Originally CUP was approved June 21, 2002 and last renewed July 15, 2016. � Project History & Summary of Request The renewal of CUP 02-004 is for the location of a non-metallic mineral extraction operation including rock crusher. The property is 48.53 acres and zoned F-1 . As per the plan of operation the mine site is consisting of approximately 3 acres. Surrounding use of the property is forestry. There are several other residential structures in the area with the closest at approximately 700'. Historically our office has not received complaints for this pit. However, there has been a recent development pattern to the west of this pit area over the last 4-5 years and currently we do have some concerned citizens. The current normal hours of operations are 6AM— 8PM Monday — Friday with rock crushing from 7AM-7PM. Operation from April through October. Crushing contractor may want to work additional days during those crushing operations. Pursuant to NR 135.02(2) municipalities are exempt from financial assurance requirements. There is also an active timber sale pending on this property. Zoning Committee would not be able to further limit vegetative buffer requirements. Topography of this site would limit any erosion issues for gravel pit operations to nearby properties. Also timber is a selective harvest that would leave all oak and pine trees. Additional information for Conditional Usc Permits: Substantial evidence means facts and informaYion,other than merely personal preferences or speculation,directly pertaining to the requirements and conditions an applicant must meeY to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specitied in the county ordinance or those imposed by the county zoning board,the county shall grant the conditional use permit.Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence.The conditions must be reasonable and,to the extent practicable,measurable.The applicant must demonstrate Yhat the application and all requirements and conditions established by the county relating to Yhe conditional use are or shall be satisfied,both of which must be supported by substantial evidence.The county's decision to approve or deny the permit must be supported by substantial evidence.
