Conditional Use Permit q19-040 with conditions:

Request: Three year renewal of conditional use permit #14-008 for location on a non-metallic
mineral extraction operation including rock crusher. Originally approved August 15, 2014.
Expires August 15, 2019 with an application received before the expiration date.
Project History & Summary of Request:
The renewal of CUP 14-008 is for the location of a non-metallic mineral extraction
operation including rock crusher. The property is 600 acres with only 80 acres being considered
as part of this request. The current operation area is approximately 4 acres. Surrounding use is
forestry with the nearest residence at 5700'.
The Zoning Department does not show any complaints on file for this site. There seems
to be some confusion with nearby land owners as to where this pit is actually located.
Pursuant to NR 135.02(2) municipalities are exempt from financial assurance
requirements.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.
Possible Conditions for Approval: (choose from list below) (add or delete from list below)
1 Maintain compliance with NR 135 (reclamation plan)
2 Maintain compliance with Plan of Operation including current days and months of
operation. 5 days a week (Monday-Friday) during the construction perios of May through
November. The crushing contractor and screen contractar man want to work additional
days during those operations.
3 Maintain compliance with Department of Natural Resources Chapter 30

a. Roadways to be used — Payne Farm Road (Partially a State Forest Road and part
township road) will be the roadway used to connect to State Hwy 70.
b. Driveway Permit — No permit required.

a. Crusher—Gravel crushing is planned at this site.
b. Asphalt Hot Mix Plant —There will be no asphalt produced at this site.
c. Screening Plant —A screening operation is planned at this site.

e. Other— Bulldozers, excavators, and backhoes may be used to remove stumps
and strip topsoil during pit expansion.

I apologize for the short notice,but I will no longer be able to attend this hearing in person,and do not have anyone
available to do so on my behalf.
The comments that I would've made in person at the hearing are:
This pit is owned and operated by the WI DNR,and is completely surrounded by State owned land. This pit is also used
by the Town of Draper,where they occasionally crush gravel,and have gravel stock piled. This pit provides gravel for 60
miles of DNR owned and maintained roads. Gravel crushing recently occurred at this pit,and it is anticipated that it will
not occur again within the timeframe of this permit. The pit will primarily be used for the stockpiling of gravel.

Your applica[ion for a Conditional Use will be considered at a Public Hearing before the Sawyer County
Zoning Committee on August 16,2019.
This Hearing will begin at 830 A.M. in the Sawyer County Courthouse, 10610 Main Street, Hayward,
Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of information
about the application may result in unnecessary delay of a decision. Failure to appear may also result in
the denial of the application.
If it is impossible for you or a representative to be presen[, please submit a written statement directed to
Ronald Buckholtz, Chairman of the Zoning Committee addressed to this office.The statement should
