Notice is hereby given that on June 21,2019 the Sawyer County Zoning Committee approved the
following application:
Part of the SE%of the SW%and the SE%;514,T37N,R03W;Parcel q032-337-14-3401;200 Total Acres;
Zoned Forestry One(F-1). Permit desired for the three(3)year renewal of conditional use permit ti05-044
for the location of a non-metallic mineral extraction operation,induding rock crusher located on 39.61
acres of[he 200 acre parcel.The CUP was originally approved at public hearing on May 20,2005 and
most recently renewed on July 15,2016.
Motion by Paulsen to approve the application with NR135,Chapter 30 DNR,second by Voight. All in
favor.
Findings of Fact: It would not be damaging to the rights of others or property values.
Any person or persons jointly aggrieved by the decision of the Zoning Committee may appeal the decision
to the Sawyer County Board of Appeals to review the legality of the decision within 30 days after the date
of this notice.

Request: Three year renewal of conditional use permit OS-004 for non-metallic mineral
extraction operation including rock crusher and screen plant. Originally approved May 20, 2005
and last approved July 15, 2016.
Project History & Summary of Request
The renewal of CUP OS-004 is for the location of a non-metallic mineral extraction
operation including rock crusher and screening plant. The property is 200 acres and zoned F-1 .
As per the plan of operation the mine site is consisting of 39.61 acres. Surrounding use is
forestry. There is one residence in the vicinity at approximately 2000'. Our office shows no
complaints on file for this site. .
The current normal hours of operations are 6AM— 6PM Monday — Friday with rock
crushing from 6AM-9PM. Operation from May through November with crushing and screening
contractor may wanting to work additional days during those operations.
The State of Wisconsin Department of Natural Resources assures this gravel pit
operation.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are ar shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

a. Location: The Price Creek Pit is located on the southern loop of Price Creek Road
in the Town of Winter, Sawyer County, Wisconsin. A map is included showing
the pit location in relation to neighboring properties.
b. Ownership: The property is owned by the State of Wisconsin, and managed by
the Dept. of Natural Resources as the Flambeau River State Forest.

7. Days and Months of Operation:
The Flambeau River State Forest will normally operate this pit five (5) days a week
(Monday - Friday) during the construction period of May through November. The
crushing contractor and screening contractor may want to work additional days during
the crushing and screening operations.
8. Access Routes:
a. Roadways to be used — Price Creek Road (A State Forest Road) will be the
roadway used to connect to County Highway M.
b. Driveway Permit— No permit required.
9. Major Equipment to be used During the Operation:
a. Crusher—Gravel crushing is planned at this site.
b. Asphalt Hot Mix Plant—There will be no asphalt produced at this site.
c. Screening Plant—A screening operation is planned at this site.
d. Washing Equipment—There will be no aggregate washing at this location.
e. Other— Bulldozers, excavators, and backhoes may be used to remove stumps
and strip topsoil during pit expansion.
10. Excavation:
a. Depth —The existing depth averages 25' across the face and will not vary
considerably as the pit expands.
b. Setbacks to lot Lines — No Setbacks are planned for this pit.
c. Buffers— No Buffers are planned for this site.

a. Fencing—There is no plan to fence this site.

a. Surface Water Protection: The pit will be internally drained.
b. Groundwater Protection —The floor of the pit will act as a sediment basin.

a. Noise — Noise will be restricted to operation hours.
b. Dust— Dust will be minimized through watering by the contractor if necessary.

This Hearing will begin at 8:30 A.M.in the Sawyer County Courthouse,10630 Main Street,Hayward,
W isconsin.
I[is recommended that either you or a representative be present at the Hearing. A lack of information
about the application may result in unnecessary delay of a decision. Failure to appear may also result in
the denial of the application.
If it is impossible for you or a representative to be present,please submit a written statement directed to
Ronald Buckholtz,Chairman of the Zoning Committee addressed to this office.The statement should
include your proposed intentions or purpose of the request and a description of the general terrain and
surrounding development.Indicate how the proposal would not be contrary to the public interest.
