Any person or persons jointly aggrieved by the decision of the Zoning Committee may commence an action

Request: Three year renewal of conditional use permit #96-015 for location on a non-metallic
mineral extraction operation including rock crusher and bituminous plant. Originally approved
A� August 16, 1996 and most recently renewed October 21, 2016.

The renewal of CUP 96-015 ' for the location of a non-metallic mineral extraction
� operation including rock crusher d bituminous plant. The property is 210 acres with the current
operation area of approximately 5 acres. Surrounding use is forestry and agriculture with the
nearest residence at 3800'.
The Zoning Department does not show any complaints on file for this site. Futurewood
Corp owns all other immediately surrounding properties.
Financial assurance has been received in the amount of $3000.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
ar speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve ar deny the permit must be supported by substantial evidence.

OPERATION ACTIVITY
Proposed activities may include:
The site will be used minimally for the next 5 years, for we anticipate only internal use of said site for upgrading personal
property.

Hours of Operation
Normal operation will be from 6AM to 7PM, Monday through Saturday. Crushing and asphalt operations will be conducted
for three to six weeks per year. The proposed operating hours for crushing operations are from 6AM to 6PM, excluding
holidays. These operations are conducted by secondary firms, which use portable equipment.
Access Route
The access road to the sand and gravel pit is through the driveway entrance off of North End Road in Section 19, T.38N.-
R.8W. Surrounding roads to be used are Blackberry Lane, County Highway F, Chapel Road, Summit Lake Road, Comet
Road, Yarnell Road, Right of Way Road and County Highway C.

OPERATION EQUIPMENT
Sand, gravel and asphalt operation equipment will include a portable crusher, screening plant(limited use), washing
machinery, loaders, dozers, dump trucks, portable conveyors, scale, machine maintenance equipment and other related
aggregate producing equipment. Machinery will be located within the 200 acre proposed site, said site, and its entirety,
being in excess of 1,000 feet from any residence.
OPERATION PLAN
Erosion Control
Runoff from existing and future extraction areas will be controlled within the project site with berms and natural barriers.
During extrection operations, the perimeter slopes will be steeper than two feet horizontal to one foot vertical (2:1 slope)
when the depth exceeds ten feet. During the operation of the pit, erosion control will be maintained so that all soil will not
leave the main pit area on the Futurewood property.The existing slopes will be maintained during the operation of the pit.
New expansion area slopes will follow Sawyer County ordinance.
Environmental Considerations
All operations will be performed in a manner that will minimize, insofar as precticable, the production of noise, vibration or
dust that would be hazardous or substantially annoying to persons located off the premises.
No bodies of water or streams are located within or adjacent to the proposed site. Two borings were completed in 1990
showing the water table to be in excess of 25 feet below the lowest point of the valley floor,which has an elevation of
1,360 feet. No excavation will be performed below the 1,360-foot elevation on the proposed site.
It is anticipated that present and existing logging roads would be upgraded as necessary to act as access roads to the
municipal highway system.
Market roads will be via South on Yarnell Road, East on Comet Road to County Highway C and West on Chapel Road to
County Highway F.

Size of Property: 200 acres, more or less. Said site rises from a base of
1 ,360' elevation to a Plateau of 1 ,460' elevation.
Use of Property: Exploration and operation of the necessary machinery to extract, store, and remove non-
metallic minerals in the forma of sand, gravel, stone and the processing of the same onsite,
include the minor blasting of rock.
Extraction Sequence
Approximately 30,000 tons will be extracted each year. The perimeter slopes on the new extraction will be a 2:1 slope or
flatter. Topsoil, overburden and the sand and gravel will be stockpiled on the present pit area.

RECLAMATION PLAN
Reclamation will begin by following the Wisconsin DNR ordinance — NR 135. The goal off our reclamation plan is to return
natural vegetation to the area after the sand, gravel and stone have been extracted from the site. Futurewood Corp will
conduct the reclamation process. This will take place after the entire site has been exhausted of sand, gravel and stone.
Updates:
Last time Futurewood Corp. processed material was in August of 2017.
Approximately 20,000 tons of material was processed.
Current size of the actual pit is estimated to be 6.01 acres.
