36.8 acres currently zoned Forestry One (F-1) as of 8/8/19. Zoning Committee has
recommended approval to rezone 10.0 acres to RR-2 which will be heard for final
ratification on 8/15/19 at County Board
Project History and Summary of Request: With the tentative rezone ratification approval the
purpose of this request is for a full time landscaping business and accounting firm. As per section
17.3 (B)(3) of the Sawyer County Zoning Ordinance recreational service oriented use that in the
opinion of the Sawyer County Zoning Committee are of the same general character or clearly
incidental to a permitted use ar use authorized by conditional use. Section 17.3(B)(7,8&13)
would allow for a greenhouse/florist, professional offices and studios, and tree nurseries with a
conditional use. It was determined by the Sawyer County Zoning Administrator that a
landscaping and accounting firm would be of the same character ar clearly incidental to those
uses previously described and that a CUP be applied for at the Zoning Committee level under the
tentative rezoning to the RR-2 zone district.
Initially the applicant/agent wanted the option to build a 60'x60' structure for full time
landscaping business and accounting firm. 66% of the structure would be used for heavy
equipment storage and repair. The remaining 33% would be used for offices for Collins Custom
Landscape & Collins Accounting & Tax Service. However, the applicant does not want to limit
the potential size of the building(s) if the business was to expand in the future. The
applicant/agent is now requesting for buildings or structures for heavy equipment storage
associated with the landscaping business and general office use without limitations on additional
buildings in the future as long as the use does not change and that all other setback requirements
are met.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.
