accident, contaminated soil will be removed from the site and disposed of properly.
The majority of the mining will take place in the existing pit or in pit expansions. During
reclamation of the pit, the site will be retumed to a natural setting.
16. Proposed supporting activities
The operation will mainly support state, courrty arxi town road construction projects.
Some material will also be sold commercially.
17. Reclamation plan
Mining will be in the existing or expanded pit area. Some progressive reclamation would
take place approximately every two years or before is possible. The reclamation would
proceed as follows:
1 .) Regarding of pit to 3:1 max slopes
2.) Reapplication of overburden material
3.) Spreading of all topsoil
4.) Seeding of all disturbed areas
5.) Mulching of entire site
6.) Monitoring to insure germination
The entire site is to be restored with topsoil and seed/mulch.
All salvaged and available topsoil will be used to restore site.
Site wil( be seeded and mulched per current DOT Specs using seed mix No. 50. Site will
be monitored until vegetation has succeeded.
The site will be developed into a prairie/wetland.
