Property is zoned Agricultural One (A-1) and is 40 total acres. Request: Three (3) year renewal of conditional use permit #88-017 for the location of a non- metallic mineral extraction operation, including rock crusher and hot mix plant. Originally approved 07/15/88 and most recently renewed on 09/16/16 Project History & Summary of Request The request is for the renewal of the location of a non-metallic mineral extraction operation, including rock crusher and hot mix plant. The property is 40 acres and zoned A-1 with the pit area of approximately 10 acres. The surrounding land use in this area is light agricultural and residential. The nearest residence other than the owner 1000' away. The Sawyer County Zoning & Conservation Department currently does not have any complaints on file for this pit. However, in the past there has been concerns from nearby residences that it will decrease property values and may be harmful to surrounding waters and land usage. The current hours of operation are indicated as SAM — 10 PM with option to operate 24 hours, 3-4 days in a row, as long as the neighbors are contacted with days and hours, Monday- Saturday. Crushing is to occur 2-3 times per year for 2-4 weeks at a time, likely every other year. If required, it is proposed that the hot mix plant would operate SAM- l OPM, Monday-Saturday. Financial assurance has been received for $10,580 and expires in the form of a bond. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the permit must be supported by substantial evidence. The existing pit is located on land owned by Derrick Smith in the Town of Edgewater, Sawyer County. An Access Road Agreement was drawn between TKC Real Estate Holdings, LLC("TKC"), a wholly- owned subsidiary of Kraemer, and Derrick Bacha("Bacha") in 2010 now McCabe. Thc original permit was approved on July 15, 1988 and most recently renewed for another three(3)year terrrt on September 20]6.Thc properties arc described as follows: Marcon-A 10-acre plot in the South one-half of the Northeast One-quarter of the Southeast One-quartcr of the Southeast One- quarter and the North onc-half of the Southeast Onc-quarter of the Southeast One-quarter of the Southeast One-quarter,all in Section 30,Town 37 North,Range 9 West,Town of Edgewatcr,Sawyer County,Wisconsin. McCabe—The existing access located on the McCabe property in Outlot 3 of Certified Survcy Map#7645 in the Southwcst One- quarter of the Southwest Qne-quarter,west of CTH F,Section 29,Town 37 fYorth,Range 9 West,Town of Edgewater,Sawycr County,Wisconsin. OWNERSHiP AND MANAGEMF,NT DATA fn 201 I,The Kracmer Company, LLC("Kraemer")created a real estate subsidiary,TKC Real Estate}{oldings, LLC("'fKC"). Owned and leased real estate is handled by TKC while quarry and gravel pit operations are managcd by Kraemer. Kraemer and TKC are both headquartered in Plain, Wisconsin. During the construction season, the Company employs over 200 people. The Company and its subcontractors are fully insured and Kraemer and"I'KC have public liability coverage in excess oi'20 million dollars. Kraemer operates sand and gravel pits and quarries in over 25 Wisconsin counties. Thus, Kraemer has acquired a great deal of expertise in opening, operating and restoring pits and quarries and has satisfied the concerns and requirements oFtowns, vilfages, counties and the State of Wisconsin, including the DepaRment of Natural Resources and the Department of'['ransportation. As high quality abgregate sources become increasingly scarce,it is Kraemer's in�ention to utilize existing sources to their fullest potential in an eavironmentally acceptable manner. OPERATIONS PLAN �'he operations on the subject site will continue to be handled by Kraemer and entail the mining of sand and gravel and the subsequent crushing and sizing of it into rnarketable products. "I'he layout of thc present and planned pit operations is depicted on the �perations Pian Map Figure A-4. The si�e of the future pit excavation within the perr►�it boundary is expected to be approximately ten (10}acres. Due to the varying nature of the economy and thc aggregate industry it is difficult to dctermine thc exact lifespan of the pit. The number of times a crushing plant and asphalt plant is within the pit and Ihe duration of each operation are largely dependen[on[he quan[ity and type of product being produced. Typically,[he crushing plant is in the pit an average oFtwo[o[hree[imes a year for Iwo to four weeks at a time,likely every other year. The present pit operations do not use water and portable sanitary facilities are provided at the site when needed. All fuel storage is above ground and all waste oil and petroleum products are collected and disposed of offsite as required by state and federal regulations. Kraemer must abide by the following environmental regulations enforced by the Wisconsin Department of Natural Resources: NR l35 Nonmetailic Mining Reclamation NR 216 Storm Watcr Discharge NR 400 Air Quality The Marcon Pit holds a WPDES f'ermit (No. W1-00465 1 1 5-6) with the Wisconsin Department oF Natural Resources. The pit is intemally drained and therefore the impact to the surrounding surface waters is negligible. nny storm water or melt water that enters the site will cemain onsite until it evaporates or infiltrates into the pit floor. If offsite drainage of sediment-laden water should occur, the problem will he fixed immediately with best management practices that may consist of a combination of water diversions, berms, silt fencing ancUor hay bale check installation. The undisturbed portion of the property drains towards the ponds to the northeast and northwest of the pit or to the 1ow-lying areas to the south. In order to successfully complete this operation, Kraemer recogni�cs the importance of site reclamation. Sawyer County has approved the submitted NR135 Reclamation Plan and a copy is avai(able from the Sawyer County Zoning Department.
