Originally approved August 15, 2014. Expires August 15, 2019 with an application received before the expiration date. Project History & Summary of Request: The renewal of CUP 14-008 is for the location of a non-metallic mineral extraction operation including rock crusher. The property is 600 acres with only 80 acres being considered as part of this request. The current operation area is approximately 4 acres. Surrounding use is forestry with the nearest residence at 5700'. The Zoning Department does not show any complaints on file for this site. There seems to be some confusion with nearby land owners as to where this pit is actually located. Pursuant to NR 135.02(2) municipalities are exempt from financial assurance requirements. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the permit must be supported by substantial evidence. This pit is also used by the Town of Draper,where they occasionally crush gravel,and have gravel stock piled. This pit provides gravel for 60 miles of DNR owned and maintained roads.
