Notice is hereby given that on August 16,2019 the Sawyer County Zoning Committee approved the
Conditional Use Permit#19-030 with conditions:
Property Description:Part of the SE%of the SW'/<,Lot 1 CSM 20/95#5793;513,T41N,R06W;Parcel
k024-641-133402;7.53 Total Acres;Zoned Forestry One(F-1). Permit is desired a 45'x 72'for an
accessory structure subject to Sawyer County Zoning Ordinance Section 17.8(B)(14)&4.26(1);Land Use
Permit applied for within 3 years for habitable structure with septic.This was postponed from the June 21,
2019 Zoning Committee meeting.
Motion to approve the application by Nyberg with conditions,second by Voight.
Conditions of:Land Use Permit is applied for accessory structure within 1 year from the date of Zoning
Committee decision and Town Board approval for building within the F-1 zone district.Land Use Permit is
applied for the principal structure within 3 years from the date of Zoning Committee decision including
other necessary zoning permits. Failure to apply will result in citation with potential order for removal of
accessory building. Proposed accessory building must met all other Sawyer County Zoning&Conservation
requirements and compliant with all other State and Federal Laws. Size of proposed accessory structure
not to exceed 45'x 72'. Not to be used for commercial use. Zoning&Conservation recommendation[hat
that a 50'buffer of undisturbed vegetation remain from all property lines minus the driveway access.

Request: The request is for a 45' x 72' accessory building subject to Section 4.26(1) of the
Sawyer County Zoning Ordinance:
1). . ..The construction of accessory buildings on vacant property may only be allowed by Conditional
Use with Town and Zoning Committee Approval. Granting of a Conditional Use will require within 3
years for a principal dwelling Land Use Permit to be applied for and the principal dwelling to be built
within the permit time frame on the same parceL Failure to build principal dwelling will result in citation
and order for removal of accessory structure
Project History & Summary of Request
The applicant is proposing to build a 45' x 72' accessory building. Future plans would be to
either add habitable living area within that structure that meets uniform dwelling code (UDC)
requirements or placing a separate small principal structure that meets dimensional within the
specified 3 year time frame criteria to obtain a Land Use Permit from the Sawyer County Zoning
& Conservation Department.
The property is zoned F-1 and would also require a Town Board approval and Zoning
Administratar approval to build a residential structure. If the applicant was to include habitable
living area on that property or in the proposed structure this case would not be held as a public
hearing process at the Zoning Committee level. In conversations with the applicant, Mr. Scheer
wants to precede with the Conditional Use Permit requirements as to have flexibility with time
frame requirements to build or include the principal structure/use. The applicant is aware of the 3
year time frame criteria to obtain a Land Use Permit from the Sawyer County Zoning &
Conservation Department for the principal structure. The proposed structure would meet all other
setbacks.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.
