Notice is hereby given that on June 21,2019 the Sawyer County Zoning Committee approved the
following application:

Total Acres;all zoned Agricultural One(A-1).Permit is desired for the three(3)year renewal of condi[ional
use permit NO2-008 for the location of a non-metallic mineral extraction operation,including screening
plants and rock crusher which was approved at public hearing May 17,2002 and most recently renewed
June 17,2016.
Motion by Voight to approve the application subject to NR135,Chapter 30 DNR and new hours of 7am-
7pm,second by Bassett.All in favor.
Findings of Fact: It would not be damaging to the rights of others or property values. It would not be
detrimental to ecology,wild life,wetlands or shorelands.
Any person or persons jointly aggrieved by the decision of the Zoning Commi[tee may appeal the decision
to the Sawyer County Board of Appeals to review the legali[y of the decision within 30 days after the date
of this notice.

Project History & Summary of Request
The location of a non-metallic mineral extraction operation, including screen plant and
rock crusher. The property is 79 acres and zoned A-L The sunounding land use in this area is
light agricultural and forestry. The nearest residence other than the owner is '/< mile away.
The Sawyer County Zoning & Conservation Department currently does not have any
complaints for this file.
The current hours of operation are indicated as approximately from 7:00 AM to 5 PM, 5
days a week. 8 months a year.
Financial assurance has been received for $7,500 and expires 08/30/19 in the form of an
inevocable letter of credit.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

Existing gravel pit is approximately 5 acres out of 80 acres total—Permit#02-008 and is
located approx.4 mi south of the village of Winter.
The Owner ofthe property is Ralph Petit.N3881 Old J Rd.Winter,Wi.The Operator of
the pit is R&P Earthworks W7064 Fadness Rd.Winter,Wi.
Plan of Operation
The proposed use would be the extraction of gravel and operating a rock crusher on a as
needed basis.
_We started this gravel pit in 2002 to level the gravel ridge that was sepazating our
property.We aze now at the end of the sepazating ridge and will be moving into a larger
ridge to connect the 2 existing fields on the properiy.The new plan will excavate approx.
200 fr.South,80 ft.wide,and 25'high.
The current mine site is approx.5 acres.A new access road��ill be constructed across
the existing field on Old J Rd.to allow access to the pit and reclamation of approx.4
acres to the north.We have moved the grauel pile and operations to allow for
reclamation.
_The hours of operation would be normal hours approx.7 a.m.-5 p.m.5 days a week,
approx.8 months a yeaz.Personal use of the pit by the Owner would be done on
weekends,if needed.
_Access routes would be the Town of Winter Roads Old 70 and Old J Road.
The neazest principal structures would be the Owners home approx.'/<mile away.
The lot lines are not an issue since the Owner has control of all surrounding properry.
There is no navigable water or wetlands within 500'
_Erosion control measures will be used as needed such as seeding and mulching of sloped
azeas in the reclamation.
Environmental considerations will be minimal because of the small size and topography
of the operation.The site is in the country,off the road,with the neazest neighbor'/<mi.

The original pit of approximately 5 acres is scheduled to be reclaimed in 2020. The location of this pit
is approximately 4 miles south of the Village of Winter.
The owner of this property equaling 40 acres is Ralph Petit, N3881 Old J Road, Winter WI. The
operator is R&P's Earth & Forest Works, W7064 Fadness Road, Winter WI.
R&P's recently purchased the 40 acres to the west of the original pit and has extended into this 40
acre parcel. The new pit is currently approximately one acre, but there is an area approximately 100'
x 100' on the Petit 40 acres, where the stockpile of gravel currently sits.
Plan of Operation
The proposed use will continue to be the extraction of gravel and operation of a rock crusher on an as
needed basis.
The original pit was started in 2002 to level the ridge of gravel in the middle of the 80 acre parcel.
The new plan will be to excavate approximately 200' south, 80' wide and 25' high.
A new access road will be constructed across the field on Old J Road to allow access to the pit and
reclamation of the original pit area.
The hours of operation would be approximately 7:00 a.m. to 7:00 p.m., 5 to 6 days a week,
approximately 8 months a year. Personal use of the pit by the owner wouid be done on weekends as
needed.

The nearest principal structure is the Ralph Petit house, approximately '/4 mile away.
