Request: The request is for the after-the-fact construction of a 41 ' x 12' accessory structure
subject to Section 4.26(1) of the Sawyer County Zoning Ordinance:
1 ) The construction of a single accessory structure on vacant property may
be allowed under this subsection by Conditional Use with mandatory
conditions required on approval for the following:
a) that within 3 years a Land Use Permit for a principal dwelling be
applied for, and
b) the principal dwelling to be built within the permit time frame on the
same parcel, and
c) that failure to build principal structure will result in citation and order
for removal of accessory structure, and
d) approval by Town and Zoning Committee.
Project History & Summary of Request
The after-the-fact accessory structure already exists on the property and was placed there within
the last 2 years without permits. This accessory structure is roughly 41 ' x 12' and meets all other
setbacks. As per conversations with the applicant(s) they are aware of the 3 year time frame
criteria to obtain a Land Use Permit from the Sawyer County Zoning & Conservation
Department for the principal structure.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

On May 20, 2019 I addressed a complaint our office received for shoreline clearing near this
area. While there appeared to have been clearing operations that may have occurred in the past
on this parcel in question, the revegetation of this lot has started to occur. Please contact our
office prior to removing additional vegetation or potential grading/filling operations.
As part of the onsite inspection I did observe a 41 ' x 12' accessory building on the property with
no permits. The Sawyer County Zoning & Conservation Department requires Land Use Permits
for all structures within the shoreland district and requires fees for those in excess of 100 square
feet. Furthermore, accessory structures are not allowed on vacant property (properties that do not
contain a principal structure).
Please contact me by June 28, 2019 so that we can discuss this matter.

This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main Street, Hayward,
Wisconsin.
It is re[ommended [hat either you or a representative be present at the Hearing. A lack of information
about the application may result in unnecessary delay of a decision. Failure to appear may also result in
the denial of the application.
If it is impossible for you or a representative to be present, please submit a written statement directed to
Ronald Buckholtz, Chairman of the Zoning Committee addressed to this office.The statement should
include your proposed intentions or purpose of the request and a description of the general terrain and
surrounding development. Indicate how the proposal would not be contrary to the public interest.
Photographs of the property and surrounding area are encouraged.
Your application will also go before the Town Board for their review. Some townships also have a
